מתנה שכתוב בה לאחר מיתה אם יש בו זמן. ובו ב סעיפים:
שטר מתנה שכתוב בו שיקנה פלוני שדה פלונית לאחד מיתה בין שהיה בשטר קנין בין שלא היה בו קנין כיון שכתוב בו זמן ובזמן הזה חי היה הזמן מוכיח שמחיים הקנה לו (ולא שאינו) [ואינו ] זוכה אלא לאחר מיתה שאילו היה בדעתו להקנות לו בשטר זה לאחר מיתה לא היה כותב בו זמן לפיכך אע"פ שאין כתוב בו מהיום ולאחר מיתה קונה לאחר מיתה (והוי כאילו כתב לו מהיום ולאחר מיתה שנתבאר דינו סי' רנ"ז) וזה שכותבים בכל המתנות והממכרות מעכשיו אע"פ שיש בשטר זמן להרויח הדבר (כותבין) כן אע"פ שאינו צריך:
וכן אם יש בו קנין קונה הגוף מיד אפילו אין בו זמן: הגה דכל קנין מעכשיו הוא והא דאמרי' זמנו של שטר מוכיח עליו היינו בכותב לו לאחר מיתה אבל בכותב לו לאחר שלשים יום אין אומרים זמן של שטר מוכיח עליו ולכן אם מת נותן או המקבל תוך ל' בטלה המתנה והוא הדין דנותן יכול לחזור תוך ל' (טור בשם הרמ"ה) והא דאמרינן זמנו של שטר מוכיח עליו היינו שצוה הנותן לכתוב זמן או שצוה לעדים לעשות שטר מעליא אבל צואה שלא נכתב בה זמן רק לזכרון בעלמא אין אומרים זמנו של שטר מוכיח עליו (ב"י בשם רשב"א ותשו' רמב"ן סי' ו' ומהרי"ק שורש צ"ד) וי"א דלאו דוקא זמנו של שטר אלא בעל פה נמי הזמן מוכיח (הר"ן ס"פ מי שאחזו):
