שור שנגח וחזר ונגח ואם תפס ניזק וחזר ונגח. ובו ב סעיפים:
שור שנגח וחזר ונגח שור אחר הרי הניזק הראשון והבעלים כשותפים בו כיצד שור שוה ק"ק שנגח שור שוה ק"ק ואין הנביל' יפה כלום הניזק נוטל ק' ובעל השור ק' חזר ונגח שור אחד שוה ק"ק ואין הנבילה יפה כלום האחרון נוטל מאה והניזק שלפניו עם הבעלים נוטלים נ' נ' זוז חזר ונגח שור שוה מאתים ואין הנביל' יפה כלום האחרון נוטל מאה והניזק שלפניו חמשים והניזק הראשון עם הבעלים כ"ה כ"ה וכן על דרך זה חולקים והולכים:
ניזק שתפס בהמה שהזיק' לגבות חצי נזקו מגופ' נעשה עלי' שומר שכר לנזקים ואם יצאת והזיקה הניזק הראשון חייב בנזקי' והבעלים פטורים כיצד שור שוה ק"ק שנגח והפסיד ה"ק ותפסו הניזק לגבות ממנו ק' וחזר ונגח והפסיד ק"מ הרי הניזק האחרון משתלם ע' והניזק הראשון שתפסו משתלם מותר נזקו והוא ל' והבעלים ק' וכן כל כיוצא בזה: הגה וי"א דאין חילוק בין אם תפסו או לא תפסו בכל ענין הניזק אינו מפסיד אלא חצי והבעלים חצי (טור בשם ר"י והרא"ש):
