<b>שותף שבקש מהמוכס שימחול לו. ובו ג סעיפים:</b><br>שותפים שבקש אחד מהם מהמוכס שימחול לו ומחל לו הוא לאמצע כאלו הוא שלוחם לבקש בשביל כלם ואם מעצמו בלא פיוס אמר אני מוחל בשביל פלוני הוא שלו לבדו:
מי שפטרו המלך מכל מסים וארנוניות אע"פ כן חייבי' לפרוע במה שהוציאו הצבור בצרכי הצבור ובשמירתן (וע' לעיל סי' קס"ג):
שותף שירד לתוך שדה המשותף ועבדה חשוב כיורד ברשות ונוטל כדין אריסי העיר אפי' בקמה העומדת לקצור ואפילו בשדה שאינה עשויה ליטע והוא הדין אם מתעסק בלא רשות בדבר המטלטל המשותף: הגה ואין השותף נוטל הוצאה רק כפי השבח שמשביח ואם לא השביח כלום אינו נוטל כלום (נ"י פ' חזקת הבתים ומרדכי פרק הגוזל בתרא) ואם מיחה השותף השני שלא לעשות כגון שבנה בנין והוא מוחה בו אם הוא דבר שא"א מלבנות צריך חבירו ליתן לו חלקו ואם אינו צריך לבנות יכול חבירו לומר לו טול עציך ואבניך.
