אין השואל רשאי להשאיל. ובו סעיף אחד:
אין השואל רשאי להשאיל אפי' שאל ספר תורה שעושה מצוה בשאלתו אינו רשאי להשאיל לאחרים ואם השאיל לאחרים אפי' נתקלקל מחמת המלאכ' ששאלו בשביל' חייב אא"כ יש לו ראיה שיכול ליפטר בה אילו היה בידו כמו שנתבאר בסי' רצ"א סעיף כ"ו: הגה מיהו דבר שא"א להבריח ולכפור בו כגון בית או ספינה מותר להשאיל (תשובות רשב"א אלף נ"ג ואלף קמ"ה) וע"ל סי' שי"ו:
