- 1A non-Jew cannot become an agent for anything in the world, so too, a Jew cannot become an agent for a non-Jew for anything.

אין שליחות לעכו"ם ויש שליחות לעבד ואשה. ובו ו סעיפים:
אין העכו"ם נעשה שליח לדבר מהדברים שבעולם וכן אין ישראל נעשה שליח לעכו"ם לדבר מהדברים:
עושה אדם שליח איש או אשה ואפי' אשת איש ואפי' עבד ושפחה הואיל והם בני דעת וישנם במקצת מצות נעשים שלוחים למשא ומתן אבל מי שאינם בני דעת והם חרש שוטה וקטן אינם נעשים שלוחים ולא עושים שליח אחד הקטן ואחד הקטנה לפיכך השולח בנו קטן אצל החנוני (ונתן בידו פונדיון שהוא שני איסרין ונתנו לחנוני) ומדד לו באיסר שמן ונתן לו את האיסר ואבד את השמן ואת האיסר החנוני חייב לשלם שלא שלחו אלא להודיעו ולא היה לו לשלח אלא עם בן דעת וכן כל כיוצא בזה: הגה ועל הצלוחית שנתן המשלח ליד הקטן ומדד החנוני לתוכו אם שברו הקטן החנוני פטור אא"כ לקחו מידו ומדד לאחרים והחזירו לידו (טור) ואם פירש ואמר שלח לי עם הקטן ה"ז פטור:
האומר לחבירו מנה שיש לי בידך בין מלוה בין פקדון שלחהו לי ביד פלוני אפי' היה קטן אם רצה לשלחו בידו נפטר ואינו חייב באחריותו :
השולח לחבירו לשלוח לו ע"י שליח מעות שהיו לו בידו מלוה או פקדון נתבאר בסי' קכ"א:
כל היכא שהשליח משנה מדעת המשלח בטל השליחות מכל וכל:
מי שהגיע לו היזק בממונו מחמת שליחות שולחו או שהעלילו עליו מחמת השליחות והפסידוהו ממון אין המשלח חייב לשלם לו נזקו (ועיין לעיל סי' קע"ו סעיף מ"ח):
