שמין השוורים לניזק ואם פיחתו או הותירו. ובו ג סעיפים:
שמין השוורים בנזיקי' אם שבר כלי הוא או בהמתו א"א יתן לו כלי שלם ויקח השברים אלא שמין כמה נפחתו דמיו בשביל השביר' ויקח הניזק השברי' והמזיק ישלים עליהם:
פחת הנביל' לניזק ושבח הנביל' חולקים אותו המזיק והניזק כיצד שור שוה מאתים שנגחוהו ומת והרי הנביל' שוה בשעת מיתה מאה ובשעת העמד' בדין פחת' והרי שוה פ' אין המזיק משלם אלא ק' ואם היה תם משל' לו נ' מגופו (נ"י) (ודוקא שנודע לניזק בשעת מיתה אבל אם לא נודע לו הפחת על המזיק עד שיוודע לניזק וי"א דה"ה אם הוזלה (טור ס"ח) ויש חולקין דבזולא אע"ג דלא נודע ליה הוי של ניזק) (נ"י פ' הנ"ל) השביח' הנביל' והרי היא שוה בשעת העמד' בדין ק"כ הרי המזיק משלם תשעים ואם היה תם משלם מ"ה מגופו וזהו וגם את המת יחצון: הגה מיהו אם השביחה כל כך שחצי שבח הוא יותר מדמי ההיזק לא אמרינן דהמזיק יטול חצי השבח וירויח (טור):
על המזיק לטרוח בנביל' עד שממציא אותו לניזק כיצד כגון שנפל השור לבור ומת מעלה הנביל' מהבור ונותנ' לניזק ואח"כ שמין לו פחת נביל' שנאמר כסף ישיב לבעליו והמת יהי' לו מלמד שהוא חייב להשיב את הנביל' ואת הפחת שפחת' מן החי לניזק ואם היה תם חצי הפחת:
