And this stumbling block meaning, so began the discourse on scripture, it is written "this stumbling block [ruin] under your hand" regarding the men of Jerusalem for whom Torah had ceased, and they were asking their friends "you have a mantle, be our ruler, and this ruin should be under your hand", that is to say, these things that are opaque like your mantle, you that are an expert on them, tell us [what to do] and be a ruler. And this stumbling block are the words of Torah, that a person does not have a firm standing on their truth unless he stumbles on them, to teach mistakes and be humiliated by them, and then one pays attention and understands. Under your hand they are - even I stumbled in my teaching and retracted [what I said].

מי איכא עבדא דלא מזדבן לקנסא‎—Is there a slave which cannot be sold for his fine O VERVIEW The גמרא cited a ברייתא, which stated that even a קנין כספו (a slave) which is not worth a פרוטה, can also eat תרומה‎. The גמרא asked if one can sell his slave for קנס, how can there be a slave (קנין כספו) who is not worth a פרוטה‎. This proves that a slave cannot be sold (only) for his קנס‎. Our תוספות challenges and explains this proof. ------------------------------ תוספות asks: ואם תאמר כי אמר נמי דאינו מכור תקשי ליה‎ – And if you will say; even if we assume that if an עבד is sold for his קנס it is not a valid sale, the גמרא can still ask – מי איכא עבדא דלא מזדבן לקנסא שיוכל למכרו כולו לגמרי – ‘Is there a slave who cannot be sold for his קנס; since he can sell the entire slave completely – תוספות answers: ויש לומר דלא ימצא קונים שיקנוהו לגמרי‎ – And one can say that he will not find buyers who are willing to buy the slave completely; they won’t be willing to do it – אפילו לא לפרנסו שיוכל לומר עשה עמי ואיני זנך – Even if they will not feed him, for the rule is that the master can say to his slave, ‘work for me, but I will not feed you’ – מכל מקום מימנעי אינשי לקנותו שלא יהא רגיל אצלם‎ – But nevertheless people will refrain from buying him, so that he will not be by them frequently; therefore he is not worth even a שוה פרוטה‎.This is true only if he has to buy him completely – אבל אם מכרו לקנס מכור זמנין דזבני ליה – However if the rule is that a sale for קנס only, is a valid sale, occasionally people will buy him, therefore he is worth a שוה פרוטה‎ – תוספות offers an alternate solution ועוד יש לומר דאפילו מוכרו כולו לגמרי אינו מכור – And additionally one can say that even if he sells this עבד completely, it is not a sale – דהא אינו שוה כלום ואינו מוכרו אלא לקנס ולקנס אינו מכור: Since intrinsically this עבד is worthless, so he is being sold only for קנס and there is no sale for קנס only (if this is what we assume), therefore he is not worth even a שוה פרוטה‎. S UMMARY People will not be willing to purchase an עבד (who is not worth a שוה פרוטה), even if they don’t feed him, for they do not want him being around, however if it’s only for קנס they may consider paying a פרוטה for the שלשים שקלים‎. Alternately, if we maintain מכרו לקנס אינו מכור, one cannot sell an עבד who is not worth a שוה פרוטה‎. T HINKING IT OVER 1. How can we explain the ועוי"ל of תוספות that even if he sold him לגמרי the sale is not valid; why should it not be valid since they both agreed to the sale? 2. What are the relative advantages of both answers?
אם תמצא לומר התקדשי לחציי מקודשת‎—If you decide to say; in a case where he said; ‘become betrothed to half of me’, she is betrothed O VERVIEW The גמרא posed a query what is the ruling if a חצי עבד וחצי בן חורין was מקדש a בת ישראל, is she מקודשת or not. This query is valid (the גמרא says) whether we assume that התקדשי לי לחציי is מקודשת, or whether we maintains חצייך מקודשת לי אינה מקודשת‎. ------------------------------ וגבי אשה קאמר אם תמצא לומר חצייך מקודשת לי אינה מקודשת‎ – And regarding the half of the woman the גמרא states, את"ל when he says ‘half of you should be מקודשת לי’, she is not מקודשת; in either את"ל the query is still valid – תוספות comments: והוי מצי למימר איפכא אלא האמת נקט דהכי מסיק בפרק קמא דקידושין (דף ז, ב): And the גמרא could have stated the את"ל in the opposite manner, but he chose the truth, for this is how the גמרא concludes in the first פרק of מסכת קידושין‎. S UMMARY The את"ל, in the manner in which the גמרא presents it, is the הלכה‎. T HINKING IT OVER תוספות writes והוי מצי למימר איפכא; what would be gained if it would be written איפכא; the הלכה is certainly not that way; why is תוספות even considering it?!
ואי אמרת קדושיו לאו קדושין יורשין מנא ליה‎—And if you say his betrothal is not a betrothal; how does he have heirs O VERVIEW The גמרא queried in a case where a חצי עבד וחצי בן חורין was מקדש a בת ישראל, whether the קידושין are valid. The גמרא cited a ברייתא, which stated that if a שור killed a חעוחב"ח, half the קנס goes to his (remaining) master and the other half goes to his heirs. The גמרא infers from this that קידושיו קידושין, for if it is not a valid קידושין, how can he have heirs. תוספות analyzes this proof. ------------------------------ תוספות asks: תימה דמה תולה יורשין בקידושין והלא בנו מן הפנויה יורשו‎ – It is astounding! For why does he associate heirs with קידושין, for is not one’s son from an unmarried woman his heir; תוספות proves this – כדאמר (יבמות דף ק, ב) גבי עשרה כהנים שפירש אחד מהן ובעל דהולד שתוקי – As שמואל ruled regarding ten כהנים, where one of them (who remains unknown) separated himself from the group, and had relations, that child who is from this relationship, is a שתוקי, meaning שמשתקין אותו מכנסי אביו משום דלא ידעינן אבוה מנו‎ – That we silence him from the estate of his father, because we do not know who is father is, however if we would know, the child would inherit, even though there was no קידושין (and she is a פנויה) – ואפילו בנו ממזר מערוה דלא תפסי בה קידושין‎ – And even if his son is a ממזר from an incestuous relation where קידושין do not take effect, nevertheless – תנן בפרק שני דיבמות (דף כב, א) דהוי בנו לכל דבר והיינו ליורשו‎ – The משנה taught in the second פרק of מסכת יבמות that this ממזר is considered his son for all matters; this means that the son inherits him – והכא אי תפסי בה קידושין גרע טפי דאתי צד עבדות ומשתמש באשת איש‎ – And here by the חעוחב"ח if קידושין would be effective it is even worse for the עבד, for the עבד part would be in a relationship with an א"א – כדאמרינן [בהחולץ] (שם דף מה, א) – As the גמרא states in פרק החולץ‎. תוספות answers: ויש לומר דסבר הש"ס דאם איתא דלאו בר קדושין הוא אין בנו מתייחס אחריו‎ – And one can say that the גמרא maintains that if indeed the חעוחב"ח cannot perform קידושין, his son is not related to him (he is not considered his son and cannot inherit him) – ולא דמי לעריות דתפסי בה קדושין לעלמא‎ – And it is not comparable to incestuous relationships, where קידושין is effective by these people with people in general (they can marry others, therefore their children inherit them) – אבל האי דלאו בר קדושין הוא בשום מקום אין הבן מתייחס אחריו: However this חעוחב"ח who can never make an effective קידושין anywhere, his child is not related to him. S UMMARY If one is not a בר קידושין anywhere, his progeny do not inherit him. T HINKING IT OVER 1. What is the reason that if one is not a בר קידושין בשום מקום therefore אין הבן מתייחס אחריו‎? 2. תוספות states that since an עבד is not a בר קידושין בשום מקום therefore his son is not מתייחס אחריו‎. We know however that regarding a נכרי who is also not a בר קידושין בשום מקום, and nevertheless his children are מתייחס אחריו, and inherit him. Why is there a difference between a נכרי and the עבד‎?

אבל הכא הא קאי שור וקאי עבד קשיא לי כי קאי שור וקאי עבד מאי הוי מכל מקום הקנס שמוכר לו איננו, ובפירות דקל נמי האי [הא] קאי דקל והאי [והא] קאי קרקע שמגדלין את הפירות, ועדיפי מהני דהנך עבידי לגדל פירות ופליגי, ועוד האומר לחברו שדה זו לכשאקחנה קנויה לך מעכשיו לרבי מאי קנה לרבנן לא קנה כדאיתא בפרק קמא במציעא, ואף על גב דקאי שדה וקאי מוכר וקאי לוקח, בבבא [ובבבא] בתרא [מט, א] גבי הקדישן ריקנין ונתמלאו ואוקימנא לרבי מאיר דהקדיש שובך ויונים הבאין דרך שובכו לשובך, ואי הכי לרבנן אין מועלין בהן אף על גב דקאי שורך וקאי יונים ויש לומר דשאני הכא דמכר העבד לקנסיו, אבל מוכר קנסי עבדו פשיטא לי דלא עשה ולא כלום ואפילו לרבי מאיר וכל שכן לרבנן דלא אמרינן בכי הא הא קאי עבד והא קאי שור, אלא דאכתי לא ניחא לי דאי משום הא משום דמספקא ליה אי הוי כמוכר דקל לפירות או לא ואף על גב דאין הקנסים יוצאין מגופו, אם כן לא הוה ליה למימר טעמא לרבנן משום דקאי שור וקאי עבד אלא הכי הוה ליה למימר תיבעי לרבנן התם הוא דלא אקני ליה דקל לפירות, אבל הכא אקני ליה עבד לקנסיו. עוד קשיא לי אשמעתין דכל שמכר העבד לקנסיו אמאי לא אמרינן דאפילו לרבנן קנה וטעמא דגוף העבד מכר לכשינגחנו השור ועשאו שותף עמו כעבד שיהא שלו ממש לענין קנסיו, ולשאר דברים כגון למלאכתו לעמוד לפניו יהיה של חברו דאטו שותפין שקנו עבד והתנו ביניהן כך מי לא הוה קנסיו לשותף זה ומאי שנא הא, והכי נמי קשיא לי בההיא דהמפקיד [לג, ב] אמאי לא העמידה בכך והוה ליה כמקנה לו הפרה לענין כפילא. וצריך לעיין.
מי איכא עבדא דלא מזדבן לקנסא ואם תאמר מכל מקום הרי הוא יכול למכרו לגמרי ושוה כסף מחמת קנסיו. יש לומר דבשלמא אי מזדבן לקנס איכא טובא דזבני בכל דהו מחמת קנס אבל אי לא מזדבן לקנס לגמרי לא זבני ליה דהא לא שוה לחם כריסיה ולהניחו למות ברעב פגם הוא לו.
ואוקימנא בטריפה ומוכה שחין ותמיה לי אמאי לא אמר ליה ולטעמיך מי איכא עבדא דלא מזדבן שעה אחת סמוך לנגיחתו והוא קנסא לדידיה, וניחא לי דאין הכי נמי דהוה ליה למימר הכי אלא דלא חש. וטובא איכא בגמרא דמצי למימר ולטעמך ולא אמר, וקושטא דמילתא קא מתרץ ליה דעל כרחין בטריפה ומוכה שחין אית לך לאוקמה לההיא דאי לא הא שוה כסף שהרי שוה פרוטה למכרו ולומר לו לכשינגח עבדי הרי הוא מכור לך מעכשיו ולשעה אחת סמוך נגיחתו. כך נראה לי.
אלא אמר רבא ראוי ליטול ואין לו איכא למידק דהא אמרינן ביבמות פרק החולץ (יבמות מה, ב) מי שחציו עבד וחציו בן חורין שקדש בת ישראל הולד אין לו תקנה משום דאתי צד עבדות ומשתמש באשת איש כלומר דנפשיה והוי ממזר אלמא תפסו בה קדושי, וראיתי בנימוקי הרמב"ן ז"ל דאינה קושיא, דהתם מעיקרא קא סלקא דעתך הכי אבל הא אסיקנא התם בשבא על אשת איש דעלמא דאתי צד חרות ומשתמש באשת איש, אבל לעולם אימא לך אין קדושיו קדושין, ואתי מסקנא דהתם כמסקנא דהכא. ודקא סלקא דעתך מעיקרא [בנדפס: דהתם] כדקא סלקא דעתך דהכא. ואינו מחוור בעיני, דמכל מקום אפילו למסקנא דהתם על כרחין אית לן למימר דקידושיו קידושין דאי לא אף הוא אינו עושה ממזר למאן דאמר נכרי ועבד הבא על בת ישראל הולד כשר, וכדאמרינן התם למאן דמכשר מכשר אפילו באשת איש וקא מפרש טעמא משום דממזר מאשת אב גמרינן ליה וכאשת אב מה אשת אב שאין לו בה קידושין אבל בעלמא יש לו קידושין יצא נכרי ועבד דאפילו בעלמא אין להן קידושין, והילכך כשתמצא לומר דמי שחציו עבד וחציו בן חורין אין קידושיו קידושין אפילו כשבא על אשת איש דעלמא אין הולד ממזר, וגירסא אחרת יש שם משמיה דרב האי גאון ז"ל באשת אב מה אשת אב שזרעו מיוחס אחריו אף כל שזרעו מיוחס אחריו יצא נכרי ועבד שאין זרעו מיוחס אחריו, ואפילו ללשון זה לכשתמצא לומר שאין קידושיו קידושין אין זרעו מיוחס אחריו וכדאמרינן נמי הכא יורשין מנא ליה, אלא רבא דהכא דיחויא בעלמא הוא דקא דחי, וקושטא דמילתא קדושיו קידושין, ויורשיו יורשיו ממש, וכן פירשו בתוספות.
מאי מאורסת מיוחדת פירוש מיוחדת בקדושין אף על פי שאינן קידושין כלל לתנא דבי רבי ישמעאל אם קדשה ישראל, ואפילו בשקדשה עבד עברי אינן קדושין גמורין, מכל מקום יחיד עושה להתחייב הבא עליה באשם, והיינו דקרי לה מאורסת אבל מיוחדת ביחוד בעלמא לאו כלום הוא, דע לך מדאמרינן בסמוך לתנא דבי רבי ישמעאל דאמר מאי מאורסת מיוחדת, הכי נמי דאי חופשה יומתו אלא מאי אית לך למימר שחזרה ונתקדשה לאחר שחופשה, ואי מיוחדת בלא קדושין קאמר אף כשעשה בה לאחר שחרור מעשה זה כלומר יחוד בעלמא מי יומתו, וקרא הכי קאמר לא יומתו מפני שמעשה זה שעשה בההעבד העברי לא עשאו אלא קודם שחופשה הא עשאו לאחר שחופשה יומתו, אלא ודאי כדאמרן. כך נראה לי.

בראשון של קדושין ביארנו שהאומר לאשה חצייך מקדשת לי אינה מקדשת שאין אשה ראויה לשנים ואם אמר התקדשי לחציי מקדשת כלה שאם ימלך לישא אחרת עמה שיעשה ברשותה מעתה חציו עבד וחציו בן חורין שקדש בת חורין וכן חציה שפחה וחציה בת חורין שנתקדשה לבן חורין שאלו בסוגיא זו אם יש כאן קדושין אם לאו ואף רוב פוסקים נחלקו בפסק שבה והוא שהרבה מהם פוסקים בשני אלו שאין כאן קדושין כלל וזה שאמרו שפחה נחרפת לאיש זו חציה שפחה וחציה בת חורין המאורסת לעבד עברי פירושו המיוחדת וגזרת הכתוב הוא לחייבו אשם הואיל ונתיחדה לו וראייתם מדאמר רב ששת הלכתא כשם שהמקדש חצי אשה אינה מקדשת כך המקדש חציה שפחה וחציה בת חורין אינה מקדשת אע"פ שמ"מ לא שייר בקנינו:
ומעתה אף חציו עבד וחציו בן חורין שקדש בת חורין אינה מקדשת הואיל ולא חזיא לכוליה שאין לחלק ביניהן ואם כן מה שאמרו למעלה נותן חצי קנס לרבו וחצי כופר ליורשיו פירושו אלו היו לו יורשים דהא מ"מ אי אפשר לו ביורשים שאם באחים גוי את הגר אינו יורש ואם אחים משוחררים גר את הגר אינו יורש ואם שהיו לו בנים בעבדותו אע"פ שגוי ועבד הבא על בת ישראל הולד כשר אין יורשין אותו דעבד אין לו חייס ואם שנולדו לו בנים אחר שנשתחרר חציו הרי לדעתך אין קדושיו תופסין וא"כ אינן יורשים שאלו היו קדושיו תופשים אע"פ שהיה צד עבירה בביאתו היו בניו יורשים אותו אלא ודאי אתה מפרש ראוי ליטול ואין לו כמו שפירשנו למעלה ומ"מ גדולי הדורות פסקו בשניהם שמקדשת מדהדר ואוקים רבה בר רב הונא אמורא עילויה ודרש והמכשלה הזאת תחת ידיך אין אדם עומד על דברי תורה אלא אם כן נכשל בהם שהחזיק עצמו כטועה על מה שאמר וחזר לומר שקדשיה קדשין ומה שאמרו בשפחה נחרפת לאיש חציה שפחה וחציה בת חורין המאורסת לעבד עברי פירושו מקדשת ממש והוא הדין לשאר ישראל אלא דאורחא דמלתא נקט ובכי הא הוא דמייתי אשם ומ"מ גדולי המחברים כתבו בה שמקדשת מספק ונראין הדברים שהיא מקדשת שבכל התלמוד אנו קורין מאורסת לעבד עברי ומתוך שלא נשתחררה כלה אינה אשת איש גמורה להעמידה בחנק אלא באשם:

דִּלְמָא מוֹדֶה וּמִיפְּטַר.
Perhaps he will admit his obligation and become exempt from his obligation to pay, for one who admits that he is required to pay a penalty before the court obligates him to pay it is exempt.
וְתִבְּעֵי לְרַבָּנַן – עַד כָּאן לָא קָאָמְרִי רַבָּנַן אֵין אָדָם מַקְנֶה דָּבָר שֶׁלֹּא בָּא לָעוֹלָם – אֶלָּא כְּגוֹן פֵּירוֹת דֶּקֶל, דְּהַשְׁתָּא מִיהָא לֵיתַנְהוּ; אֲבָל הָכָא – הָא קָאֵי שׁוֹר וְהָא קָאֵי עֶבֶד. מַאי?
And you could raise this dilemma according to the opinion of the Rabbis as well, as the Rabbis state that a person cannot transfer ownership of an entity that has not yet come into the world only in a case such as the produce of a date palm, which now, at least, is not in the world. However, here, the ox is standing and the slave is standing, and there is no need for any change in the reality. What is the halakha in this case?
אָמַר רַבִּי אַבָּא, תָּא שְׁמַע: ״וִילִיד בַּיִת״ – מָה תַּלְמוּד לוֹמַר? אִם קִנְיַן כֶּסֶף – אוֹכֵל, יְלִיד בַּיִת – לֹא כׇּל שֶׁכֵּן?!
Rabbi Abba said: Come and hear a proof based on a halakhic exposition of the verse that details those who may partake of teruma . The verse states: “But if a priest buys any person, the purchase of his money, he may eat of it; and those who are born in his house, they may eat of his bread” (Leviticus 22:11), and the Sages expound as follows: What is the meaning when the verse states: “And those who are born in his house”? If a slave, who is the purchase of his money, may partake of teruma , then in the case of those slaves who are born to the priest in his house, is it not all the more so that they should be able to partake of teruma ?
אִילּוּ כֵּן, הָיִיתִי אוֹמֵר: מָה קִנְיַן כֶּסֶף, שֶׁיֵּשׁ בּוֹ שָׁוֶה כֶּסֶף – אוֹכֵל; אַף יְלִיד בַּיִת, שֶׁיֵּשׁ בּוֹ שָׁוֶה כֶּסֶף – אוֹכֵל; וּמִנַּיִן שֶׁאַף עַל פִּי שֶׁאֵינוֹ שָׁוֶה כְּלוּם? תַּלְמוּד לוֹמַר ״יְלִיד בַּיִת״ – מִכׇּל מָקוֹם.
The baraita continues: If so, if the halakha that a born slave may partake of teruma is derived only due to this a fortiori inference, I would have said: Just as with regard to the purchase of his money it is only one who has monetary value that partakes, so too, with regard to one born in his house, only one who has monetary value partakes. And from where is it derived that the same halakha applies when a born slave is not worth anything, e.g., in the case of a newborn, who cannot perform any labor? The verse states: “Those who are born in his house,” in any case, regardless of their present monetary value.
וַעֲדַיִין אֲנִי אוֹמֵר: יְלִיד בַּיִת, בֵּין שֶׁיֵּשׁ בּוֹ שָׁוֶה כֶּסֶף, בֵּין שֶׁאֵין בּוֹ שָׁוֶה כֶּסֶף – אוֹכֵל; קִנְיַן כֶּסֶף, יֵשׁ בּוֹ שָׁוֶה כֶּסֶף – אוֹכֵל, אֵין בּוֹ שָׁוֶה כֶּסֶף – אֵינוֹ אוֹכֵל; תַּלְמוּד לוֹמַר: ״קִנְיַן כַּסְפּוֹ וִילִיד בֵּיתוֹ״ – מָה יְלִיד בַּיִת, אַף עַל פִּי שֶׁאֵינוֹ שָׁוֶה כְּלוּם – אוֹכֵל; אַף קִנְיַן כַּסְפּוֹ, אַף עַל פִּי שֶׁאֵינוֹ שָׁוֶה כְּלוּם – אוֹכֵל.
The baraita continues: And I still say that perhaps one born in the priest’s house may partake of teruma whether he has monetary value or whether he does not have monetary value. But with regard to a slave purchased of the priest’s money, when he has monetary value, he may partake; when he does not have monetary value, he may not partake. The verse states: “The purchase of his money…and those who are born in his house, they may eat of his bread” (Leviticus 22:11). The verse compares the two, indicating: Just as one born in the priest’s house may partake of teruma although he is not worth anything, so too, the purchase of his money may partake of teruma although he is not worth anything. In any event, it is clear from this baraita that it is possible for a slave to have no monetary value.
וְאִי סָלְקָא דַעְתָּךְ, עֶבֶד שֶׁמְּכָרוֹ רַבּוֹ לִקְנָס – מָכוּר; מִי אִיכָּא עַבְדָּא דְּלָא מִזְדַּבַּן לִקְנָסָא?! אִין, אִיכָּא עֶבֶד טְרֵפָה.
Rabbi Abba now states his proof. And if it enters your mind to say that a slave whose master sold him to another person only with regard to the penalty is sold, is there a slave that cannot be sold with regard to the penalty? Even if he cannot perform any labor, he still has value in that he can be sold with regard to the penalty. The Gemara answers: Yes, there is the case of a slave who has a wound that will cause him to die within twelve months [ tereifa ]. Since he will die from an injury that is already present, one would not be required to pay a penalty if one’s ox gored him.
וְהָא חֲזֵי לְמֵיקַם קַמֵּיהּ! בִּמְנֻוּוֹל וּמוּכֵּה שְׁחִין.
The Gemara challenges: But isn’t he fit to stand before his master in honor, even if he cannot perform any other service, so he has some value as a slave? The Gemara answers: This baraita is referring to a slave who is not only a tereifa and for whom there is no penalty, but is also disgusting [ menuvval ] or afflicted with boils [ mukeh sheḥin ]. It would not be a display of honor for the slave to stand before the master, and therefore he is worthless. This question of the Gemara remains unresolved.
אִיבַּעְיָא לְהוּ: מִי שֶׁחֶצְיוֹ עֶבֶד וְחֶצְיוֹ בֶּן חוֹרִין, שֶׁקִּידֵּשׁ בַּת חוֹרִין, מַהוּ? אִם תִּמְצָא לוֹמַר: ״בֶּן יִשְׂרָאֵל שֶׁאָמַר לְבַת יִשְׂרָאֵל: ׳הִתְקַדְּשִׁי לְחֶצְיִי׳ – מְקוּדֶּשֶׁת״ – דְּחַזְיָא לְכוּלֵּיהּ; הָא – לָא חַזְיָא לְכוּלֵּיהּ.
§ A dilemma was raised before the Sages: In the case of one who is a half-slave half-freeman who betrothed a free woman, what is the halakha ? The Gemara discusses the elements of this question: If you say that this should be compared to a Jewish man who said to a Jewish woman: Become betrothed to half of me, and the halakha is that she is betrothed, this is because she is fit to marry all of him. However, in this case one could say that she is not fit to marry all of him because he is a half-slave, so it is not a valid betrothal.
וְאִם תִּמְצָא לוֹמַר: ״בֶּן יִשְׂרָאֵל הַמְקַדֵּשׁ חֲצִי אִשָּׁה – אֵינָהּ מְקוּדֶּשֶׁת״ – דְּשִׁיֵּיר בְּקִנְיָנוֹ; וְהָא עֶבֶד – לֹא שִׁיֵּיר בְּקִנְיָנוֹ. מַאי?
However, if you say that this should be compared to the case of a Jewish man who betroths half a woman, where the halakha is that she is not betrothed because he left a portion of the woman out of his acquisition, as betrothal acquires a complete woman and not half of a woman, but this slave did not leave any part of her out of his acquisition, as his Jewish half betrothed her fully. What is the halakha in this case?
תָּא שְׁמַע: הֵמִית מִי שֶׁחֶצְיוֹ עֶבֶד וְחֶצְיוֹ בֶּן חוֹרִין – נוֹתֵן חֲצִי קְנָס לְרַבּוֹ, וַחֲצִי כוֹפֶר לְיוֹרְשָׁיו. וְאִי אָמְרַתְּ קִידּוּשָׁיו לָאו קִידּוּשִׁין, יוֹרְשִׁין מְנָא לֵיהּ?
The Gemara suggests: Come and hear a proof based on that which is taught in a baraita : If an ox killed a half-slave half-freeman, then the owner of the ox gives half of a penalty, i.e., fifteen shekels, to his master and half of a ransom, i.e., half of the value of the deceased, to his heirs. And if you say that his betrothal is not a valid betrothal, and the half-slave half-freeman may not marry a woman, then from where does he have heirs? It must be that he may betroth and marry a woman, and as a result he can have heirs.
אָמַר רַב אַדָּא בַּר אַהֲבָה: כְּשֶׁעֲשָׂאוֹ טְרֵפָה; וּמַאי ״יוֹרְשָׁיו״ – נַפְשֵׁיהּ.
Rav Adda bar Ahava says: This is referring to a case where the ox did not actually kill him. Rather, it made him a tereifa , and a tereifa is like a dead person. And what is the meaning of: His heirs? It means the half-slave half-freeman himself.
אָמַר רָבָא, שְׁתֵּי תְּשׁוּבוֹת בַּדָּבָר: חֲדָא – דְּ״יוֹרְשָׁיו״ קָתָנֵי; וְעוֹד – כּוֹפֶר הוּא, וְאָמַר רֵישׁ לָקִישׁ: כּוֹפֶר אֵין מִשְׁתַּלֵּם אֶלָּא לְאַחַר מִיתָה! אֶלָּא אָמַר רָבָא: רָאוּי לִיטּוֹל, וְאֵין לוֹ.
Rava said that there are two refutations of your statement: One is that it teaches: His heirs, and it is not reasonable to say that this is referring to the victim himself. And furthermore, it is referring to ransom here, and Reish Lakish says: Ransom is paid only after the death of the victim but not while he is still alive, even if he is a tereifa . Rather, Rava says: When the baraita states that half of the ransom is given to his heirs, it means that it is fitting for heirs to take the ransom, but he does not actually have heirs.
אָמַר רָבָא: כְּשֵׁם שֶׁהַמְקַדֵּשׁ חֲצִי אִשָּׁה – אֵינָהּ מְקוּדֶּשֶׁת, כָּךְ חֶצְיָהּ שִׁפְחָה וְחֶצְיָהּ בַּת חוֹרִין שֶׁנִּתְקַדְּשָׁה – אֵין קִדּוּשֶׁיהָ קִדּוּשִׁין.
§ Rava says: Just as the halakha is that in the case of one who betroths half a woman, she is not betrothed, so too, if there is a half-maidservant half-free woman who was betrothed, then her betrothal is not a valid betrothal.
דָּרֵשׁ רַבָּה בַּר רַב הוּנָא: כְּשֵׁם שֶׁהַמְקַדֵּשׁ חֲצִי אִשָּׁה – אֵינָהּ מְקוּדֶּשֶׁת, כָּךְ חֶצְיָהּ שִׁפְחָה וְחֶצְיָהּ בַּת חוֹרִין שֶׁנִּתְקַדְּשָׁה – אֵינָהּ מְקוּדֶּשֶׁת. אֲמַר לֵיהּ רַב חִסְדָּא: מִי דָּמֵי? הָתָם שִׁיֵּיר בְּקִנְיָנוֹ, הָכָא לֹא שִׁיֵּיר בְּקִנְיָנוֹ!
The Gemara says: Rabba bar Rav Huna taught this halakha in public: Just as the halakha is that in the case of one who betroths half a woman, she is not betrothed, so too, if there is a half-maidservant half-free woman who was betrothed, then her betrothal is not a valid betrothal. Rav Ḥisda said to him as a question: Are the cases comparable? There, where he betroths half a woman, he leaves a portion of the woman out of his acquisition. That is why the betrothal does not take effect. However, here, she was a half-maidservant half-free woman when he betrothed her, and he did not leave a portion of the woman out of his acquisition, so the betrothal should take effect.
הֲדַר אוֹקֵים רַבָּה בַּר רַב הוּנָא אָמוֹרָא עֲלֵיהּ, וּדְרַשׁ: ״וְהַמַּכְשֵׁלָה הַזֹּאת תַּחַת יָדֶיךָ״ – אֵין אָדָם עוֹמֵד עַל דִּבְרֵי תוֹרָה, אֶלָּא אִם כֵּן נִכְשָׁל בָּהֶן; אַף עַל פִּי שֶׁאָמְרוּ הַמְקַדֵּשׁ חֲצִי אִשָּׁה – אֵינָהּ מְקוּדֶּשֶׁת, אֲבָל חֶצְיָהּ שִׁפְחָה וְחֶצְיָהּ בַּת חוֹרִין שֶׁנִּתְקַדְּשָׁה – קִדּוּשֶׁיהָ קִדּוּשִׁין. מַאי טַעְמָא? הָתָם שִׁיֵּיר בְּקִנְיָנוֹ, הָכָא לֹא שִׁיֵּיר בְּקִנְיָנוֹ.
Rabba bar Rav Huna went back and placed an interpreter before him so that he could tell the public that he had been wrong, and he interpreted a verse homiletically. The verse states: “And let this stumbling-block be under your hand” (Isaiah 3:6). A person does not understand statements of Torah unless he stumbles in them. Therefore, I retract my previous statement and say that although the Sages said that in the case of one who betroths half a woman, she is not betrothed, however, if there was a half-maidservant half-free woman who was betrothed, then her betrothal is a valid betrothal. What is the reason for the distinction? There, he left a portion of the woman out of his acquisition; here, he did not leave a portion of the woman out of his acquisition.
אָמַר רַב שֵׁשֶׁת: כְּשֵׁם שֶׁהַמְקַדֵּשׁ חֲצִי אִשָּׁה – אֵינָהּ מְקוּדֶּשֶׁת, כָּךְ חֶצְיָהּ שִׁפְחָה וְחֶצְיָהּ בַּת חוֹרִין שֶׁנִּתְקַדְּשָׁה – אֵין קִידּוּשֶׁיהָ קִידּוּשִׁין. וְאִם לְחָשְׁךָ אָדָם לוֹמַר: אֵיזוֹ הִיא שִׁפְחָה חֲרוּפָה – זוֹ שֶׁחֶצְיָהּ שִׁפְחָה וְחֶצְיָהּ בַּת חוֹרִין הַמְאוֹרֶסֶת לְעֶבֶד עִבְרִי; אַלְמָא בַּת אִיתְּרוֹסֵי הִיא! אֱמוֹר לוֹ: כְּלָךְ אֵצֶל רַבִּי יִשְׁמָעֵאל, שֶׁהוּא אוֹמֵר – בְּשִׁפְחָה כְּנַעֲנִית הַמְאוֹרֶסֶת לְעֶבֶד עִבְרִי.
Rav Sheshet said in response to this: Just as the halakha is that in the case of one who betroths half a woman, she is not betrothed, so too, if there is a half-maidservant half-free woman who was betrothed, then her betrothal is not a valid betrothal. And if a person whispers to you [ leḥashekha ], saying, based on what was taught in a baraita : Who is the designated maidservant mentioned in the Torah? This is a woman who is a half-maidservant half-free woman who is betrothed to a Hebrew slave, apparently indicating that she can be betrothed, then say to him: Go to the opinion of Rabbi Yishmael, for he says that this is not referring to a woman who is a half-slave, but rather to a Canaanite maidservant betrothed to a Hebrew slave.
וְשִׁפְחָה כְּנַעֲנִית בַּת אִיתְּרוֹסֵי הִיא?! אֶלָּא מַאי אִית לָךְ לְמֵימַר, מַאי ״מְאוֹרֶסֶת״ – מְיוּחֶדֶת; הָכָא נָמֵי, מַאי ״מְאוֹרֶסֶת״ – מְיוּחֶדֶת.
Rav Sheshet questions his own statement: But can a Canaanite maidservant be betrothed? Rather, what have you to say: What is the meaning of the word betrothed in the statement of Rabbi Yishmael? It means that she is designated for him, and it is not actual betrothal. Here, also, in the baraita , what does it mean that the Canaanite maidservant is betrothed to a Hebrew slave? It means that she is designated to cohabit with him, but they are not in fact betrothed.
אָמַר רַב חִסְדָּא: חֶצְיָהּ שִׁפְחָה וְחֶצְיָהּ בַּת חוֹרִין שֶׁנִּתְקַדְּשָׁה לִרְאוּבֵן, וְנִשְׁתַּחְרְרָה, וְחָזְרָה וְנִתְקַדְּשָׁה לְשִׁמְעוֹן, וּמֵתוּ שְׁנֵיהֶם – מִתְיַיבֶּמֶת לְלֵוִי,
Rav Ḥisda says: If there was a half-maidservant half-free woman who was betrothed to Reuven, and afterward she was emancipated entirely, and she went back and was betrothed to Shimon his brother, and both brothers died without children, then she enters into levirate marriage with Levi, the third brother, because she was considered to be the complete wife of only one of the brothers,
