And one who is impure by a corpse one who touches a corpse is a primary source of impurity. The corpse itself, however, is a super-primary source of impurity; one who touches it becomes a primary source of impurity who can then impurify people and vessels. The verse states: "Whatever that impure person touches shall be impure" [Numbers 19:22]; this verse is discussing one who is impure by a corpse, and implies that he can impurify people, since it states "and the person who touches..." [Numbers 19:22]
Here what the subcategories of Shabbat [labors] are equivalent to the primary categories; the subcategories of impurity are not equivalent to the primary categories. Here, what [is the relationship to] the subcategories of damages? Do we say that the subcategories are equivalent, and there is no difference between a primary category and a subcategory, in that in each case the one who causes damage must pay, or perhaps not?

Tosafot
For concerning the primary category [of ritual impurity], it impurifies a person and vessels. For that expression implies that the person becomes tomay and causes his clothing to become tomay as he is wearing them. This is not true in the case of a dead rodent, semen and one who has been in contact with a corpse. They cause a person to become tomay, he becomes a Rishon, a first level of tumoh, but the clothes he is wearing do not become tomay. Since the wearer is only a Rishon and not an av, his clothing which are treated as vessels do not become tomay. As the Gemara says vessels (and clothing) can only become tomay from an av. The Gemara has stated that an av of tumoh does not make its toldoh as itself. The toldoh has a reduced level of tumoh. It can only cause tumoh to foodstuff, but not to people and vessels. Although this is generally true for an av coming in contact with a person and with most utensils, there is an area where this is not true and the utensil will have a degree of tumoh as great as the av. And if you ask: There is a tomay mais, a person who came in contact with a corpse, who causes a metal vessel to have the same degree of tumoh as the tomay mais himself, for we have a rule that the sword is the same level of tumoh as the corpse. We see that there is a toldoh of tumoh which has the same level of tumoh as the av. Tosafot points out that although the statement is generally true, there still is a difference between a tomay mais and the metal vessel with which it comes in contact. And we can answer: the metal vessel is still not entirely like the tomay mais, because that metal vessel will not cause a second metal vessel to become tomay, as the tomay mais does, as Rabbeinu Tam deduces at the beginning of Masechet Oholos.
The Sages taught three primary categories. The Gemara asked a question: do the derivatives of damagers have the same laws as the avos? Now, the Gemara introduces a lengthy Braita that explains all the avos of shor and how they are derived. It seems as if the Gemara forgot to answer the question. Tosafot explains: The Gemara interrupted its flow by citing this Braita, so that eventually he can explain, using this Braita as a basis, which are their toldos that are not like the avos, of which Rav Papa spoke.
But with [a horn] attached, say [that in] all [cases the legal status] is [that of] a forewarned [ox]. If we only had a verse that spoke of an unattached horn, we would say that the difference of tam and muad applies only to an unattached horn, but when goring with an attached keren, I would say it is totally, even the first time, muad. Tosafot tells us the practical difference that would result from what I might have thought: That one must pay full payment even the first time. This requires some explanation. At this point in the Gemara full payment for an attached keren is not mentioned in the Torah. That I might have thought that there is reason to pay in full, is not an adequate reason to require full payment. There must be some means of deriving a new rule, to require a payment that is not mentioned in the Torah. As we have already seen in Tosafot (2a ד"ה ולא) the Gemara later (5b) discusses the possibility of learning one av from the other. It is that Gemara that Tosafot uses to search for a source for the new ruling that an attached keren must make full payment. The Gemara there concludes that all of the avos could be known, had the Torah only written bor and one other av. The Gemara there goes on to explain why the Torah did in fact write all of the Avos. There is one exception, keren, which may not be able to be derived from bor and one of the others. The Gemara says that the derivation of keren depends on a dispute among the amoraim. One holds that we could not learn keren from the other avos because all the others are initially muadim, it is usual for them to damage, whereas keren is not. It is therefore less likely to be liable, and we therefore cannot derive keren from the others. There is a second opinion there, that keren is more likely to be liable than the other avos, because of all the avos, it is the only one that harms intentionally. This amoro views the characteristics of keren as more likely to be liable than the others, so the others can be used as a source for keren. Tosafot will now show us how our Gemara which says that I would think that an attached keren should initially be a muad should be viewed in light of the Gemara on (5b). And if you ask: From where would we derive that an attached keren makes full payment? Tosafot suggests two possible sources for the attached keren, first: if from the unattached keren by a kal v’chomer and say that if the unattached keren is liable then the attached keren should certainly be liable? Then it should be sufficient to give it the rule of an unattached keren and it should only pay half. The second possible source for an attached keren: If you want to learn attached keren from the other avos, as the Gemara says on (5b) that all the avos could be derived from bor and one of the others, that makes sense according to the one who says that keren is stronger than the other avos and is more likely to be liable, because keren has intent to destroy, and even keren can be derived from the other avos, as Rabbeinu Tam has explained that the opinion referred to on (5b) as saying keren is stronger, is actually the one who is mentioned later on (15a) as the one who holds that half payment of keren is a financial obligation, for he holds that ordinary oxen are not assumed to be guarded. That means that we cannot assume that they will not gore others and that there is no need to take measures to prevent them from goring. Rather, we must anticipate the possibility that they might gore, and one is responsible to prevent them from doing so. When he does not take those measures, he is liable for not fulfilling his responsibility. According to this opinion the likelihood of attached keren damaging is no less that the other avos and we could derive the attached keren from the other avos. As opposed to a financial obligation because of his negligence of not guarding his oxen to prevent them from goring. The one, who holds that half payment is a fine, believes that essentially one need not take precautions to prevent oxen from goring. The torah’s insistent on half payment is a fine, not a financial obligation. The differences between the nature of the obligation, financial or fine will be discussed later in the Gemara. However, according to the one who says that half payment is a fine, because he holds that ordinary oxen are assumed to be guarded, and it is not necessary to take precautions to prevent oxen from goring, an attached keren cannot be derived from the other avos, as the Gemara says later on (5b), if you put bor together with any one of the other avos, the other avos could be derived from the combination, with the exception of keren, because one can refute the attempt to learn it from the other avos by arguing that it is not a fair comparison, since all the other avos are initially muadim, which means that it is the norm for them to cause damage as opposed to keren, which is assumed to be guarded, and not likely to cause damage. We are now faced with the problem of understanding how according to the one who holds that half payment is a fine, our Gemara says that I would say that an attached keren is fully liable? There seems to be no source for such a conclusion. Tosafot question is based on the understanding that when the Gemara says “I would say” that attached keren pays in full, is that the conclusion would be correct. Thus, Tosafot has attempted to show why that conclusion would in fact be correct. In Tosafot solution, he will say that this understanding of “I would say” is not necessarily so. “I might say” can mean that I might erroneously say. And one can answer: That according to the one who says half payment is a fine, and that ordinary oxen can be assumed to be guarded, that which the Gemara says: but as a far as an attached keren, I might say that it is initially a muad and pay in full even the first time it damages, do not mean to say that a special verse is actually needed to teach me that attached keren is not a muad, and that if not for the verse I would correctly conclude that an attached keren is required to make full payment. If one were to follow the regular systems of deriving one av from another, one could not logically reach the conclusion that an attached keren must make full payment, as we have already explained in Tosafot question. Rather, what is meant is the tanna needed to teach us by citing proof from a verse, that an attached keren as well is included in the term “goring”, so that you might not erroneously conclude that the term “goring” is limited to only an unattached keren, such as the iron horns of Tzidkiyah, but with an attached keren, it is initially the norm for an ox to damage, ror.and we could learn from bor and one of the other avos that attached keren is initially liable for full payment. To avoid making such an error the Braita cited the verse of “the horns of a r’aim are his horns”, with them he shall gore etc. This shows that goring with an ordinary attached keren is included in the term goring. There is no room for a possible error.
And the Torah teaches us, in passing, a concept By using different verbs to describe the goring of a person as opposed to the goring of another animal, the Torah is teaching us that there is an inherent difference between killing a person and killing an animal. A greater effort and viciousness is required to kill a person. Therefore if an animal is muad to kill people, it is automatically muad to kill animals, but if the animal is muad to kill other animals it is not muad to kill people. Tosafot points out that there seems to be a Gemara later that contradicts our conclusion. On (37a) Rav Papa clearly says that an animal that is muad to kill people is not muad to kill animals. Tosafot will attempt to reconcile this apparent contradiction. And even according to Rav Papa who says later in Shor Shenogach Daled V’hay (37a) that a muad to kill people ordinarily is not muad to kill animals, which seems to contradict our Gemara and the lesson taught by the Braita, that is only when he killed only three people, by doing that he does not become muad to kill animals, but if he gored a person, an ox and a donkey which are three species he becomes muad for all including people. However, if he gores an ox, a donkey and a camel, he does not become muad for people, even though he is muad for all animals, even according to Rav Papa as the Gemara says there (37a). That according to Rav Papa an ox who killed three different animals is a muad for all animals. The lesson of the Braita is still in effect, animals are more readily killed than humans. Tosafot offers a second solution to this contradiction: And R’ M’nachem explained that the Gemara means to say as follows: An animal that is muad for people, who was a muad for everything including animals, and he retracted from animals, he saw an animal three times and did not attack it, but he remained a muad for people, there was no evidence that he retracted from killing people, remains a muad for animals, for the retraction from killing animals is inconclusive, as long as he remains a muad for people. However, a muad for everything, people and animals, who retracted from killing people, is no longer muad to kill people, for his retraction from killing people is a retraction. According to this answer as well, we see that an animal is more likely to kill animals than humans, therefore his retraction from killing animals is inconclusive as long as he remains muad for people, but his retraction from killing people is a retraction even though he remains a muad for killing animals.
As one who consumes with the tooth Why is tooth referred to as golol? Rabbeinu Chananel explains that the word golol is related to tooth as we see in Ezra 6, “rows of marble stone.” We see that golol is used to describe marble. For a tooth is similar to marble stone. We therefore translate “as the golol consumes”- as the tooth consumes. The word y’vaer is used to describe the activity of the tooth, so too, the verse in the Torah u’vee’air refers to the activity of the tooth.

נשיכה תולדה דשן היא כלומר לא אתחייב אלא ברשות הניזוק אבל ברשות הרבים או ברשות אחר פטור וכן נמי נחמיר עליו להתחייב אפילו פעם אחת בנזק שלם כשן.

אין נגיחה אלא בקרן שנאמר וכו' הקשה הר"מ אמאי לא פריך הכא כדפריך לקמן גבי שן ורגל הכי אמאי איצטריך קרא הא בלאו הכי נמי בקרן איירי דאי לאו במאי מוקמינן ליה אי רגל כתיבא אי שן כתיבא. תוספי הרא"ש. ובגליון הקשה על קושיא זו וז"ל תימה נימא דכי יגח איירי בקרן וברגל דברשות הניזק נזק שלם וברשות הרבים חצי נזק. וי"ל נמצא שהיינו מחלקים בחצי נזק של תם דברשות הרבים חצי נזק וברשות הניזק נזק שלם וזה אי אפשר לומר דאין חצי נזק חלוק כדאמרינן בפרק כיצד הרגל. ותירץ ה"ר מאיר ז"ל דקרא דויעש לו צדקיהו איצטריך לאשמועינן דשייך נגיחה בתלוש וכיון דאייתי קרא דשייכא נגיחה בקרן תלושה איצטריך נמי בכור שורו דלא תימא מחוברת כולה מועדת היא. ונראה לי דלא קשה דגבי שן ורגל אינו מפרש מהו שלוח וביעור. אלא מייתי קרא דאשכחן דכתיב שלוח גבי רגל וביעור גבי שן אבל הכא דמפרש דנגיחה היינו נזק שעושים בקרנים לא שייך למיפרך. תוספי הרא"ש ז"ל.
ותלמיד רבינו פרץ תירץ כתירוץ הר"מ ועוד תירצו דנגיחה סלקא דעתך אמינא דחיפת הגוף קאמר מדפתח הכתוב בנגיפה וסיים בנגיחה. מיהו קשה מכל מקום ידעינן שפיר דמיירי או בקרן או בתולדה דקרן. ע"כ.
ובגליון תוספות תירצו דהכא ליכא למיפרך הא לאו הכי וכו' דודאי בקרן איירי אבל לא ידענא אי בתלושה אי במחוברת. ע"כ.

בתוספות בד"ה אבל במחוברת וכו' וא"ת דמהי תיתי וכו' אבל למ"ד פלגא נזקא קנסא וכו'. פי' תורף הקושיא לפי סוגית הש"ס דאמרינן לקמן דאי לא כתב רחמנא קרן לא הוי ידעינן לה משאר נזקין דאיכא למיפרך מה להנך שכן מועדין מתחילתן פי' אבל קרן לאו אורחא משמע להדיא דאם לא נאמר שום קרא בקרן ה"א דפטור כיון דלאו אורחא ובמחוברת איירי והיאך קאמר כאן להיפך דאילו לא גילה לנו הכתוב הוי אמרינן דמחוברת אורחא הוא והאריכו תוספות בלשונם לפי שיש לנו לומר באמת שיש לדחות סברא חיצונה לכאן ולכאן זיל הכא קא מדחי ליה דאילו לא נאמר קרא ה"א דחייב נ"ש דאורחא היא והתם קא מדחי דאם לא נאמר קרא ה"א דפטור מכלום דה"א לאו אורחא לכך פי' התוספות שהביא ר"ת לקמן בדף ה' ראיה לדבריו על הא דאמרינן דקרן לאו אורחא דהיינו כמ"ד פלגא נזקא קנסא וקשה מאי ראיה היא דלמא האי דס"ל פלגא נזקא קנסא דלאו אורחא היינו לאחר שגילה לנו הכתוב שיש חילוק בין תם למועד כדפרישית ברש"י בסמוך אבל התם דף ה' ע"ב אילו לא נאמר קאמר וא"כ מאי ראיה מייתי א"ו דס"ל לר"ת דאי לאו דס"ל למ"ד פלגא נזקא קנסא שזו היא סברא מוכרחת דקרן לאו אורחא ואין לזוז ממנה לא הוי אמר דפ"נ קנסא ואי משום דגילה הכתוב לחלק בין תם למועד אפשר לפרש כדמפרש מ"ד פלגא נזקא ממונא דחס רחמנא עליה ומנ"ל לשנות נזק זה משאר נזקין ולומר שהוא קנס א"ו דס"ל שזו היא סברא מוכרחת דקרן לאו אורחא ור"ל דסברא חיצונה היא כך וא"כ מקשו שפיר. ותירצו התוספות דבאמת לא אמרינן הכא שהכתוב הוצרך לגלות כן דהאי לאו מילף הוא והפסוקים אינן מיותרין אלא הש"ס מפרש שהוצרכה הברייתא להביא ראיה מהפסוק כדי שלא נטעה בסברא של טעות ונאמר דסברא נותנת דאורחא היא וחייב נ"ש מבור וחד מהנך לכך הביא הברייתא שלא יטעה הטועה בשום ענין ודוק היטב כי נכון הוא. ועיין בחדושי מהרש"א שפירש בענין אחר:
בגמרא מ"ש גבי אדם דכתיב כי יגח וכו' אגופיה דקרא לא קשיא ליה כיון דהוי ס"ד דנגיחה ונגיפה שני מיני נזקין הן וה"א דגזירת הכתוב הוא דלא מחייבי אלא בהכי דהיינו במין הקל לא מחייב אלא בנגיחה החמורה ובאידך מחייב בתרווייהו אבל עכשיו שאומר שמין א' הם למה שני בלישנא:

דִּבְרֵי תּוֹרָה מִדִּבְרֵי קַבָּלָה לָא יַלְפִינָן הא דקרי לפסוקי נביאים 'דִּבְרֵי קַבָּלָה' נראה לי בס"ד דאמרו רבותינו ז"ל (פסיקתא במדבר קלז, ב) כל הנביאים נתנבאו בכה דכתיב כֹּה אָמַר הֳ' (ירמיה ב, ב) ומשה רבינו ע"ה נתנבא בזה דכתיב זֶה הַדָּבָר אֲשֶׁר צִוָּה הֳ' (ויקרא ט, ו) וכתב הרב מהרי"ם (רבי יעקב קראנץ - המגיד מדובנא) ז"ל באהל יעקב הכונה כי משה רבינו ע"ה שכינה מדברת מתוך גרונו ולכן אמר זֶה הַדָּבָר אֲשֶׁר צִוָּה הֳ', 'זה' דייקא כאלו שומעים הדבר מפי אור השכינה ממש אבל הנביאים הם שמעו מפי השכינה ואחר כך מוציאין דברים חדשים מפיהם כאותם הדברים ששמעו ומשמיעין אותם לישראל. נמצא הם קבלו הדברים האלה מפי השכינה לעצמן וחוזרים ומגידים אותם לישראל לכך אומרים כֹּה אָמַר הֳ' כלומר כאלה הדברים אמר ה' לנו משל לאדם שלוה מחבירו מאה דנרים והוציאן בהוצאה לצרכו ואחר כך פורע מאה דנרים כמותם ממש משלו ולזה ידמה דברי הנביאים אך דברי משה רבינו ע"ה דומין לאדם שלקח מאה דנרים מאחד והוא מחזיר לו אותם הדנרים ממש עד כאן דבריו. ולכן דברי הנביאים נקראים 'דִּבְרֵי קַבָּלָה' כלומר דברים אלו אשר קבלו הנביאים לעצמן וחוזרים ומגידים כמותם לישראל שנמצא ישראל לקחו מהנביאים דברים אשר קבלו מהשכינה לעצמן אבל פסוקי תורה קבלו אותם ישראל מפי השכינה ממש דהשכינה היתה מדברת מתוך גרונו וממנה לקחו דברים אלו. ובאופן אחר נראה לי בס"ד מה שנקראים דברי הנביאים 'דִּבְרֵי קַבָּלָה' על פי מה שכתב רבינו מורנו הרב רבי חיים ויטאל ז"ל (בשער קדושה חלק ג' שער וא"ו) וזה לשונו וזהו סוד מה שאמרו רבותינו ז"ל ששים רבוא נביאים עמדו בישראל ומשה רבינו ע"ה כולל כולם ושקול ככולם, ואמנם דרך כללות נבאר מדרגתם כי משה רבינו ע"ה היה עולה עד האצילות ומשם רואה ממש אלא הוא על ידי התלבשו בבריאה לבדה וגם זה אינו אלא דרך מעבר לבד כי האצילות לבדו הוא נמנע וזהו סוד כִּי לֹא יִרְאַנִי הָאָדָם וָחָי (שמות לג, כ) ושאר נביאים היו רואין באצילות על ידי התלבשות גמור באורות הבריאה ואחר החרבן היה יחזקאל והתנבא מן האצילות אחר התלבשו בבריאה והבריאה ביצירה התלבשות גמור ומאז ואילך אין עוד אור אצילות ובריאה נראין כלל עד כאן לשונו עיין שם. נמצא משה רבינו ע"ה רואה אור האצילות בנבואה על ידי אורות הבריאה אך אינו בסוד התלבשות אלא דרך מעבר בלבד וכיון דאינו בהתלבשות ממש אלא דרך מעבר בלבד לכך אין דברי נבואתו נקראים דִּבְרֵי קַבָּלָה כי לא קיבלם על ידי אמצעי שהוא הבריאה אבל שאר הנביאים דרואין דבר הנבואה שהם מן האצילות על ידי התלבשות גמור בבריאה נקראים דברים אלו 'דִּבְרֵי קַבָּלָה' כי קבלום על ידי אמצעי שהוא הבריאה ולא באו מן האצילות בלתי אמצעי אלא כאדם המקבל המים בכלי ושותה מן פיו של כלי. ועוד נראה לי בס"ד קרוב לזה דאמרו רבותינו ז"ל משה רבינו ע"ה נתנבא מאספקלריא המאירה שהוא סוד שם הוי־ה ושאר נביאים מאספקלריא שאינה מאירה שהוא סוד שם אדנ־י. (ועיין מה שכתב רבינו ז"ל בזה בשער מאמרי רשב"י פרשת תרומה ועוד מה שכתב בריש שער רוח הקודש עיין שם.) וידוע כי אספקלריא המאירה נותן ושאינה מאירה מקבל כי בבחינת שם הוי־ה נותן ו בחינת שם אדנ־י מקבל ולכן הנביאים שנתנבאו מאספקלריא שאינה מאירה נקראים דבריהם 'דִּבְרֵי קַבָּלָה'.
תָּא שְׁמַע "בְּכוֹר שׁוֹרוֹ הָדָר לוֹ" (דברים לג, יז). קשא למה הביא מעיקרא פסוק של נביאים ולא הביא האי קרא שהוא פסוק תורה? ונראה לי בס"ד כי מפסוק דנביאים איכא הוכחה טפי כי על פסוק זה יש לומר לעולם שייך לשון נגיחה בידים ורגלים ומה שנאמר (דברים לג, יז) וְקַרְנֵי רְאֵם קַרְנָיו בָּהֶם עַמִּים יְנַגַּח, משום שכבר דמהו לשור ודרכו של שור לנגח בקרניו ולכן נקיט קרן גבי נגיחה זו דשור אבל בפסוק (מלכים א' כב, יא) וַיַּעַשׂ לוֹ צִדְקִיָּה, איכא הוכחה טפי כיון דטרח לעשות קרנים מברזל כדי לעשות בהם פועל דמיוני לומר 'בְּאֵלֶּה תְּנַגַּח אֶת אֲרָם' ולמה טרח כולי האי הא איכא כלים עשויים מברזל שיש להם יד וכן איכא כסאות של ברזל שיש להם רגל ברזל יקחם בידו ויאמר 'בְּאֵלֶּה תְּנַגַּח אֶת אֲרָם' כיון דשייך נגיחה בידים או ברגלים גם כן אלא ודאי לא שייך נגיחה אלא בקרן וליכא קרן ברזל מוכן ומזומן לכך טרח ועשה.

וּטְמֵא מֵת. תּוֹלְדוֹתֵיהֶן לָאו כַּיּוֹצֵא בָּהֶן; דְּאִילּוּ אָב – מְטַמֵּא אָדָם וְכֵלִים, וְאִילּוּ תּוֹלָדוֹת – אוֹכָלִין וּמַשְׁקִין מְטַמֵּא, אָדָם וְכֵלִים לֹא מְטַמֵּא.
and one who is impure with impurity imparted by a human corpse. A person, a vessel, or food that is rendered impure through contact with an item classified as a primary category of ritual impurity is characterized as a subcategory. In that domain, their subcategories are dissimilar to them, as any person or item classified as a primary category of ritual impurity impurifies a person and impurifies any vessels with which it comes into contact, while a person or item classified as a subcategory of ritual impurity impurifies food or drink, but does not impurify a person or vessels.
הָכָא מַאי? אָמַר רַב פָּפָּא: יֵשׁ מֵהֶן כַּיּוֹצֵא בָּהֶן, וְיֵשׁ מֵהֶן לָאו כַּיּוֹצֵא בָּהֶן.
After determining that there are instances where the legal status of subcategories is like that of primary categories, e.g., Shabbat, and there are instances where the legal status of subcategories is dissimilar to that of primary categories, e.g., ritual impurity, the Gemara asks: Here, with regard to the laws of damages, what is the relationship between the primary categories and their subcategories? Rav Pappa said: There are, among the primary categories of damage, some whose subcategories are similar to them, and there are, among them, some whose subcategories are dissimilar to them.
תָּנוּ רַבָּנַן: שְׁלֹשָׁה אָבוֹת נֶאֶמְרוּ בְּשׁוֹר – הַקֶּרֶן, וְהַשֵּׁן, וְהָרֶגֶל.
§ Seeking to clarify Rav Pappa’s statement, the Gemara cites a baraita that delineates the primary categories of damage. The Sages taught in a baraita : Three primary categories of damage were stated in the Torah with regard to an ox. An ox causes damage in three ways, and each is classified as a distinct primary category of damage represented by a part of the body of the ox: There is the category of Goring [ keren ], literally, horn. This is referring to an ox goring a person or an animal and causing damage. And there is the category of Eating [ shen ], literally, tooth. This is referring to one’s ox causing damage by consuming another person’s produce. And there is the category of Trampling [ regel ], literally, foot. This is referring to an ox trampling another person’s belongings and causing damage. These are classified as primary categories because they are mentioned explicitly in the Torah.
קֶרֶן מְנָלַן? דְּתָנוּ רַבָּנַן: ״כִּי יִגַּח״ – אֵין נְגִיחָה אֶלָּא קֶרֶן, שֶׁנֶּאֱמַר: ״וַיַּעַשׂ לוֹ צִדְקִיָּה בֶן כְּנַעֲנָה קַרְנֵי בַרְזֶל, וַיֹּאמֶר: כֹּה אָמַר ה׳, בְּאֵלֶּה תְּנַגַּח אֶת אֲרָם וְגוֹ׳״. וְאוֹמֵר: ״בְּכוֹר שׁוֹרוֹ הָדָר לוֹ, וְקַרְנֵי רְאֵם קַרְנָיו, בָּהֶם עַמִּים יְנַגַּח״.
The Gemara elaborates: From where do we derive the primary category of Goring? The source is as the Sages taught in a baraita : The verse states: “And if an ox gores a man or a woman” (Exodus 21:28); and goring is performed only with a horn, as it is stated: “And Zedekiah, son of Chenaanah, made himself horns of iron, and said: So says the Lord: With these shall you gore the Arameans, until they are consumed” (I Kings 22:11). And the verse also states: “His firstborn bull, majesty is his, and his horns are the horns of the wild ox; with them he shall gore the nations” (Deuteronomy 33:17).
מַאי ״וְאוֹמֵר״? וְכִי תֵּימָא דִּבְרֵי תוֹרָה מִדִּבְרֵי קַבָּלָה לָא יָלְפִינַן, תָּא שְׁמַע: ״בְּכוֹר שׁוֹרוֹ הָדָר לוֹ״.
The Gemara interrupts its citation of the baraita and asks: What is the purpose of citing the additional verse introduced with the term: And the verse also states? The Gemara answers: And if you would say that the first verse cited is not a legitimate source as it is a verse from the Prophets, and we do not derive Torah matters from the texts of the tradition, i.e., Prophets and Writings, come and hear proof from the Torah: “His firstborn bull, majesty is his.”
וְהַאי מֵילָף הוּא?! גִּילּוּי מִילְּתָא בְּעָלְמָא הוּא, דִּנְגִיחָה בְּקֶרֶן הוּא!
The Gemara rejects the possibility that the reason a second verse was cited is that the primary category of Goring cannot be derived from a verse in the Prophets: But is this a halakhic derivation? It is a mere disclosure of the matter, that goring is performed with a horn. A verse in the Prophets can certainly serve as a source for that disclosure.
אֶלָּא מַהוּ דְּתֵימָא, כִּי פַּלֵּיג רַחֲמָנָא בֵּין תָּם לְמוּעָד – הָנֵי מִילֵּי בִּתְלוּשָׁה, אֲבָל בִּמְחוּבֶּרֶת – אֵימָא כּוּלָּהּ מוּעֶדֶת הִיא;
Rather, the reason the baraita cites a second verse is lest you say, based on the first verse, that when the Merciful One distinguishes between liability for damage caused by an innocuous ox, for which the owner is liable to pay half of the damages for the first three times that it gores, and liability for damage caused by a forewarned ox, which already gored three times and whose owner was cautioned to prevent the ox from goring, for which he is liable to pay the full damages, that statement applies only to damage caused with a detached horn, like the horn of Zedekiah described in the verse, e.g., if an animal held a detached horn in its mouth and caused damage with it; but for damage that an ox caused with a horn attached to its head, say that in all cases the legal status of the ox is that of a forewarned ox and its owner is liable to pay for all of the damage.
תָּא שְׁמַע: ״בְּכוֹר שׁוֹרוֹ הָדָר לוֹ וְגוֹ׳״.
Therefore, the baraita says: Come and hear a proof from another verse: “His firstborn bull, majesty is his, and his horns are the horns of the wild ox; with them he shall gore the nations,” where the reference is to a horn attached to the ox’s head. Evidently, when an ox gores with its own horns there is a distinction between an innocuous ox and a forewarned ox.
תּוֹלָדָה דְקֶרֶן מַאי הִיא? נְגִיפָה, נְשִׁיכָה, רְבִיצָה, וּבְעִיטָה.
The Gemara resumes its citation of the baraita : What is a subcategory of Goring? It includes any action that an ox performs with its body with the objective of inflicting damage: Pushing [ negifa ], biting, crouching upon items with the objective of inflicting damage, and kicking.
מַאי שְׁנָא נְגִיחָה דְּקָרֵי לַהּ אָב – דִּכְתִיב ״כִּי יִגַּח״, נְגִיפָה נָמֵי כְּתִיב ״כִּי יִגֹּף״! הַאי נְגִיפָה – נְגִיחָה הִיא. דְּתַנְיָא: פָּתַח בִּ״נְגִיפָה״ וְסִיֵּים בִּ״נְגִיחָה״, לוֹמַר לָךְ: זוֹ הִיא נְגִיפָה זוֹ הִיא נְגִיחָה.
The Gemara asks: What is different about goring that it is characterized as a primary category of damage, as it is written explicitly in the verse: “And if an ox gores a man or a woman” (Exodus 21:28); accordingly, negifa should also be characterized as a primary category, as it is written: “If one man’s ox hurts [ yiggof ] the ox of another” (Exodus 21:35)? The Gemara answers: This negifa mentioned in the verse, is actually a reference to goring, as it is taught in a baraita that the verses states: “And if one man’s ox hurts [ yiggof ] the ox of another…or if it is known that the ox was a goring ox in time past” (Exodus 21:35–36). The verse began its description of the case with the term negifa and it concluded with the term goring to say to you that in this context the two terms describe the same action: This action is negifa and this same action is goring.
מַאי שְׁנָא גַּבֵּי אָדָם דִּכְתִיב ״כִּי יִגַּח״, וּמַאי שְׁנָא גַּבֵּי בְּהֵמָה דִּכְתִיב ״כִּי יִגֹּף״?
The Gemara asks: If the two terms are interchangeable, what is different with regard to an ox goring a person that it is written: “And if an ox gores a man or a woman” (Exodus 21:28), and what is different with regard to an ox goring an animal that it is written: “If one man’s ox hurts [ yiggof ] the ox of another” (Exodus 21:35)?
אָדָם – דְּאִית לֵיהּ מַזָּלָא, כְּתִיב ״כִּי יִגַּח״; בְּהֵמָה – דְּלֵית לַהּ מַזָּלָא, כְּתִיב ״כִּי יִגֹּף״.
The Gemara explains: With regard to a person, who has the ingenuity to defend himself and is not easily injured, it is written: “If an ox gores,” a term indicating an attack of greater force. With regard to an animal, which does not have the ingenuity to defend itself and is more easily injured, it is written: “If an ox hurts [ yiggof ],” a term indicating an attack of lesser force. The term yiggof is related to the term magefa , meaning plague. The Torah employs that term with regard to the goring of an animal to indicate that when an animal is gored, regardless of the force of the blow, it will likely result in its death.
וּמִלְּתָא אַגַּב אוֹרְחֵיהּ קָא מַשְׁמַע לַן – דְּמוּעָד לְאָדָם הָוֵי מוּעָד לִבְהֵמָה וּמוּעָד לִבְהֵמָה לָא הָוֵי מוּעָד לְאָדָם.
And the Torah’s use of these terms teaches us a matter in passing: Because the effort required for the ox to gore a person to death is greater than the effort required for the ox to gore an animal to death, the halakha is that an ox that is forewarned with regard to goring a person is also forewarned with regard to an animal. But an ox that is forewarned with regard to an animal is not forewarned with regard to a person.
נְשִׁיכָה – תּוֹלָדָה דְשֵׁן הִיא! לָא; שֵׁן – יֵשׁ הֲנָאָה לְהֶזֵּיקָהּ, הָא – אֵין הֲנָאָה לְהֶזֵּיקָהּ.
The Gemara questions the classification in the baraita of biting, crouching, and kicking as subcategories of Goring: Isn’t biting a subcategory of Eating, as the animal both eats and bites with its teeth? The Gemara answers: No, in cases included in the primary category of Eating, there is pleasure for the animal in the course of its causing damage. In this case of damage caused by biting, there is no intrinsic pleasure for the animal in the course of the damage that it causes, as when the ox bites forcefully, the exclusive objective of the action is to cause damage.
רְבִיצָה וּבְעִיטָה – תּוֹלָדָה דְרֶגֶל הִיא! לָא; רֶגֶל – הֶזֵּיקָהּ מָצוּי, הָנֵי – אֵין הֶזֵּיקָן מָצוּי.
The Gemara asks: Aren’t crouching upon items and kicking items in order to damage them each a subcategory of Trampling, as the animal crouches by bending its legs and kicks with its feet? The Gemara answers: No, in cases included in the primary category of Trampling, the damage is commonplace, as it is caused in the course of the animal’s walking; in these cases of crouching and kicking, the damage is not commonplace, as animals do not typically kick or crouch upon utensils.
אֶלָּא ״תּוֹלְדוֹתֵיהֶן לָאו כַּיּוֹצֵא בָּהֶן״ דְּאָמַר רַב פָּפָּא, אַהֵיָיא?
After citing the subcategories listed in the baraita , the Gemara resumes its analysis of the statement of Rav Pappa: But with regard to the statement that Rav Pappa said: There are among them some whose subcategories are dissimilar to them, to which primary category was Rav Pappa referring?
אִילֵּימָא אַהָנֵי; מַאי שְׁנָא קֶרֶן – דְּכַוּוֹנָתוֹ לְהַזִּיק, וּמָמוֹנְךָ וּשְׁמִירָתוֹ עָלֶיךָ; הָנֵי נָמֵי – כַּוּוֹנָתָן לְהַזִּיק, וּמָמוֹנְךָ וּשְׁמִירָתָן עָלֶיךָ!
If we say that his reference was to these subcategories of Goring, what is different about Goring that defines it as a unique primary category? What is different is that the objective of the ox’s action is to cause damage, and the ox is your property, and responsibility for its safeguarding, to prevent it from causing damage, is incumbent upon you, its owner. In these subcategories of Goring, i.e., pushing [ negifa ], biting, crouching, and kicking, as well, the objective of the oxen’s actions is to cause damage, and the oxen are your property, and responsibility for their safeguarding, to prevent your oxen from causing damage, is incumbent upon you.
אֶלָּא תּוֹלָדָה דְקֶרֶן כְּקֶרֶן, וְכִי קָאָמַר רַב פָּפָּא – אַשֵּׁן וָרֶגֶל.
Rather, it is apparent that the status of a subcategory of Goring is like that of the primary category of Goring, and when Rav Pappa says: There are among them some whose subcategories are dissimilar to them, he was referring to Eating and Trampling.
שֵׁן וָרֶגֶל הֵיכָא כְּתִיבִי? דְּתַנְיָא: ״וְשִׁלַּח״ – זֶה הָרֶגֶל, וְכֵן הוּא אוֹמֵר: ״מְשַׁלְּחֵי רֶגֶל הַשּׁוֹר וְהַחֲמוֹר״.
The Gemara asks: Where are Eating and Trampling written in the Torah that led them to be classified as primary categories? The Gemara answers: The source is as the Sages taught in a baraita : The verse states: “If a man causes a field or vineyard to be eaten, and he sends forth his animal, and it consumed in the field of another” (Exodus 22:4). The two parts of the verse are referring to different categories: “And he sends forth,” this is a reference to the primary category of Trampling, as sending forth results in the animal trampling another’s produce and damaging it, and likewise it states: “Happy are you that sow beside all waters that send forth the feet of the ox and the donkey” (Isaiah 32:20). Clearly the term “send forth” is a reference to trampling by the feet of the animal.
