עכו"ם שמכר שדה לישראל וקבל הדמים ולא כתב לו השטר הרי הוא כהפקר וכל הקודם בהם זכה ונתבאר בסימן קצ"ד: הגה עשרה תנאים התנה יהושע בארץ וכולן נוהגות אף בחוץ לארץ וכתבן הרמב"ם פ"ה דהלכות נזקי ממון והטור סי' רע"ד א' ולא ידעתי למה השמיטן המחבר הזה ואולי משום שאינן שכיחין שרובם אינן רק במקום שיש לישראל שדות וכרמים וזה אינו שכיח בגלות והרוצה לעמוד על דיניהן יעיין בפנים מי שהיה לו נחיל של דבורים ויצאו וישבו על אילן של חבירו י"א דיכול לקוץ ענף כדי להציל נחילו ונותן דמי ענף לבעל האילן (טור בשם אביו הרא"ש) ויש חולקין (שם בשם הרי"ף והרמ"ה):
