בשלוה על מנת למשכנו כולי‎—When he borrowed with the intent to collateralize it, etc. Overview The גמרא differentiated between עבד (where it is considered as if he was sold) and שדה (where it is not considered as if it was sold), in a case where he borrowed the money with the intent to use them (the עבד or the שדה) as security, but he did not collect the security as collateral. There is a dispute between רש"י and תוספות how to understand this answer. -------------------------------- פירש בקונטרס שאם לא אפרע עד זמן פלוני בא ומשכנני מקרקע זו ותהא שלך‎ – רש"י explained (the case of שדה) that the נכרי said to the ישראל, ‘that if I do not repay the loan by this date, come and take this field as collateral and it will be yours’ (this is the meaning of בשלוה ע"מ למשכנו) – וכל זמן שלא בא ישראל ומשכנו הוי בחזקת עובד כוכבים‎ – So as long as the ישראל did not come and take it as collateral (this is the meaning of ולא משכנו), the field is in the possession of the נכרי and it is פטור from מעשר‎ – וגבי עבד כי האי גוונא קנסוה רבנן לישראל הואיל ועבר הזמן ולא פרע – And regarding an עבד in the same case, the רבנן penalized the ישראל, since the time of payment passed and he did not pay – ואף על פי שלא משכנו עדיין‎ – So even though the נכרי did not take the עבד as collateral yet, nevertheless the עבד goes out free, תוספות asks on פירש"י: וקשה דהוה ליה למימר אידי ואידי דמטא זמניה – And there is a difficulty with this explanation, for the גמרא should have said; ‘that in both cases the time of payment has arrived’ – תוספות offers his explanation: לכך נראה דאתא לשנויי שנויא קמא הא דמטא זמניה והא דלא מטא זמניה‎ – Therefore it appears to תוספות that the גמרא is coming to reinforce the first answer, that by the עבד it is מטא זמניה (and therefore it is considered a מכירה), and this case by a שדה is where לא מטא זמניה (therefore it is not considered a מכירה) – והא דאקשינן גבי עבד דמטא זמניה צריכא למימר בשלוה על מנת למשכנו ולא משכנו‎ – And this which the גמרא asked on this answer; ‘ is it necessary for the ברייתא to teach us regarding an עבד that if מטא זמניה it is considered a מכירה;’ it is obvious! The גמרא is answering this question; indeed it is מטא זמניה, but we are discussing a case where the ישראל borrowed from the נכרי with the intent to be ממשכן his עבד, but the נכרי did not yet take the עבד as a משכון‎ – דסלקא דעתין כיון דלא משכנו עדיין לא יצא לחירות‎ – So it may have entered our minds that since he was not ממשכן him yet, the עבד should not go free, because he is not yet ברשות הנכרי – קא משמע לן דהואיל ובידו למשכנו דיוצא לחירות: The ברייתא informs us that since the נכרי has the right to be ממשכן the עבד, therefore the עבד goes out free. S UMMARY According to רש"י this איבעית אימא is a new answer (and אידי ואידי דמטי זמניה), however according to תוספות this איב"א is explaining the first answer (הא דלא מטי זמניה וכו') that even though it was לא משכנו, the עבד is freed since it is מטי זמניה‎. T HINKING IT OVER What would be the ruling by a field if it is מטי זמניה and לא משכנו, according to this איבעית אימא; would it be חייב במעשר or not?
המוכר עבדו לפרהנג עובד כוכבים‎—One who sells his slave to a gentile PFarhang O VERVIEW רב ruled that if one sells his slave to a פרהנג נכרי, the slave goes out free. There is a dispute between רש"י and תוספות, as to what this means. -------------------------------- פירש בקונטרס מציק ושם עלילות ומכרו לו באותן דמים שהעליל – רש"י explained that פרהנג is a מציק (an extortionist) and he created a libel against the ישראל that the ישראל owes him a sum of money, and the ישראל sold the עבד to the מציק for those monies which the מציק libelously claimed – תוספות asks on פרש"י: וקשה דלא שייך על זה לשון מכירה ולישנא שהיה לו לפייס ולא פייס לא משמע הכי – And there is a difficulty with this explanation for the expression 'מכירה' (sale) is not appropriate in this case, and the expression, ‘he should have appeased him and he did not appease him’, does not seem to support פרש"י – Another question on פרש"י: ועוד דמדמי למוכרו לשלשים יום‎ – And additionally the גמרא compares the case of מכרו לפרהנג to the case where he sold his עבד for thirty days; according to רש"י what is the comparison?! תוספות offers his explanation: ונראה דהפרהנג נוטל עבדו על כורחו אלא שנותן לו דמים – And it appears to תוספות that the פרהנג takes his slave against his will, however the פרהנג pays him (the ישראל) money (the market value) – לכך פריך דאמאי יצא לחירות כיון דהוי בעל כורחו כמו גבאו בחובו‎ – Therefore the גמרא asks, why should the עבד be freed, since this happened against the sישראל' will; it is like when someone (a נכרי) collects the עבד for a loan that is owed to him, where the ברייתא just ruled that לא יצא לחירות‎ – ומשני דהיה לו לפייס דכיון דנותן דמים ודאי היה מתפייס בדבר מועט – And the גמרא answered that he should have appeased him, for since he is paying money (market price) for the עבד, he surely would have been appeased with something minor – ומדמי לו נמי למוכרו לשלשים יום דאחר שגומר מלאכתו דרכו להחזירו לישראל‎ – And this explains why the גמרא compares it to the case of selling the עבד for thirty days, since after the slave finishes his work for the פרהנג, he usually returns the עבד back to the ישראל‎ – וישראל מחזיר לו הדמים: And the ישראל returns to him his money; therefore it is similar to a temporary sale. S UMMARY According to רש"י, the פרהנג extorts the עבד from the ישראל through some scheme, however according to תוספות the פרהנג coerces the ישראל to sell him the עבד (temporarily) for the market value. T HINKING IT OVER תוספות asks on פרש"י that the לשון מכירהis not שייך here according to פרש"י. However one can argue that according to רש"י that he is willingly giving him the עבד instead the money he is demanding; that is a regular מכירה; however according to תוספות that the פרהנג takes the עבד בע"כ, how is that considered a מכירה (even if he is paying him)?
וכותב ומעלה בערכאות שלהם‎—And he writes and brings it up to their courts O VERVIEW The ברייתא states that if a נכרי forcibly took possession of a Jew’s house and the ישראל is not able to evict him, the ישראל is permitted to take payment from the נכרי for the house and write a bill of sale to the נכרי and he may bring it to the secular courts. There is a dispute between רש"י and תוספות as to what the novelty is in this ruling that he is כותב ומעלה בערכאות שלהם‎. ---------------------------------- פירש בקונטרס אף על פי דחשיבות הוא להן‎ – רש"י explained; even though that by doing this he is giving a recognition of importance to the ערכאות, nevertheless one is permitted to be מעלה בערכאות‎ – תוספות asks on פרש"י: וקשה דשטרות העולין בערכאות של עובדי כוכבים מכשרינן – And there is a difficulty with this explanation, for the משנה rules; ‘any documents which are brought before the secular courts are valid’ – ולא מפלגינן בין לכתחילה בין לדיעבד – And we do not distinguish whether it was done initially or only where it was already done; it is always כשר, so what is the novelty here that he may bring the שטר מכירה to the ערכאות‎?! תוספות offers his explanation as to what the novelty is here: ומפרש רבינו תם דאף על גב דנראה כמקיים המקח שרי הכא‎ – And the ר"ת explained that even though it appears that he is certifying the sale, nevertheless it is permitted here – תוספות responds to an anticipated difficulty: וההיא דפרק קמא דעבודה זרה (דף יג, א) הולכין ליריד של עובדי כוכבים‎ – And that ברייתא in the first פרק of מסכת ע"ז which states, ‘ we go to the fairs of נכרים‎ – ולוקחים מהן בהמה ועבדים מפני שהוא כמציל מידם ומעלה בערכאות של עובדי כוכבים – And we buy from them animals and slaves, because he is saving it from them, and he may bring the sales document to the ערכאות of the נכרים’ – תוספות replies: התם נמי מקיים המקח ומתפרסם הדבר שמהנה לעבודת כוכבים ואפילו הכי שרי: There too he is certifying the sale and it becomes public knowledge that he is aiding the נכרים, and nevertheless it is permitted because he is מציל מידם. S UMMARY According to רש"י the novelty of מעלה בערכאות is that it is permitted even though that חשיבות הוא להן, while according to תוספות there needs to be some impropriety in the deal, and nevertheless it is permitted מפני שהוא כמציל מידם‎. T HINKING IT OVER 1. We see here and in the ברייתא of ע"ז that one may be מעלה בערכאות, only if it is כמציל מידם; why therefore does the משנה state that (even לכתחילה) the שטרות העולין בערכאות של עכו"ם are כשרין; in what type of case is that? 2. Is the question from ע"ז, apply according to פרש"י as well?
או לאו דוקא‎—Or is it not precise O VERVIEW ר' יהושע בן לוי ruled that we penalize one who sold his slave to a נכרי that he must redeem him (buy him back) and pay up to a hundred times his sale price. The גמרא asked did ריב"ל mean precisely that he is obligated to redeem him for up to a hundred times his sale price, or perhaps he was not precise. There is a dispute between רש"י and תוספות as to the meaning of לאו דוקא‎. ------------------------------- פירש בקונטרס דלא קנסינן ליה כולי האי וגוזמא קאמר‎ – רש"י explained that לאו דוקא means that we do not penalize him that much to actually pay a hundred times his value, but rather ריב"ל exaggerated – תוספות asks on פרש"י: וקשה דאם כן איזה שיעור יהיב‎ – And there is a difficulty with this פרש"י, for if indeed it is so that he is not required to redeem him for a hundred times, so what maximum amount is given that he is required to redeem him – דאכתי לא ידע ההיא דקונסין אותו עד עשרה דנימא ביה ההוא שיעורא‎ – For as yet the גמרא did not know that other ruling that we penalize him up to ten times his value, so we should use that limit – תוספות offers his explanation: ונראה לפרש או לאו דוקא אלא אפילו ביותר ממאה קנסינן ליה עד דפריק – And it appears to תוספות to explain 'או לאו דוקא' to mean not precisely a hundred, but rather we penalize him even for more than a hundred times his worth until he redeems the slave, no matter at what price. This explanation – כענין שפירש בקונטרס באיכא דאמרי – Is similar to how רש"י explained 'או לאו דוקא' in the איכא דאמרי version of ריב"ל – ומייתי מבהמה דקונסין אותו עד עשרה בדמיה אלמא לאו דוקא – And the גמרא cited from the ברייתא of בהמה where we penalize him up to ten times its value, indicating that ten times is לאו דוקא‎ – דהוא הדין טפי כדקאמר הכא עד מאה גבי עבדים והוא הדין דהכא לאו דוקא: For the law requires that he redeem the בהמה for more than ten times, as ריב"ל stated here regarding slaves that it is up to a hundred times, so just as by a בהמה ten times is לאו דוקא, so the same rule applies here by an עבד that a hundred times is לאו דוקא‎. S UMMARY According to רש"י, the meaning of לאו דוקא is that it can be less than one hundred times, and according to תוספות it means even more than one hundred times. T HINKING IT OVER תוספות cites the resolution the גמרא attempted to make on the query of דוקא או לאו דוקא‎. Why did תוספות find it necessary to do so? Is there a difficulty with the answer according to תוספות, but not according to פרש"י‎?
התם דאיסורא דאורייתא‎—There it is a Torah prohibition O VERVIEW ר' ירמיה posed a query what is the rule if a person sold his slave to a נכרי and died, do we penalize the son that he is required to redeem the slave from the נכרי, or not. The גמרא says (even) if we assume that in the case where a person made a מום in a בכור, and died; we penalize the son (and do not permit him to slaughter it and eat it), nevertheless we cannot assume that the same law applies here by עבד, because by the בכור the father transgressed an איסור מה"ת, however here selling a בכור to a נכרי is only an איסור מדרבנן‎. Our תוספות suggests that there were more options to consider. ------------------------------- ובפרק כל פסולי המוקדשין (בכורות לד, ב) גבי צרם אוזן הבכור קאמר‎ – And in פרק כל פסולי המוקדשין, regarding the case where one nicked the ear of a בכור (making it into a בעל מום) and died, the גמרא there states – דליכא למיפשט מהכא דשאני עבד דמפקע ליה ממצות – That we cannot resolve the case of בכור from the case of עבד that we penalize the son, for an עבד is different and stricter than בכור, since by selling him to a נכרי, you remove him from observing the מצות, so – אם כן הוה מצי למימר הכא‎ – Therefore the גמרא could have said here (also) the opposite – אם תימצי לומר דהתם לא קנסו הכא קנסו משום דמפקע ליה ממצות‎ – Even if we assume that there by בכור they did not penalize the son, nevertheless here by עבד they did penalize the son because he removed him from מצות‎ – וכן התם הוה מצי למימר איפכא כי הכא: And similarly there in בכורות, the גמרא could have said the opposite as the reasoning is here that בכור is stricter than עבד‎. S UMMARY בכור has a strictness over עבד that it is a דאורייתא and עבד has a strictness over בכור because he is מפקע the עבד from מצות‎. T HINKING IT OVER 1. Did תוספות mean that in each מסכת the גמרא should have only said the opposite of what it said, or should the גמרא also have said the opposite of what it said? 2. Is there any reason why indeed the גמרא did not mention (in either מסכת) that we cannot derive one from the other, even if we assume the opposite of what the גמרא assumes in each מסכת (as תוספות suggests)?

ומעלה בערכאות שלהן פירש רש"י ז"ל אף על פי שנראה כמחשיב תורתם. ואינו נראה, דהא דתנן כל השטרות העולות בערכאות של נכרים כשרין לא שנא לכתחילה ולא שנא דיעבד. ורבינו תם ז"ל פירש אף על פי שנראה כמקיים המקח לרצונו.

מכרו לגוי לזמן כגון לשלשים יום שנמצא מפקיעו מן המצות אותו זמן או שמכרו חוץ ממלאכתו כלומר שלא ישתעבד בו בחוץ מדעתו שעכשו הפקעת מצות תלויה ברצון העבד או שמכרו חוץ מן המצות כלומר שלא יהא יכול להפקיעו מן המצות או חוץ מן השבתות וימים טובים כדי שלא יזלזל בהם אלא שהפקיעו שאר מצות כל אלו ספק אם יצא לחירות אם לאו ואם תפש העבד לרבו כדי דמיו לפדות עצמו בהם אין מוציאין מידו זה שכתבנו במכר עבדו לגוי לא סוף דבר לגוי אלא אף לגר תושב אבל מכרו לכותי עד שלא נעשו כגוים גמורים או לישראל משמד הרי זה ספק וכותי משנעשו כגוים גמורים אין ספק שדינו כגוי:

כבר ביארנו במוכר עבדו לגוי שקונסין אותו עד עשרה בדמיו מכל מקום במוכר בהמה גסה לגוים שהוא אסור כמו שביארנו במסכת ע"ז קונסין אותו לפדותה הימנו עד מאה בדמיה ר"ל אם לא רצה הגוי לקבל פחות ומשם ואילך אין קונסין אותו ושאלו בסוגיא זו טעם הבדל שביניהם ואמר בתחלה משום דעבדא לא הדר ליה כלומר שהרי יצא לחירות אבל בהמה חוזרת לו וחזר והקשה ואי משום הא דיו שתקנסהו במעט יותר מבעבד ודיו שתקנסהו באחד עשר בדמיה אלא שחזר ופירש דעבד מילתא דלא שכיחא הוא ודיו בעשרה בדמיו ומ"מ כתבו גדולי הפוסקים שקנסות אלו אין מגבין אותם בחוצה לארץ שאין דנין דיני קנסות בבבל אלא שיש חולקים לומר שמאחר שקנסות אלו מתורת איסור אנו באים עליהם מגבין אותם אף בחוצה לארץ אלא שמ"מ לא כל הרוצה ליטול את השם יטול אלא שיעשה על ידי חכמים ויראי שמים מכיון שביארנו שלא אמרו במוכר עבדו לגוי לפדותו עד עשרה בדמיו אלא מתורת קנס אם מכר עבדו ומת אין קונסין בנו אחריו וכן כהן שצרם אוזן בבכור כדי לעשותו בעל מום שקנסו אותו שלא ישחט עולמית אם מת לא קנסו בנו אחריו וכן אם כיון מלאכתו במועד שאמרו במקומה לאבדה הימנו אם מת לא קנסו בנו אחריו וכן מה שאמרו שדה שנתקווצה בשביעית ר"ל שניטלו קוציה תזרע למוצאי שביעית שאין זו עבודה גמורה שיהא ראוי לקנוס עליה אבל ניטייבה ר"ל נזדבלה או נידיירה ר"ל שהעביר עליה דיר של בהמות לזבלה שבאלו קנסוהו שלא תזרע אף למוצאי שביעית אם מת בנו זורעה וכן טימא טהרותיו של חברו שהוא היזק שאינו נכר ולא שמיה היזק אלא שמתורת קנס חייבוהו לשלם אם מת לא קנסו בנו אחריו וכבר ביארנו ענין כלם יותר בשני של מועד קטן ובמסכת יבמות מ"ח ב' אמרו שהלוקח עבד מן הגוי ולא רצה למול מגלגל עמו כל שנים עשר חדש וחוזר ומוכרו לגוים:

וְאִי בָּעֵית אֵימָא: בְּשֶׁלָּוָה עַל מְנָת לְמַשְׁכְּנוֹ, וְלֹא מִשְׁכְּנוֹ.
And if you wish, say instead: Even if the time for the slave or the field to be taken as collateral had arrived, there is something novel about this in a case where he borrowed on the condition that the creditors collect from it, i.e., the slave or field, but they did not yet collect from it. Since the field had not yet been collected from the gentile by the Jew as payment of the debt, it remains exempt from tithes, but the mere fact that the Jew agreed to have his slave be collected suffices for the rabbinic penalty to take effect, and the slave is emancipated.
תָּנוּ רַבָּנַן: גְּבָאוֹ בְּחוֹבוֹ אוֹ שֶׁלְּקָחוֹ סִיקָרִיקוֹן, לֹא יָצָא לְחֵירוּת. וּבְחוֹבוֹ לֹא?!
§ The Sages taught ( Tosefta , Avoda Zara 3:16): If a gentile collected a slave for payment of his debt, or the slave was taken by a Sicarius, i.e., one who would use violence and intimidation to force people to give them their property, then he is not emancipated. The Gemara asks: And is it so that if a gentile collected a slave for payment of his debt, the Sages did not institute a penalty and the slave is not emancipated?
וּרְמִינְהִי: הֲרֵי שֶׁאָנְסוּ בֵּית הַמֶּלֶךְ גּוֹרְנוֹ, אִם בְּחוֹבוֹ – חַיָּיב לְעַשֵּׂר, אִם בָּאַנְפָּרוֹת – פָּטוּר מִלְּעַשֵּׂר!
And the Gemara raises a contradiction based on what was taught in a baraita : With regard to a case where the household of the king seized one’s threshing floor by force, if they took it for payment of his debt to the king, then he is obligated to tithe in order to render fit for consumption the grain that they seized. The reason for this is because if he were not to tithe it, it would be considered as if he paid a debt using tithe. If they engaged in unjust seizure [ anparot ] then he is exempt from tithing. This baraita indicates that an item taken for payment of a debt is akin to a sale, so why should the slave taken in payment of the debt not be emancipated?
שָׁאנֵי הָתָם, דְּקָא מִשְׁתָּרְשִׁי לֵיהּ.
The Gemara answers: It is different there, because he profits by repaying a portion of his debt with tithe. If they would have taken regular produce, it would have been more of a financial loss for him. Therefore, he must separate tithe for the seized grain. In the case of the slave, he did not profit from the seizure. Therefore, the Sages did not penalize him.
תָּא שְׁמַע, דְּאָמַר רַב: הַמּוֹכֵר עַבְדּוֹ לְפַרְהַנְגְּ גּוֹי – יָצָא לְחֵירוּת! הָתָם, הֲוָה לֵיהּ לְפַיֵּיס וְלֹא פִּיֵּיס.
The Gemara suggests: Come and hear a proof, as Rav says: One who sells his slave to a gentile government official [ parhang ], then the slave is emancipated even though the owner agreed to the sale only because he was pressured by the official. There too, he neither desired nor profited from the sale. The Gemara answers: There, the owner should have appeased the official in some other way so that he would not take the slave, and he did not appease him, therefore it is appropriate to penalize him.
גּוּפָא – אָמַר רַב: הַמּוֹכֵר עַבְדּוֹ לְפַרְהַנְגְּ גּוֹי – יָצָא לְחֵירוּת. מַאי הֲוָה לֵיהּ לְמֶעְבַּד? הֲוָה לֵיהּ לְפַיֵּיס, וְלֹא פִּיֵּיס.
The Gemara discusses the matter itself. Rav says: One who sells his slave to a gentile government official, then the slave is emancipated. The Gemara asks: What could he have done; the gentile government official forced him to agree to the sale. The Gemara answers: He should have appeased the official in some other way, and he did not appease him.
בָּעֵי רַבִּי יִרְמְיָה: מְכָרוֹ לִשְׁלשִׁים יוֹם, מַהוּ? תָּא שְׁמַע, דְּאָמַר רַב: הַמּוֹכֵר עַבְדּוֹ לְפַרְהַנְגְּ גּוֹי – יָצָא לְחֵירוּת! הָתָם בְּפַרְהַנְגְּ גּוֹי שֶׁאֵינָהּ חוֹזֶרֶת.
Rabbi Yirmeya raises a dilemma: If he sold the slave to a gentile for thirty days, then what is the halakha ; is this considered to be a sale and he is emancipated as a result, or is it not a sale? The Gemara suggests: Come and hear a proof, as Rav says: With regard to one who sells his slave to a gentile government official, the slave is emancipated. The assumption is that he would be sold to the official in order to work for a limited amount of time or perform a specific task, yet he is emancipated. The Gemara answers: There, he was sold to a gentile government official, as this sale is not reversed. No proof can be brought from here with regard to the halakha of a sale that is in effect for a limited duration.
מְכָרוֹ חוּץ מִמְּלַאכְתּוֹ, מַהוּ? חוּץ מִן הַמִּצְוֹת, מַהוּ? חוּץ מִשַּׁבָּתוֹת וְיָמִים טוֹבִים, מַהוּ? לְגֵר תּוֹשָׁב, לְיִשְׂרָאֵל מְשׁוּמָּד, מַהוּ? לְכוּתִי, מַהוּ? פְּשׁוֹט מִיהָא חֲדָא: גֵּר תּוֹשָׁב הֲרֵי הוּא כְּגוֹי. כּוּתִי וְיִשְׂרָאֵל מְשׁוּמָּד – אָמְרִי לַהּ כְּגוֹי, וְאָמְרִי לַהּ כְּיִשְׂרָאֵל.
Rabbi Yirmeya asks several questions with regard to the extent of the application of this penalty: If he sold the slave to a gentile aside from his labor, i.e., the gentile will own the slave but he will still perform labor for the Jewish master, what is the halakha ? If he sold him to a gentile aside from the mitzvot, i.e., he stipulated that the slave would be able to continue observing the mitzvot, what is the halakha ? If he sold him aside from Shabbatot and Festivals, what is the halakha ? If he sold him to a gentile who resides in Eretz Yisrael and observes the seven Noahide mitzvot [ ger toshav ], or to a Jewish apostate, what is the halakha ? If he sold him to a Samaritan, what is the halakha ? The Gemara suggests: You can resolve at least one of these questions, as it was taught: A ger toshav is like a gentile. With regard to a Samaritan and a Jewish apostate, some say they are like gentiles and some say they are like Jews.
בְּעוֹ מִינֵּיהּ מֵרַבִּי אַמֵּי: עֶבֶד שֶׁהִפִּיל עַצְמוֹ לִגְיָיסוֹת, וְאֵין רַבּוֹ יָכוֹל לְהוֹצִיאוֹ – לֹא בְּדִינֵי יִשְׂרָאֵל וְלֹא בְּדִינֵי אוּמּוֹת הָעוֹלָם, מַהוּ שֶׁיִּטּוֹל אֶת דָּמָיו?
They raised a dilemma before Rabbi Ami: If a slave fled from his master and gave himself over to a foreign army to serve as a solider, and his master cannot remove him, neither through Jewish law nor through the laws of the nations of the world, what is the halakha ? Is it permitted for the master to at least take his value from the army, or would this be considered as if he is selling the slave?
אֲמַר לֵיהּ רַבִּי יִרְמְיָה לְרַבִּי זְרִיקָא: פּוֹק עַיֵּין בִּמְכִילָתָיךְ. נְפַק דָּק וְאַשְׁכַּח, דְּתַנְיָא: הַמּוֹכֵר בֵּיתוֹ לְגוֹי – דָּמָיו אֲסוּרִין. וְגוֹי שֶׁאָנַס בֵּיתוֹ שֶׁל יִשְׂרָאֵל, וְאֵין בְּעָלָיו יָכוֹל לְהוֹצִיאוֹ – לֹא בְּדִינֵי יִשְׂרָאֵל וְלֹא בְּדִינֵי אוּמּוֹת הָעוֹלָם, מוּתָּר לִיטּוֹל אֶת דָּמָיו, וְכוֹתֵב וּמַעֲלֶה בְּעַרְכָּאוֹת שֶׁלָּהֶן – מִפְּנֵי שֶׁהוּא כְּמַצִּיל מִיָּדָם.
Rabbi Yirmeya said to Rabbi Zerika: Go out and examine your mishnayot to find an answer. He went out, examined, and discovered an answer, as it is taught in a baraita ( Tosefta , Avoda Zara 6:2): One who sells his house in Eretz Yisrael to a gentile, the monies received from the sale of the house are forbidden to him. And if there was a gentile who seized a Jew’s house by force and its owner cannot remove it, i.e., get it back, neither through Jewish law nor through the laws of the nations of the world, then he is permitted to take the house’s value from the gentile, and he may even write a document and register the sale in their courts, because he is like one who rescues the money from their possession. Although it is prohibited for a Jew to sell his house in Eretz Yisrael to a gentile, if it was taken from him by force he is permitted to take payment for it. Similarly, if the slave cannot be retrieved from a gentile, it should be permitted for him to take money in return.
וְדִילְמָא הָנֵי מִילֵּי בַּיִת – דְּכֵיוָן דְּלָא סַגִּי לֵיהּ בְּלֹא בַּיִת, לָא אָתֵי לְזַבּוֹנֵיהּ; אֲבָל עַבְדָּא – דְּסַגִּי לֵיהּ בְּלָא עַבְדָּא, אָתֵי לְזַבּוֹנֵיהּ – אוֹ לָא.
The Gemara rejects this comparison: But perhaps this matter applies only to a house, that since it is not sufficient, i.e., not possible, for him to live without a house, he would not sell it willingly. Therefore, there is no reason to penalize him when it is taken by force. But with regard to a slave, as it is sufficient for him to live without a slave, there is a concern that he will also come to sell him willingly, and therefore there should be a penalty in this case as well. Or it is possible that this distinction is not made.
שְׁלַח לְהוּ רַבִּי אַמֵּי: ״מִינַּי אַמֵּי בַּר נָתָן, תּוֹרָה יוֹצְאָה לְכׇל יִשְׂרָאֵל: עֶבֶד שֶׁהִפִּיל עַצְמוֹ לִגְיָיסוֹת, וְאֵין רַבּוֹ יָכוֹל לְהוֹצִיאוֹ – לֹא בְּדִינֵי יִשְׂרָאֵל וְלֹא בְּדִינֵי אוּמּוֹת הָעוֹלָם, מוּתָּר לִיטּוֹל אֶת דָּמָיו, וְכוֹתֵב וּמַעֲלֶה בְּעַרְכָּאוֹת שֶׁל גּוֹיִם – מִפְּנֵי שֶׁהוּא כְּמַצִּיל מִיָּדָם.
Rabbi Ami sent the following message to the other Sages: From me, Ami bar Natan, Torah emerges to all of Israel: If a slave fled his master and gave himself to a foreign army to serve as a solider, and his master cannot remove him, neither through Jewish law nor through the laws of the nations of the world, then he is permitted to take the slave’s value, and he writes a deed of sale and registers this transaction in gentile courts, because he is like one who rescues the money from their possession.
אָמַר רַבִּי יְהוֹשֻׁעַ בֶּן לֵוִי: הַמּוֹכֵר עַבְדּוֹ לְגוֹי – קוֹנְסִים אוֹתוֹ עַד מֵאָה בְּדָמָיו.
Rabbi Yehoshua ben Levi says: With regard to one who sells his slave to a gentile, even though he can no longer enslave him, he is penalized and is forced to redeem the slave from the gentile for up to one hundred times the slave’s value.
דַּוְקָא, אוֹ לָאו דַּוְקָא? תָּא שְׁמַע, דְּאָמַר רֵישׁ לָקִישׁ: הַמּוֹכֵר בְּהֵמָה גַּסָּה לְגוֹי – קוֹנְסִים אוֹתוֹ עַד עֲשָׂרָה בְּדָמֶיהָ!
The Gemara asks: Is this amount stated specifically or not specifically? Perhaps this number is an exaggeration? The Gemara suggests: Come and hear an answer from that which Reish Lakish says: One who sells a large domesticated animal to a gentile, he is penalized and is forced to purchase the animal back from the gentile for up to ten times its value. It can be seen here that one who violates an ordinance of the Sages by engaging in a prohibited sale must pay up to only ten times the item’s value to purchase it back, and the same would presumably apply to the case of the slave.
וְדִלְמָא שָׁאנֵי עֶבֶד, דְּכֹל יוֹמָא וְיוֹמָא מַפְקַע לֵיהּ מִמִּצְוֹת.
The Gemara rejects this: But perhaps a slave is different, as each and every day the owner releases him from the fulfillment of mitzvot by selling him to a gentile, so there may be a greater penalty as a result.
וְאִיכָּא דְאָמְרִי, אָמַר רַבִּי יְהוֹשֻׁעַ בֶּן לֵוִי: הַמּוֹכֵר עַבְדּוֹ לְגוֹי – קוֹנְסִין אוֹתוֹ עַד עֲשָׂרָה בְּדָמָיו. דַּוְקָא אוֹ לָאו דַּוְקָא? תָּא שְׁמַע, דְּאָמַר רֵישׁ לָקִישׁ: הַמּוֹכֵר בְּהֵמָה גַּסָּה לְגוֹי – קוֹנְסִין אוֹתוֹ עַד מֵאָה בְּדָמֶיהָ!
And there are those who say a different version of this discussion: Rabbi Yehoshua ben Levi says that with regard to one who sells his slave to a gentile, even though he can no longer enslave him, he is penalized and is forced to redeem the slave from the gentile for up to ten times the slave’s value. The Gemara asks: Is this amount stated specifically or not specifically; is his penalty limited to up to ten times the value of the slave? The Gemara suggests: Come and hear an answer from that which Reish Lakish says: With regard to one who sells a large domesticated animal to a gentile, he is penalized and is forced to purchase the animal back from the gentile for up to one hundred times its value, and the penalty in the case of the slave should be at least as large as in the case of the animal.
שָׁאנֵי עֶבֶד, דְּלָא הָדַר לֵיהּ.
The Gemara rejects this: A slave is different, as he does not return to him. Since the slave will be emancipated once the master redeems him, it may be that the Sages would not penalize him to such a great extent.
אֶלָּא בְּהֵמָה טַעְמָא מַאי – מִשּׁוּם דְּהָדְרָא לֵיהּ?! לִקְנְסֵיהּ טְפֵי חַד! אֶלָּא עֶבֶד מִילְּתָא דְלָא שְׁכִיחָא, וּמִלְּתָא דְלָא שְׁכִיחָא לָא גָּזְרִי בַּהּ רַבָּנַן.
The Gemara challenges: Rather, what is the reason that he is penalized in the case of an animal more so than in the case of a slave; because of the fact that it returns to him? If so, he should be penalized only one additional amount. If the difference is that an animal returns to its owners and a slave does not, then the difference in penalties should be reflective of this, and he should have to purchase the animal for no more than eleven times its value. Rather, the Gemara offers a different distinction: The sale of a slave is an uncommon matter, and the Sages did not decree with regard to an uncommon matter. Therefore, one cannot compare the penalty in the case of selling a slave to the penalty in the case of selling an animal.
בְּעָא מִינֵּיהּ רַבִּי יִרְמְיָה מֵרַבִּי אַסִּי: מָכַר עַבְדּוֹ וָמֵת, מַהוּ שֶׁיִּקְנְסוּ אֶת בְּנוֹ אַחֲרָיו? אִם תִּימְצֵי לוֹמַר: ״צָרַם אוֹזֶן בְּכוֹר, וָמֵת – קָנְסוּ בְּנוֹ אַחֲרָיו״ – מִשּׁוּם דְּאִיסּוּרָא דְּאוֹרָיְיתָא הִיא, אֲבָל הָכָא אִיסּוּרָא דְרַבָּנַן.
Rabbi Yirmeya raised a dilemma before Rabbi Asi: If one sold his slave to a gentile and died, what is the halakha : Is his son penalized after him? Is the son also required to redeem the slave, or does the penalty apply only to the seller? The Gemara compares this to other penalties assessed by the Sages. If you say, in accordance with the opinion that holds that if one slit the ear of a firstborn animal and by doing so intentionally blemishes it so that it may be eaten, and then that person died, then his son is penalized after him and his son may not slaughter and eat it, perhaps this is because it is a prohibition by Torah law. Here, however, with regard to the sale of a slave, it is a prohibition only by rabbinic law and perhaps the son is not penalized.
