דין המציל או הקונה מלסטים ישראל או עכו"ם. ובו סעיף אחד:
(ע"ל סי' שפ"א ס"ג) המציל מיד לסטים ישראל הרי אלו שלו מפני שסתם הדבר שנתיאשו הבעלי' ואם ידע שלא נתייאשו חייב להחזיר אבל המציל מיד לסטים עכו"ם או מוכס עכו"ם חייב להחזיר שסתם הדבר שלא נתיאשו הבעלים ואם נתייאשו הרי אלו שלו ומפני מה אמרו סתם לסטים ישראל נתייאשו הבעלים וסתם עכו"ם לא נתייאשו מפני שהבעלים יודעים שעכו"ם מחזירין מיד הגזלן אע"פ שאין שם עדים שגזל אלא בראיות רעועות ובאומד הדעת: הגה וסתם גניבה הוי יאוש אפי' בעכו"ם וא"כ הקונה מן הגנב לא היה צריך להחזיר הגניבה אא"כ ידעינן דלא נתיאש דהא קנאה ביאוש ושינוי רשות כמו שנתבאר לעיל סי' שנ"ג מיהו נהגו להחזיר כל גניבה (ת"ה סי' ש"ט) ואין לשנות מן המנהג (טור) וכמו שנתבאר לעיל סי' שנ"ו ואין חילוק בזה בין גנב לגזלן דבכל ענין מחזיר דמיו ונוטל את שלו כן נראה לי וע"ל סי' רל"ו הקונה קרקע גזולה:
