1. 1A Non-Jew who has a window opening to an alleyway. Containing 1 paragraph. A non-Jew who lives in an alleyway and has a back window of his house opening to a field or yard—even if it is only four by four handbreadths—does not prohibit the residents of the alleyway [from carrying], even if he brings in and takes out camels and wagons through the alleyway all day long. For he prefers the opening in back that is open to him alone, which has air, and his opening to the alleyway is as if he does not regularly use it, so he does not prohibit. This applies when the field or yard is more than two se'ah in area. But if it is only two se'ah, it is small and he is not satisfied with it. A Jew who has an opening to an alleyway and a back opening to a yard, and he forgot and did not make an eruv: if the yard is more than two se'ah, he prohibits, since it is not suitable for him and he does not withdraw from the alleyway. But if it was enclosed for dwelling, even if it is more than two se'ah, he does not prohibit, since it is suitable for him. And there are those who say that on the contrary: if it was enclosed for dwelling, even if it is two se'ah, he prohibits, since when it is enclosed for dwelling it has no air and he does not want to withdraw from the alleyway on its account.
