<b>דין המשכיר בית על תנאי. ובו ד סעיפים:</b><br>שכירות קרקע נשכר בדרכים שהוא נקנה בהם (ואין אונאה לשכירות קרקע כמו במכירת קרקע (הרא"ש כלל א' סי' ז'):
כשם שמתנה אדם כל תנאי שירצה במקח כך מתנה בשכירות וכל שממכרו ממכר בנכסיו שכירותו שכירות וכל שאין לו למכור אין לו להשכיר אלא אם כן יש לו פירות בלבד באותו קרקע שזה שוכר ואינו מוכר:
השוכר בית מחבירו וטוען ששכרו על תנאי שיכניס עמו דיורין אחרים והמשכיר מכחישו ישבע המשכיר שלא התנה כן והוא הדין לכל טענות שביניהם (ועיין לעיל סי' שי"ב סעיף ט"ז ולקמן סי' שט"ז סעיף ב'):
ראובן שכר נער לשמשו ואמר לו שמעון לסמוך עליו לשלם לו כל מה שיפסיד בהיות הנער בביתו אע"פ שלא היה קנין בדבר חייב כי כל תנאי שכירות אינו צריך קנין :
