ב' שוורים שחבלו זה בזה והן תמים או מועדים. ובו סעיף אחד:
ב' שוורים תמים שחבלו זה בזה משלמים במותר חצי נזק כגון אם אחד הזיק בחבירו שוה ק' והשני הזיק שוה נ' יצאו חמשים בחמשים והנ' הנותרי' ישלם לו חצים ואפי' נאבד האחד ודוקא ששוה כל אחד דמי נזקו אבל אם אינו שוה כ"כ אינו מנכה לו רק מה שיוכל לגבות מגופו (נ"י שם) ואם שניהם מועדים משלמים במותר נזק שלם ואם היה אחד תם ואחד מועד מועד בתם שהזיק המועד לתם יותר ממה שהזיקו ישלם במותר נזק שלם כגון אם הזיק מועד בתם מאה והתם לא הזיקו אלא נ' משלם לו ע"ה תם במועד ישלם לו חצי נזק כגון שהזיק תם במועד ק' והמועד לא הזיקו אלא כ"ה משלם לו כ"ה: הגה י"א דכל זה מיירי דוקא שהתחילו בבת אחת או לאחר שנפרדו זה מזה חזר השני וחבל בראשון אבל אם א' התחיל המתחיל משלם והשני פטור דכל המשנה ובא אחר ושינה (בו) פטור (טור בשם הרא"ש) וכן הוא לקמן סי' תכ"א סעיף י"ג לענין שני אנשים שחבלו זה בזה והמחבר שפסק כאן כמי שחולק וס"ל שאין לחלק ולקמן פסק כמו שכתבתי לא כוון יפה:
