Shulchan Arukh Orach Chayim 467 — English translation

- 1Laws of wheat upon which water fell, and a cooked dish in which a wheat kernel was found. Contains 16 sections Grain that was submerged in a river or upon which water fell — just as it is forbidden to eat it, so too it is forbidden to keep it. Rather one sells it to a Jew and informs him so that he eats it before Passover. If he sold it to a non-Jew before Passover, he sells a little to each one so that it will be consumed before Passover, lest the non-Jew resell it to a Jew.
- 2Such grain that was submerged in a river or upon which water fell — even if it did not split open — is forbidden, since when it rests undisturbed it comes to leavening. Rema: Therefore one should be careful that water or drizzling rain not come upon wheat, for then even if the kernels did not split open they are forbidden. Grain that was stored in an attic and rain came through the roof in some places and moistened it — those that became moist are forbidden, but the rest may be kept on account of a double doubt: perhaps the rain did not fall on them, and even if it did, perhaps they did not become leavened. But to eat them on Passover is forbidden, and a double doubt does not help for that.
- 3Wheat that came by ship — if it is dry and hard and its appearance has not changed, we do not presume it to be forbidden.
- 4In a year when rains were plentiful and fell on stacks in the fields such that some of the stalks on top of the stacks sprouted — we have no concern about ordinary wheat of that year.
- 5Grain still attached to the ground that dried out completely and no longer needs moisture is considered as if resting in a barrel, and becomes leavened if rain falls on it.
- 6Wheat kernels among which some split ones are found — those that are not split are permitted, since it is common for the top and bottom of a stack to become leavened and split during rain while the water does not touch the middle at all.
- 7A Jew who has pits full of wheat and is concerned there may be split kernels at the bottom and sides of the pit from the moisture of the pit and the earth — mere nullification suffices. (See above Siman 436, section 1.)
- 8Honey belonging to a non-Jew — we do not presume it to be forbidden and one may eat it on Passover. Rema: However some are stringent. The custom in these lands is to eat only honey brought in barrels from the hive used to make the drink called mead. Dried figs and dried grapes — whether large or small raisins — depends on local custom, as some are stringent not to eat them and some are lenient. Therefore the custom in these lands is to be stringent not to eat any dried fruits unless it is known they were dried in a way that raises no leavening concern. Sugar is forbidden to eat and even to keep. On the last day of Yom Tov one eats dried fruits and rock candy sugar which have no leavening concern. The custom in these lands is not to eat saffron called zafran or negelach. However they do not forbid their mixtures, and so it seems to me.
- 9A cooked dish that was cooked and wheat or barley kernels were found in it — if they actually split open, the entire dish is forbidden. If they did not actually split open, the dish is permitted. Rema: The custom is not so — rather everything is forbidden even in the smallest amount even if they did not split open, and those wheat or barley kernels are burned.
- 10A cooked chicken in which a split wheat kernel was found on Passover — it is permitted to sell it to a non-Jew since it does not sell for a higher price on account of the wheat found in it. Rema: In these lands the custom is to burn everything. And if it was found on the eighth day of Passover, it is permitted to keep it until after Passover.
- 11If a split wheat kernel was found in dough or in baked matzah — one removes from it the amount required for removal of the place and the rest is permitted. Some forbid the entire dough or that matzah, and it is proper to be concerned for their opinion except in case of great loss or pressing need. Rema: The custom during Passover is to forbid that matzah in which the wheat was found and to permit the others — whether it was found baked in or raw — and we say "here it was found, here it was," meaning it was always there. If it was found in the dough, the entire dough is forbidden. This applies only during Passover, but before Passover one only forbids the amount required for removal. Such is the custom.
- 12If a chicken was scalded — meaning boiled in water to remove the feathers — and afterward a split wheat kernel was found in the water, the chicken is forbidden. If a split wheat kernel or leavened bread was found in a vessel of cold water and there is not enough to impart flavor — since the water is cold — and one cooked a dish or kneaded dough with that water, it is permitted. Some forbid this if it occurred during Passover. Rema: Some permit even in the case of scalding chickens, since we say perhaps it fell there afterward. Some forbid in the case of other meat but permit in the case of chicken on account of a double doubt. Regarding the custom, it seems proper to forbid other meat or a whole wheat kernel even in chicken, specifically when the chickens were scalded meaning the water was hot — but if the water was cold and the chickens soaked there, one should not forbid on account of doubt. Where one can say the wheat was digested inside the chicken such as when it is broken, even in scalding there is reason to permit on account of double doubt. However if the mixtures became mixed together and there is great loss and it would prevent Yom Tov joy, one may be lenient in all this regarding doubt about a rabbinic prohibition which is the smallest amount, and one may permit other dishes that contain a mixture from that meat dish that soaked in the water or was scalded — so it seems to me.
- 13If one scalded a leavened pot that had been used that same day and the leavened water flowed into a cistern during Passover, it is forbidden to drink from the cistern during Passover since it became mixed in.
- 14If a split wheat kernel was found on a chicken before salting — washing suffices. If after salting — peeling suffices. Some are stringent to say one must cut deeply all around it and discard it. If other chickens were salted with it, one peels all of them. Rema: Some are stringent to forbid everything salted together, but the primary ruling is to forbid the entire piece on which the wheat was found and to permit the others through slight peeling. If one wishes, one may sell everything to a non-Jew as explained in Siman 447, section 1 — even though this is not the custom for other leavened mixtures, so it seems to me.
- 15A roasted chicken in which a split wheat kernel was found during Passover — one cuts away the area of its spread according to estimate. Some forbid the entire chicken since when the spit is turned the flavor spreads throughout the chicken. Some also forbid all the other chickens roasted on the same spit that were touching each other, since through the turning of the spit it spreads from one to another.
- 16A wheat or barley kernel found in the crop of a bird after it was singed — the bird is permitted, but the wheat and barley must be burned since they are not considered fully digested.

דגן זה שנטבע בנהר או שנפל עליו מים אף על פי שלא נתבקע אסור דכיון דמינח נייחי אתי לידי חימוץ: הגה ולכן יש ליזהר שלא יבאו מים או גשמים מזלפין על החטים כי אז אפי' לא נתבקעו אסורות ודגן שהיה מונח בעלייה וירדו גשמים דרך הגג בקצת המקומות ונתלחלחו אותן שנתלחלחו אסורות אבל שאר מקומות מותר להשהותן מכח ספק ספיקא שמא לא ירדו עליהם גשמים ואם תמצי לומר ירדו שמא לא נתחמצו אבל לאכלן בפסח אסור ולא מהני ספק ספיקא (אגור וכל בו):
חטים שבאו בספינה אם הם יבשות וקשות ולא נשתנה מראיהן אחזוקי איסורא לא מחזקינן:
שנה שרבו גשמים וירדו על ערימות שבשדות עד שהיו קצת מהשבלים שעל הערימות מעלים צמחים אין חוששין לסתם חטים של אותה שנה:
דגן שבמחובר שנתייבש לגמרי ואינו צריך ליניק' כמאן דמנח בכדא דמי ומקבל חימוץ אם ירדו עליו גשמים:
חטים שנמצאו בהן מבוקעות אותן שאינן מבוקעות מותרות מפני שהדבר מצוי שבשעת גשמים עליונות הגדיש ותחתיתו מתחמץ ומתבקע ואין המים נוגעים באמצעיתו כלל:
ישראל שיש לו בורות מלאים חטים וחושש שמא יש בקרקעית הבור ובקירותיו חטים מבוקעים מלחות הבור והארץ בביטול בעלמא סגי: (וע"ל סי' תל"ו סעיף א'):
דבש של עכו"ם אין מחזיקין בו איסור ואוכלין אותו בפסח: הגה מיהו יש מחמירין (מרדכי פרק כל שעה והגמ"י פ"ד) והמנהג במדינות אלו שלא לאכול דבש רק אותו שמביאין בחביות מן הכוורת שעושין ממנו משקה שקורין מע"ד ותאנים יבשים וענבים יבשים שקורין רוזי"ני גדולים או קטנים תלוי במנהג המקומות כי יש מחמירין שלא לאכלן ויש מקילין ולכן נהגו במדינות אלו להחמיר שלא לאכול שום פירות יבשים אם לא שידוע שנתייבשו בדרך שאין לחוש לחמץ וצוקר אסור לאוכלו אפי' להשהותו אסור (ת"ה סי' קי"א) וביו"ט האחרון אוכלין פירות יבשים וצוק"ר קאנדי"ל שאין בו חשש חימוץ (מהרי"ל) והמנהג במדינות אלו שלא לאכול כרכום שקורין זפרי"ן או נעגלי"ך (מהרי"ל) מיהו אינן אוסרין תערובתן וכן נ"ל:
תבשיל שנתבשל ונמצאו בו שעורים או חטים אם נתבקעו ממש הרי כל התבשיל אסור ואם לא נתבקעו ממש התבשיל מותר: הגה ואין המנהג כן אלא אוסרים הכל במשהו אפילו לא נתבקעו ואותם חטים או שעורים שורפים אותם:
תרנגולת מבושלת שנמצא בה בפסח חטה מבוקעת מותר למוכרה לעכו"ם שאינה נמכרת יותר ביוקר בשביל החטה שנמצאת בתוכה: הגה ובמדינות אלו נוהגין לשרוף הכל (וע"ל סימן תמ"ז סעיף ג') ואם נמצאת ביום שמיני של פסח מותר להשהותה עד אחר הפסח:
אם נמצאת חטה בקועה בעיסה או במצה אפויה יסיר ממנה כדי נטילת מקום והשאר מותר ויש מי שאוסר כל העיסה או אותה מצה וראוי לחוש לדבריו אם לא במקום הפסד מרובה או בשעת הדחק: הגה וכן נוהגין תוך הפסח לאסור אותה מצה שנמצא בה החטה ומתירים את האחרות בין שנמצא בה אפויה או חיה ואמרינן כאן נמצאת כאן היתה ואם נמצאת בעיסה אוסרין כל העיסה ודוקא תוך הפסח אבל קודם הפסח אין אוסרין רק כדי נטילה והכי נהוג:
אם מלגו (פי' שהרתיחוהו במים להעביר הנוצה) תרנגולת ואח"כ מצאו במים גרעין חטה בקועה אסורה התרנגולת ואם נמצאת חיטה בקועה או לחם חמץ בכלי של מים ואין בו כדי ליתן טעם שהמים צוננים ובישלו באותו מים תבשיל או לשו עיסה מותר ויש מי שאוסר אם הוא בתוך הפסח: הגה ויש מי שמתיר אפי' במליגת תרנגולים משום דאמרינן שמא אחר כך נפלה לשם (תא"ו נ"ה מח"ו ומהרי"ב) ויש מי שאוסר בשאר בשר ומתיר בתרנגולת מכח ספק ספיקא (מרדכי פרק כל שעה) ולענין מנהג נראה לאסור בשאר בשר או בחטה שלימה אפי' תרנגולת ודוקא אם נמלגו תרנגולים דהיינו שהיו המים חמין אבל אם היו צוננים ושרו שם התרנגולים אין לאסור מספיקא ובמקום דאיכא למימר שמא נתעכלה החטה בתרנגולת כגון שהיא שבורה (מהרי"ב) אפי' במליגה יש להתיר מכח ספק ספיקא מיהו אם נתערבו התערובות ויש הפסד מרובה ומניעת שמחת יום טוב יש להקל בכל זה בספיקת איסור דרבנן שהוא משהו ויש להתיר שאר תבשילין שיש בהן תערובת מאותו תבשיל של הבשר שנשרה במים או נמלג כך נראה לי:
אם הגעילו יורה מחומצת בת יומא וירדו המים (המחומצים) לבור בתוך הפסח אסור לשתות מימיו בפסח בשביל שנתערבו:
אם נמצאת חטה מבוקעת בתרנגלת קודם מליחה די בשטיפה ואם אחר מליחה די בקליפה ויש מחמירים לומר שמעמיק כל סביבותיה וחותך ומשליך ואם נמלחו עמה תרנגולו' אחרות קולף את כולם: הגה ויש מחמירים לאסור כל מה שימלח ביחד אבל העיקר לאסור אותה חתיכה כולה שנמצא החטה עליה ולהתיר האחרות ע"י קליפה קצת ואם רוצה יוכל למכור הכל לעכו"ם כמו שנתבאר סי' תמ"ז סעיף א' אע"ג דאין נוהגין כן בשאר תערובות חמץ כן נ"ל:
תרנגולת צלויה שנמצאת בה חטה מבוקעת בתוך הפסח חותך מקום פיעפועו לפי אומד הדעת ויש אוסרים את כולה לפי שכשמהפכים השפוד מתפשט הטעם בכל התרנגולת וכן יש מי שאוסר כל התרנגולות הצלויות עמה באותה שפוד הנוגעות זו בזו כי ע"י היפוך השפוד מתפשט מזו לזו:
חטה או שעורה שנמצאת בזפק העוף לאחר שהבהבו אותו העוף מותר והחטה והשעור' צריך לשרפם דלא חשיבי כמעוכלים:
