הלוקח כלים מן האומן למכור. ובו ב סעיפים:
הלוקח כלים מבית האומן לשגרן לבית חמיו ואמר לו אם מקבלים אותן ממני אתן לך דמיהם ואם לאו אתן לך שכר מועט ונאנסו בהליכה חייב ואם נאנסו בחזרה פטור אבל אם נגנבו או אבדו חייב:
נטלם ע"מ למכרם וא"ל אם ימכרו במקום פלוני או עד זמן פלוני אתן לך דמים כך וכך ואם לא ימכרו אחזירם לך ונאנסו בין בהליכה בין בחזרה חייב לשלם וי"א דהני מילי בדבר שיש לו קונים הרבה ויכול למכרו מיד בדמים שקצב אלא שמחזיר למכרו ביותר כדי שישתכר בו דאל"כ פטור מאונסים ואינו חייב אלא בגניבה ואבידה כדין סרסור: הגה ואם קצב לו דמים ואמר לו כל הריוח מזה נחלוק בינינו אין לו אלא דין סרסור ואינו חייב באונסים (ב"י) :
