<b>פירות כוורת ופירות שובך באיזה ענין קנה. ובו ב סעיפים:</b><br>המוכר פירות שובך או פירות כוורת לחבירו קנה ואין זה מוכר דשלב"ל לפי שאינו מוכר יונים שיולדו או דבש שיבוא לכוורת אלא הוא מוכר שובך לפירותיו או כוורת לדבשה שהרי הוא כמוכר אמת המים לחבירו שהוא נהנה בכל מה שיצוד בה כך זה הקנה שובך זה לפירותיו כמו שמוכר אילן לפירותיו:
הביצים והאפרוחים עצמם שיש בשובך לא קנה אותם בעל השובך כ"ז שלא פרחו ודבר זה תקנת חכמים הוא ומשום לא תקח האם על הבנים נגעו בה לפיכך הרוצה להקנות אפרוחים וביצים אלו לחבירו מטפח (פי' מכה בידו) על השובך עד שיפרחו האמהות ויגבהו מעל הארץ ואח"כ יקנה אותם לחבירו בא' מדרכי הקנאות המטלטלין:
