דין כשאמכור אמכור לך במאה ומכר לאחר ביותר או שאמר אמכרנה לך כמו שישומו אותו ב"ד. ובו ד סעיפים:
האומר לחבירו כשאמכור שדה זו הרי היא מכורה לך מעכשיו במנה וקנה מידו על כך ולאחר זמן מכרה לאחר במאה קנה הראשון (לא הזכיר סכום רק א"ל כשאמכרנה אמכור לך (לא קנה הראשון) (טור) וכן אם) מכרה ביותר על מנה קנה האחרון שלא א"ל אלא כשאמכור שיהיה מוכר מדעתו כבתחלה וזה לא היה רוצה למכור ולא מכר אלא מפני התוספות שהוסיף זה ונמצא כמי שנאנס ומכר: הגה וכל זה מיירי שאמר בלשון כשאמכור אמכור לך וכו' אבל אמר לא תמכור אלא לי (מהרי"ק שורש כ') או שהתנה בפירוש שאף אם יתנו לו יותר ממה שקצב ימכור לו תנאו קיים (הגהות מרדכי פ' איזהו נשך והמגיד פ"ח דמכירה):
א"ל כשאמכרנה הרי היא קנויה לך מעכשיו כמו שישומו ב"ד של ג' אפי' ע"פ שנים מהשלש' א"ל כמו שיאמרו שלשה עד שיאמרו הג':
וכן אם אמר כמו שישומו אותה ב"ד ארבעה עד שישומו הארבעה כולם ויסכימו וימכור לאחר כמו שיסכימו ואח"כ קנה הראשון:
שמו אותה שלשה או ארבעה ואמר המוכר עד שיבואו ג' אחרים או ד' וישומו אין שומעין לו שהרי קנו מידו תחלה שמכר מעכשיו: הגה אבל לא מכר מעכשיו אע"פ שקנו מידו שכשימכור יהא מוכר לו לא קנה דהוי קנין דברים כמו שנתבאר לעיל סי' ר"ג ועוד דהוי אסמכתא כמו שנתבאר בסי' ר"ז:
