<b>הכותל והאילן שהיו רעועים ונפלו והזיקו. ובו סעיף אחד:</b><br>הכותל והאילן שנפלו לרשות הרבים והזיקו פטור מלשלם אע"פ שהפקירם לפי שאינם דומים לבור שהרי אין תחילתן להזיק (וי"א דאם היה לו פנאי לסלקן ולא הפקירן חייב) (טור ס"א) ואם היו רעועין ב"ד קובעין לו זמן ודוקא שהתרו בו ב"ד אבל בלא ב"ד אע"פ שהתרו בו חביריו אינו כלום מיהו אם חפר בכותל וגרם להפילו חייב בניזקין דהוה ליה חציו ממש (ב"י בשם רשב"א) לקוץ את האילן ולסתור את הכותל וכמה הזמן ל' יום (ואם הדבר נחוץ ויש לחוש שיזיק לאחרים אין נותנין לו זמן רק כופין אותו לסלק היזיקו מיד) (ב"י בשם ריטב"א) נפלו בתוך הזמן פטור לאחר הזמן חייב מפני שהשהה אותם: הגה וכ"ז כשבנאה מתחילתו כראוי אבל אם לא בנאה כראוי ומחמת זה נפל הכותל חייב בנזקה (תוס' המגיד פי"ג דנזקי ממון וב"י בשם רבי' ירוחם נל"א ח"א):
