Shulchan Arukh Even HaEzer 54 — English translation

- 1One who ordered that [his executor] give his daughter some sum of money for her sustenance, to purchase land, whether he is on his death bed or he is well, and he then died, and the money is with a third party, and the daughter says, "Give the money to my husband who may then with it as he wishes." If the daughter is an adult, and she is married, she has full authority to do as she likes. If she is still betrothed, the third party should follow his instructions. If she is still a child, even if she is marries, we so not listen to her and the third party must follow the father's orders. Rem"a: Some authorities say that the third party must have been explicitly delegated for this purpose, see (Shulchan Arukh, Choshen Mishpat 292).

מי שצוה לתת לבתו כך וכך מעות לפרנסתה ליקח בהם קרקע בין שהיה שכיב מרע בין שהיה בריא ומת והרי המעות ביד השליש ואמרה הבת תנו אותם לבעלי כל מה שירצה יעשה בהם אם היתה גדולה ונשאת הרשות בידה ואם עדיין מאורסה היא יעשה שליש מה שהושלש בידו ואם עדיין קטנה היא אפי' נשאת אין שומעין לה אלא יעשה שליש כמו שצוה האב (וי"א דבעינן שהושלש מתחלה לכך וע' בח"ה סי' רצ"ב):
