<b>שותפין אין להם חזקה זה על זה. ובו סעיף אחד:</b><br>דבר הידוע שהוא משל השותפות אין לא' חזקה בו על חבירו ואפי' נשתהה בידו זמן רב אינו יכול לומר שלקחו ממנו או שנתנו לו במתנה אלא בראייה ולא מיבעיא במילת' דידיע לתרווייהו שוה בשוה אלא אפי' חזי דהאי אייתי זוזי והאי אייתי זוזי וזבני בהו עיסקא ולא ידיע כמה אייתי כל חד ובתר הכי נפיק האי עיסקא מידא דחד ואמר תרי תילתא דידי ותילתא דחבראי לא מהימן אלא פלגי ליה בשוה והוא דלא מצי למטען להד"ם או החזרתיו לך כגון דחזו ליה סהדי תחות ידיה וידעו דהא עיסקא דזבנו תרווייהו: הגה ודוקא קודם שחלקו אבל לאחר שחלקו יש להן חזקה זה על זה (ב"י בשם הרי"ף וכן משמע מדברי הרמב"ם פ"ה משותפים וע' לעיל סי' קמ"ט):
