    1. 1Du vœu qui consiste à s’interdire un objet en l’assimilant à une chose défendue par la Torah Un homme a dit: «Que ces fruits, ou: que cette espèce de fruits, ou: que les repas pris en compagnie de telle personne, me soient comme la viande de porc, ou: comme l’idolâtrie, ou: comme la viande des animaux non abattus selon le rite», ou bien il a dit: «Que ma femme me soit comme ma mère, ou: comme ma sœur, ou comme les fruits d’une jeune greffe, ou: comme le mélange de semences diverses»: Tous ces vœux sont nuls. Cependant si un tel vœu a été prononcé par un ignorant, celui-ci doit s’en faire faire remise par un rabbin, dont le devoir est alors de lui laisser penser que ce qu’il s’est interdit pourrait bien lui rester interdit, et de chercher un moyen de le dispenser de ce vœu, qui en réalité n’en est pas un. Le rabbin doit recourir à ce subterfuge, afin que l’ignorant craigne à l’avenir de prononcer des vœux irréfléchis. G LOSE : D’aucuns prétendent qu’aujourd’hui la plupart des Israélites, n’étudiant pas assez la Loi, doivent être considérés comme des ignorants. D’autres disent que l’ignorant lui-même n’a pas besoin de rabbin pour se faire faire remise d’un des vœux dont on vient de parler, sauf lorsqu’il s’agit du vœu concernant la femme.
    2. 2Si un homme dit «Que mon vin me soit comme le vin destiné aux idoles, et que mon pain me soit comme le pain des Kouthîm», le vœu est nul. Mais lorsque cet homme, en formulant son vœu, se pose une condition, à savoir: «Que son vin lui soit comme le vin destiné aux idoles, et son pain comme le pain des Kouthîm, s’il accomplit telle action, ou s’il commet telle infraction», et qu’il se rend ensuite coupable de l’acte visé, les uns considèrent le pain et le vin comme permis pour lui, d’autres les lui interdisent. G LOSE : Si ce vœu a été prononcé par un ignorant, il doit s’en faire faire remise par un rabbin. Il ne s’agit ici que du cas où la personne s’est interdit le pain et le vin à elle seule; mais si elle a dit que nul ne profiterait de ces aliments, ils restent défendus, pour la punir de son vœu imprudent (Voir § 229: Ce qui arrive quand on dit: «Si je fais cela, je ne serai plus un Israélite.»

    האומר שיהא יינו יין נסך ופתו פת כותים לא נאסר בכך אבל אם אמרו בדרך קנס כגון שאמר אם אעשה כך או אם אעבור על כך יהיה פתי פת כותים וייני יין נסך ועבר יש אוסרים ויש מתירים: הגה ואפ"ה בעם הארץ יש להתירו וכל זה ביחיד שקבל על עצמו אבל רבים יכולים בזמן הסנהדרין לרדות המורדים והפושעים שיינם יהיה יין נסך ופתן פת כותים וכל מה שגוזרים בזה הי' קיים (תשובת הרשב"א) ע"ל סי' רכ"ט מי שאמר אם אעשה דבר פלוני לא אהיה יהודי:
