מי שלקט פירותיו של חבירו. ובו ג סעיפים:
היורד לתוך שדה חבירו ולקט פירותיו בעל השדה טוען שבגזל לקחם וזה אומר שמכרם לו נאמן בשבועת היסת אפילו אם יש עדים שליקטן:
אם אין בעל השדה והאילן כאן ואמר א' אלך ואלקוט פירות האילן והשדה של פלוני שמכרם לי אין ב"ד צריכין למנעו ואם באו הבעלים קודם שליקטם מעכבים על ידו ואפילו אם ליקטם כבר אם טוען שמכר לו גוף השדה אינו נאמן אף על הפירות שאכל כיון שאין לו שטר ולא חזקת ג' שנים:
האומר אלך ואכרות אילנות של פלוני ב"ד מוחין בידו:
