    1. 1A Document That Says “I Borrowed a Maneh From You”, 1 Seif: If a document with witnesses states, “I so and so borrowed a maneh from you,” whomever produces this document may collect the maneh. If, however, the document does not have witnesses but was written with the borrower’s handwriting, the borrower is believed to say he did not borrow from the document-holder but from someone else who dropped it and the document-owner simply found it because the borrower would have been believed to say he paid it back. RAMA: The same applies to a court ruling that states that a person is obligated to pay his adversary and he would be required to pay the individual that produces the ruling. (Mordechai; Piskei Raknati; Teshuvos Maharam) The same applies to a document that states that so-and-so owes money to so-and-so or to whomever produces the document and the borrower would be obligated to pay whomever produces it. This only applies if the person producing the document is making his claim via the so-and-so, unless the document explicitly stated that there is no distinction whether the person is claiming via so-and-so or not. (R"i) If a receipt was written on any person with respect to this document, no person may subsequently collect with the document. (Nimukei Yosef in the name of the R"am and the Ritva) If a document states that a person is obligating himself to anyone who produces this document against him, he is obligated to pay the person who produces it, even if it was known that he never owed him anything, because he obligated himself (Teshuvos HaRosh, Klal 68, Siman 9 and 11) as was explained above in Siman 40.     שטר בעדים שכתוב בו אני פלוני לויתי ממך מנה כל המוציאו גובה בו אבל אם אין בו עדים אלא שהוא כתב ידו מתוך שנאמן לומר פרעתי נאמן לומר לא לויתי ממך אלא מאחר ונפל ממנו ומצאתו: הגה וה"ה פסק דין שכתוב בו פלוני נתחייב לכנגדו חייב לשלם למי שמוציאו (מרדכי פרק ג"פ ופסקי רקנטי סי' תל"ז ותשו' מהר"ם ד"פ סי' תקכ"א וכן שטר שכתוב בו פלוני חייב לפלוני או לכל מי שמוציאו חייב לשלם לכל מי שמוציאו ודוקא שבא מחמת אותו פ' אא"כ כתוב בפירוש בין בא מחמתו או שלא מחמתו (ר"י נ"ו ח"ה) ואם נכתב שובר משום אדם על שטר זה אח"כ שום אדם לא יוכל לגבות בו (נ"י פרק ג"פ בשם הר"מ והריטב"א) ואם כתב בשטר שמשעבד עצמו נגד המוציא שטר חוב זה עליו אע"ג שידוע שלא היה חייב לו מעולם מ"מ חייב לשלם לו דהרי מ"מ נשתעבד נגדו (תשו' הרא"ש כלל ס"ח סי' ט' וי"א) וכמו שנתבאר לעיל סי' מ' וע' לקמן סי' ס"א ס"י:
