הנודר על תנאי או מי שתולה נדרו בדעת אחרים. ובו סעיף אחד:
אין הנדר והשבועה ניתרים אלא על פי מומחה או בג' הדיוטות שאפילו פירש והתנה בשעת הנדר או השבועה אימתי שירצה שיבטלנו מעיקרו או שתלה (באחר) שיבטלנו אימתי שירצה אינו כלום דמיד כשחל הנדר אין לו התרה אלא על ידי מומחה או ג' הדיוטות ואפילו אם תלאו בדעת אחר וקיימו ושוב נשאל על הקיום אינו מועיל: הגה אבל אם לא קיימו ומיד ששמעו אמר שלא יהיה נדר הנדר בטל (כן משמע מדברי הרא"ש כלל י' סי' ג' ומל' הטור) וכ"ש אם התנה בפירוש שחבירו יוכל לבטלו דיוכל חבירו לבטל כל זמן שלא חל הנדר (ריב"ש סי' תפ"ו וקפ"ב) ועיין לעיל סי' רכ"ח סעיף ל"ז ול"ח : ומיהו אם נדר לזמן אין צריך התרה אלא לכשיגיע הזמן בטל ממילא:
