שיירא שעמד עליהם גייס והציל א' מהם. ובו ג סעיפים:
שיירא שהיתה הולכת במדבר ועמד עליה גייס וטרפה אם אינם יכולים להציל מידם ועמד א' מהם והציל הציל לעצמו ואם יכולים הם להציל וקדם אחד מהם והציל אע"פ שאמר לעצמי אני מציל הציל לאמצע ויטול כל א' מהם שלו היו יכולים להציל ע"י הדחק כל המציל מציל לאמצע אלא א"כ אמר לעצמי אני מציל שאם אמר כן הרי זה מציל לעצמו שכיון ששמעו שהוא אומר לעצמי אני מציל היה להם לדחוק עצמם ולהציל וכיון שישבו ולא הצילו הרי נתייאשו מן הכל:
היו שני שותפים והציל אחד מהם הציל לאמצע ואם אמר לעצמי אני מציל הרי זה חלק מחבירו והציל לעצמו: הגה כל מה שהגיע לחלקו אבל אם הציל יותר הוא שלהם ודוקא שהם יכולים להציל אבל אם אינן יכולין להציל הכל שלו (טור) וע"ל סימן קע"ו סכ"ח ואם אמר שאמר שהציל לעצמו ואין לו עדים נשבע על כך ומחזיק לעצמו (מרדכי פרק הגוזל בתרא בשם ראבי"ה):
וכן השוכר את הפועל להציל כל שיציל הרי הוא למשכיר ואם אמר לעצמי אני מציל ה"ז חוזר בו מהשכירות וכל שיציל אחר שאמר לי הרי הוא שלו:
