<b>מוכר שאמר במאתי' ולוקח אומר במנה. ובו סעיף אחד:</b><br>המבקש לקנות מחבירו מקח מוכר אומר במאתים אני מוכר לך והלוקח אומר איני לוקח אלא במנה והלך זה לביתו וזה לביתו ואח"כ נתקבצו ומשך זה החפץ סתם אם המוכר הוא שתבע הלוקח ונתן לו החפץ אינו נותן אלא מנה ואם הלוקח הוא שבא ומשך החפץ סתם חייב ליתן ק"ק: הגה היה בתחילה קציצה ביניהן וחזר אחד וחזרו ומשכו סתם אמרינן ודאי על קציצה הראשונה קנו (נ"י פרק האומנין):
