    <b>על מי מחללין שבת. ובו ט סעיפים:</b><br>כל פיקוח נפש דוחה שבת והזריז הרי זה משובח אפילו נפלה דליקה בחצר אחרת וירא שתעבור לחצר זו ויבא לידי סכנה מכבין כדי שלא תעבור:

    When to violate Shabbos. Contains 9 sections All cases of saving a life supersede Shabbat, and he who hurries in these matters is praised. Even if there is a fire in a different yard and there is concern that it will move to this yard and cause danger, we put it out to ensure that it does not spread.

    אין הולכין בפיקוח נפש אחר הרוב אפילו היו ט' עכו"ם וישראל א' בחצר ופירש א' מהם לחצר אחרת ונפל עליו שם מפולת מפקחין כיון שנשאר קביעות הראשון במקומו חשבינן ליה כמחצה על מחצה אבל אם נעקרו כולם ובשעת עקירתן פירש א' מהם לחצר אחרת ונפל עליו אין מפקחין עליו שכיון שנעקר קביעות הראשון ממקומו אמרינן כל דפריש מרובה פריש:

    Life-threatening cases do not go by the majority. Even if there are nine idolaters and one Jew in a yard, and one leaves to a different yard where there is an avalanche, the debris is removed, because the first group is still stationery and is considered half and half. However, if they have all left, and while they were leaving, one goes to another yard where there is an avalanche, the debris is not removed, because the first group is no longer stationery, so we say that whoever left the group is associated with the majority.

    מי שנפלה עליו מפולת ספק חי ספק מת ספק הוא שם ספק אינו שם אפילו אם תמצ' לומר שהו' שם ספק עכו"ם ספק ישראל מפקחין עליו אע"פ שיש בו כמה ספיקות:

    Someone who experiences an avalanche, if he may be alive and may be dead, if he may be there or may not be there, even if he is for sure there but he may be Jewish or may be an idolater, we remove the debris, even though there are many degrees of doubt.

    אפי' מצאוהו מרוצץ שאינו יכול לחיות אלא לפי שעה מפקחים ובודקים עד חוטמו אם לא הרגישו בחוטמו חיות אז ודאי מת לא שנא פגעו בראשו תחלה לא שנא פגעו ברגליו תחילה:

    Even if they find him trampled and he can only live a few hours, they check his nose, and if they feel no life, he is for sure dead. [They must do this] whether they uncover his nose or his legs first.

    מצא עליונים מתים לא יאמר כבר מתו תחתונים אלא מפקח עליהם שמא עדיין הם חיים:

    If, [while digging through the debris], the top bodies are found to be dead, they should not assume that the bottom ones are also dead. Rather, they should uncover them in case they are still alive.

    עכו"ם שצרו על עיירות ישראל אם באו על עסק ממון אין מחללין עליהם את השבת באו על עסק נפשות ואפי' סתם יוצאים עליהם בכלי זיין ומחללים עליהם את השבת ובעיר הסמוכה לספר אפילו לא באו אלא על עסקי תבן וקש מחללין עליהם את השבת: הגה ואפילו לא באו עדיין אלא רוצים לבא [א"ז]:

    Regarding non-Jews who besiege Jewish cities: if they come for money, we do not desecrate the Shabbat [to protect ourselves], but if they came to kill or come with no presented reason, we go out with weapons and desecrate the Shabbat. In a city that is near the border, even if they just come for straw or hay, we desecrate the Shabbat. Rem"a: Even if they haven't come but they want to come (Or Zarua).

    יש מי שאומר שבזמן הזה אפי' באו על עסקי ממון מחללין שאם לא יניחנו ישראל לשלול ולבוז ממונו יהרגנו והוי עסקי נפשות [ומ"מ הכל לפי הענין] (פסקי מהרי"א סי' ק"כ):

    There is one who says that in our times, even if they come for money, we desecrate the Shabbat, because if we do not allow them to plunder the money, they will kill, and so it becomes a case of saving life. (In any event, everything is according to the situation(Piskei Mahara'i Chapter 156).)

    הרואה ספינה שיש בה ישראל המטורפת בים וכן נהר שוטף וכן יחיד הנרדף מפני עכו"ם מצוה על כל אדם לחלל עליהם שבת כדי להצילם: [וע"ל סוף סימן ש"ז מי שרוצים לאנסו אם מחללים עליו שבת]:

    One who sees a boat with Jews that is endangered at sea or in a flowing river, or an individual being chased by idolaters, it is a commandment to desecrate Shabbat to save them. (And see above at the end of chapter 306 regarding whether one desecrates Shabbat if someone wants to rape him.)

    כל היוצאים להציל חוזרים בכלי זיינם למקומם:

    All who go out to save may return with their weapons.
