    <b>הקונה שדה על שם אחר ואחר כך אומר שהוא לעצמו (ודין שליח שמנה לג' ביחד). ובו ב סעיפים:</b><br>ג' שנתנו מעות לאחד לקנות להם מקח אם היו המעות מעורבים וקנה במקצת הדמים אע"פ שהיתה כוונת השליח שזה שקנה לא' מהם הרי המקח של כולם וחולקים אותו לפי מעותיהם: הגה מיהו אם פירש בהדיא שקנה לאחד מהן הרי חזר משליחות האחרים וזכה זה שקנה לו (טור בשם ר' ישעיה) היו מעות של כל א' מהם צרורים וחתומים אע"פ שהיה בלב השליח הזה שיקנה המקח לכלם לא קנה אלא זה שקנה המקח במעותיו בלבד:

    ראובן שקנה שדה משמעון ואמר ליה ללוי קניתי אותה וכתב שטר מכר בשם לוי וחזר ראובן ואמר לשמעון לעצמי קניתיה חזור וכתוב שטר מכר בשמי אין כופין את המוכר לכתוב לו שטר אחר בשם ראובן ואם התנה עמו מתחלה ואמר ליה לעצמי אני קונה וזה שאכתוב שטר בשם לוי כדי שלא ידעו בי שאני הוא הקונה הרי זה כופהו לכתוב שטר אחר בשמו ולא עוד אלא אפי' לא אמר כן למוכר אלא שאמר לעדים תחלה בפני המוכר יש לכם לכתוב לי שטר אחר על שמי כופין אותו לכתוב שטר אחר על שמו: הגה ואם קנה קרקע תחלה על שם לוי אע"פ שלוי לא עשהו שליח אם קנה במעות לוי לא יוכל לחזור בו (הגהות מרדכי פ"ד דמציעא):
