Does one deduce the possible from the impossible? The (three scenarios) offspring of a sin offering, and the exchange of a sin offering, and a sin offering whose owner has died, are not possible when it comes to a communal offering, yet we say that a comparison is made (to apply the same law from these non-existent situations to the 2 cases which are possible).
That is not a difficulty, that we cannot deduce the possible from the impossible, because R. Shimon in one instance does learn it, for when Israel were instructed regarding 4 (cases) of sin offerings, in one instance he learnt that the Sinatic law given to Moishe should apply (the one law should apply to all 4 situations) either to an individual or to a communal (offerings), and R. Shimon inferred if you think that we that we are discussing communal sacrifices, can they all apply to communal offerings? Rather we can deduce it must be with regard to individual sacrifices that it (the law) was stated and not to the communal ones. For just as death of the owner, and an the offspring of the sin offering, and an exchange of a sin offering cannot apply to a communal offering so the (issues) of a sin offering where there already had been an atonement (in a situation when the original animal had got lost, been replaced, and the original subsequently found) and when the animal was (too old)

מזיד ועשה שוגג תימה היכא הוי שוגג בלא הוראה אי אכיל בשתיקה ולא מיקרי הוראה הא מאחר שאינו מורה לאחרים כי אם לעצמו מה לי בשתיקה מה לי בדיבור:
(אין) [כהוראת] בית דין כו' כמה עניינים שונה הכא מה שכבר שנה בפרק קמא אלא משום דאתי לפרושי רישא אמאי שוה להוראת צבור לענין שוגג ועשה כו' משום דשוו פר כהן משיח וצבור להדדי:
שוגג ועשה שוגג פשיטא לעיל בפ"ק (הוריות ד:) דקתני שוגגין ועשו שוגגין לא פריך נמי פשיטא וצריך לומר אגב דתנא הכא דהתם ליכא לשנויי כדהכא דהיכי סלקא דעתך למימר דכולהו סנהדרין שכחו מאיזה טעם הורו:

אמר רב אחא בר יעקב לא מייתי בהוראה אלא מאן דאקרי קהל ושבטו של לוי לא אקרי קהל שנאמר ויאמר אלי הנני מפרך והרבתיך ונתתיך לקהל עמים ונתתי את הארץ הזאת לזרעך אחריך אחזת עולם כל שיש לו אחוזה קרוי קהל וכל שאין לו אחוזה אינו קרוי קהל. פי' ולוים לית להו אחוזה. אקשי' אי הכי בצרי להו. פירוש י"א הוו ופרקינן משמיה דאביי אפרים ומנשה כראובן ושמעון יהיו לי. א"ל רבא והא כתיב על שם אחיהם יקראו בנחלתם. לנחלה הקשתים לראובן ושמעון ולא לדבר אחר אהדר ליה אביי ולא והא חלוקין בדגלים. פירוש דכתיב דגל מחנה אפרים וגו' ועליו מטה מנשה. ופרקינן כדי לחלוק כבוד לדגלים. פירוש כי כל דגל היו לו ג' נשיאים ואילו לא נחלק שבט יוסף היה נשאר דגל אחד בב' נשיאים בלבד כי שבט לוי לא פוקד דכתיב והלוים לא התפקדו וגו' ס"א והא חלוקין בדגלים כנחלתם כך חנייתם. פירוש הכי קאמר ליה יעקב ליוסף על שם אחיהם יקראו בנחלתם והמחנות נמי מעין נחלה היתה שהן חולקין הרוחות הלכך נחלקו. וראינו במקצת פי' חכמים כנחלתם כך חנייתם שיעקב חלק להם את הארץ. וצום היאך יחנו לדגליהם. וכך מצינו במדרש ר' תנחומא איש על דגלו באותות לאות שצוה להם אביהם שלרוחות שנחלקו לשאת מטתו להן נחלקו לדגלים ואקשינן והא חלוקין בנשיאים דכתיב ביום השביעי נשיא לבני אפרים אלישמע בן עמיהוד. ביום השמיני נשיא לבני מנשה גמליאל בן פדהצור ופרקינן כדי לחלוק כבוד לנשיאים.
פירוש הואיל ונחלקו בדגלים לטעם שאמרנו אילו הקריב אחד וחברו לא איכא זילותא. דתניא [מג"ת פי"ב] שלמה עשה ז' ימים בחנוכת הבית מפני מה עשה משה י"ב כדי לחלוק כבוד לנשיאים. פי' שאם הקריב זה ולא יקריב זה איכא קפידא וקיימא לה קושיא דאי הכי בצרו להו וליכא למימר כהנים עם לעצמן ולעולם קסבר ר' שמעון חטאת השותפין לא אזלא למיתה. מאי הוה עלה פירוש דהא דרב יוסף מי מתוקמא האי כר' שמעון אי לא. ת"ש דתניא בספרא פרשת נשיא ושחט אותו ולא תמורתו ולמטה הוא אומר ושחט אותה ולא וולדה ולא תמורתה מכאן היה רבי שמעון אומר כו' ר"ש אומר ה' חטאות מתות וולד חטאת ותמורת חטאת וחטאת שמתו בעליה ושנתכפרו בעליה ושעברה שנתה ואי אתה יכול לומר ולד חטאת בצבור. פי' ימות לפי שאין הצבור [מפרישין נקבה וא"א יכול לומר תמורת חטאת בצבור לפי שאין הצבור] ממירין. פי' דתנן בתמורה הצבור והשותפין מקדישין אבל לא ממירין. ואי את יכול לומר חטאת שמתו בעלים בצבור לפי שאין הצבור מתים פי' כולם הלכך כל אלו השלשה לתנהו בצבור. יכול כפרו בעלים ושעברה שנתה יהו מתות בצבור אמרת ילמד סתום ממפורש. פי' סתום דצבור מפורש דיחיד. מה ולד חטאת ותמורת חטאת ושמתו בעליה ביחיד דברי' אמורים ולא בצבור אף כיפרו בעלים ושעברה שנתה ביחיד דברי' אמורים ולא בצבור. הלכך קרבין בצבור.
פי' הוא הדין לשותפין נמי דאמרינן אי אתה יכול לומר ולד חטאת בשותפין שאין שותפין מביאין נקבה פי' דכתיב בחטאת יחיד וכפר עליו. ותניא בספרא שתהא כפרה לשמו שלא יכפר על שנים כאחת. ולא תמורת חטאת בשותפין לפי שאין שותפין ממירין וה"נ ילמוד סתום ממפורש דכולהו ה' חטאות לר' שמעון בשותפין לא מייתי ולא מתוקמא האי דמת אחד מב"ד פטורין כר"ש דלסבריה חייבין וכמאן דאוקמה כר"מ סלקא סוגיא דשמעתא:
הדרי' לאקשויי אהא דקתני ר' שמעון ילמוד סתום ממפורש וכי דנין אפשר משאי אפשר.
פי' היאך נדון כפרו בעליה ושעברה שנתה דאפשר בהו בצבור מולד חטאת ותמורת חטאת וחטאת שמתו בעליה דאי אפשר בהן בצבור. ופרקינן בחד מקום גמיר. פי' כך גמיר ר"ש מפי רבותיו הלכה למשה מסיני כי החטאות המתות אין אחת מהן נוהגת אלא במקום שנוהגות כולן וכיון דאי אפשר באותן הג' לנהוג בצבור (הכי) [הני] נמי אין נוהגות ובעל כרחך למד סתום ממפורש והתם בתמורה בסוף פרק יש בקרבנות היחיד אקשינן עלה כי האי גוונא וכי דנין אפשר משאי אפשר. אמר ר"ל ד' נתנו והעמידום על ה' פי' אלו הה' חטאות ד' מהן נתנו למיתה וה' נשתכח דינה בימי אבל משה. דגרסינן התם בפרק יש בקרבנות היחיד א"ר יצחק אף חטאת שנתכפרו בעליה נשתכחה בימי אבל משה והעמידו כל הה' למיתה. כלומר ואי ס"ד דהני ד' בצבור נתנו הא אי אפשר בכולהו. אלא ש"מ ביחיד נתנו ובעל כרחך ילמד סתום ממפורש:
אמר ברוך קדמנו באור תנאין י"א אשר אין חולק בי' מהן כי הן צורך ההוראה ואותו שחלק בא' והוא ר' יהודה האומר שמתקיימת בב"ד שבט. ואין הלכה כמוהו אלא כחכמים. עכשיו נבאר החלוקה היטב לאמר כי נחלקו חכמי המשנה ג' מחלוקת בביאת הפר. משום ר' מאיר נחלקו בה ב' התנאין. אחד אמר כי ר' מאיר היה סובר כי הקהל הכתוב בפרשה כל קהל שבטי ישראל הוא ולעולם אין מביאין פר עד שיעשו רוב ישראל בשבטים ובמספר הגברים וכשעושין החובה תלויה במי שההוראה תלויה והן ב"ד. הלכך ב"ד יביאו פר אחד וכל ישראל פטורין ובעבודת כוכבים פר ושעיר וכל ישראל פטורין ור' שמעון בן אלעזר אומר לא היה ר' מאיר מבקש רוב מספר שבטים ורוב מספר גברים אלא או זה או זה:
ר' יהודה הסובר כי הקהל הכתוב בפרשה שבט הוא וכך שורתו אם חטא שבט או רובו בהוריית בית דינו אותו שבט מביא פר וב"ד וכל ישראל פטורין אבל חטא בהוריית בית דין הגדול (באין) [כולן] על אותו חטא י"ב פרים מביאין. אבל אם היה החטא ממיעוט שבט ליכא פר ובין כך ובין כך ב"ד לעולם פטור. ר' שמעון הסובר כי הקהל שבט הוא אבל אין לו חובת פר כלל ולא לב"ד על ידו אלא בהוריית ב"ד הגדול וכך דינו כשהורו ב"ד הגדול ועשה שבט או רובו על פיהם אותו שבט מביא פר וב"ד מביא על ידו פר כי כשם שנשתתפו בשגגה ישתתפו בחובה ושאר ישראל פטורין.
והוא הדין לב' שבטים או ג' או ד' או ה' או ו' והן רובו או ז' והן מיעוטו לעולם כולן מביאין פר אחד וב"ד פר.

לדעת האומר ששבט לוי אינו קרוי קהל על כרחך אי אתה מוצא שנים עשר פרים בפר העלם דבר אלא שתחשוב אפרים ומנשה בשני שבטים ולפי סוגיא זו אינם נמנים לענין זה אלא בשבט אחד שנאמר על שם אחיהם יקראו בנחלתם לנחלה הוקשו ולא לדבר אחר ואע"פ שנחלקו בדגלים ונשיאים לא היה אלא לחלוק כבוד לדגלים ולנשיאים ומעתה אתה זקוק לומר ששבט לוי קרוי קהל וכן הדין נותן:
ונשלם הפרק תהלה לאל:
הורה כהן משיח וכו' כבר ביארנו בראש המסכתא שיסוד זה הפרק אמנם הוא בביאור עניני קרבן כהן משיח ונשיא ובקצת ענינים שבשניהם עם קצת דינים כלליים בעניני אשם ועל זה הצד יחלק ענין הפרק לשלשה חלקים הראשון לבאר עניני קרבן כהן משיח על איזה צד משתנה מקרבן הדיוט ועל איזה צד חייב ועל איזה צד פטור השני לבאר שיש עברות שאינן בדין קרבן צבור וקרבן כהן משיח אע"פ שזדונן כרת אע"פ ששגגתן חטאת הואיל ואינו קבוע ויתגלגלו בחלק זה קצת דברים בעניני אשם תלוי השלישי בחלוק הקרבנות איזה קרבן לצבור ואיזה לכהן משיח ואיזה לנשיא ובאיזה צד קרבן צבור ומשיח ונשיא חלוקין זה מזה זהו שרש הפרק דרך כלל אלא שיתגלגלו בו קצת ענינים כמו שיתבאר:
והמשנה הראשונה ממנו אמנם תכוין לבאר ענין החלק הראשון והוא שאמר הורה כהן משיח וכו' כלומר שלא אמרו בכהן משיח שיביא פר אלא על הדרכים שהצבור מביאו בהוראת בית דין שדינו לענין הוראת עצמו כדין הקהל להוראת בית דין ומתוך כך פרט בענינים אלו שאם הורה לעצמו בטעות ושגג על פי אותה הוראה על דרך בית דין שהתירו בשוגג ושגגו הקהל על פי הוראתם חייב אבל הורה שוגג ועשה מזיד או הורה מזיד ועשה שוגג פטור לגמרי שזה כלל בכהן משיח שאינו מביא קרבן כלל אלא בהעלם דבר ר"ל הוראת טעות עם שגגת מעשה אבל אם שגג במעשה בלא שום הוראה אינו מביא קרבן כלל הורה בפני עצמו ר"ל בטעות ועשה בפני עצמו שוגג על פי הוראתו על הדרך שכתבנו מתכפר לו בפני עצמו ר"ל שמביא פר הורה עם הצבור ר"ל עם הבית דין ושגג הוא והבית דין בהוראתם ושגג עם הצבור במעשה מתכפר בכלל הצבור בפר העלם דבר של צבור הואיל ועל הוראת בית דין סמך אע"פ שהורה עמהם ואם לא היה שם קרבן צבור כגון ששגגו מיעוט הקהל הוא פטור לגמרי משום קרבן וכשם שאין בית דין חייבין עד שיורו לבטל מקצת ולקיים מקצת אבל לא בעקירת כל הגוף כך הדין בכהן משיח להוראת עצמו כגון זורק מרשות לרשות וכן בע"ז בהשתחואה שלא בפשוט ידים ורגלים על הדרך שביארנו בפרק ראשון וכן כשם שאין דין קרבן צבור אלא בהעלם דבר ר"ל בהוראת בית דין עם שגגת מעשה כך במשיח וכן בע"ז אין בית דין חייבין ר"ל שאין בה דין קרבן צבור אלא בהעלם דבר ושגגת מעשה ואע"פ שלא שנו בזה וכן המשיח פי' בגמ' שהדין כך הוא מ"מ שאף בע"ז אע"פ שאין קרבנה חלוק לכהן משיח מנשיא ושאר הדיוטות מ"מ אין כהן משיח חייב שום קרבן בשגגת מעשה לבד אא"כ בהעלם דבר וכן שאין קרבן צבור אלא בהוראת דבר שזדונו כרת ושגגתו חטאת כך המשיח אבל אם הורה בדבר שזדונו אשם ודאי אין בהם אלא דין יחידים לעושים הן הדיוט הן כהן משיח הן נשיא כמו שיתבאר וכן בע"ז אין שם קרבן צבור אלא בדבר שזדונו כרת ושגגתו חטאת כגון השתחואה ולא במגפף ומנשק וכן במשיח וכן אתה צריך לבאר בענינו שיהא מופלא וראוי להוראה אע"פ שלא הוזכר כמו שיתבאר בגמרא כללו של דבר כל שהוא בהוראת עצמו עם שגגת מעשה חייב על הדרכים שהצבור חייב בהוראת בית דין וכל שחסר אחת מהן פטור משום קרבן ואם הורה ושגג בע"ז כפי הוראתו מביא שעירה שהרי קרבן יחיד בע"ז לא נשתנה בין משיח בין נשיא בין הדיוט כמו שהתבאר אבל אם שגג במעשה בלבד או שחסר אחד מן הדרכים שבארנו בצבור עם בית דין אינו מביא קרבן כלל לא בע"ז ולא בשאר מצות:
זהו ביאור המשנה וכלה על הצד שביארנוה הלכה היא ודברים שנכנסו תחתיה בגמרא אלו הם:
כהן משיח שהורה לעצמו ושכח מאיזה טעם הורה ומ"מ בשעת מעשה עשאו על סמך הוראתו הרי זה בדין קרבן כהן משיח ואין אומרין שאלו היה זכור הטעם היה חוזר בו והרי הוא כאלו חזר בו אלא דנין אותו כהורה ושגג על פי הוראתו לגמרי וכן הדין בבית דין אצל צבור:

כָּל שֶׁיֵּשׁ לוֹ אֲחוּזָה אִקְרֵי 'קָהָל' וְכָל שֶׁאֵין לוֹ אֲחוּזָה לֹא אִקְרֵי 'קָהָל' (בראשית מח, ד). יש להקשות מה טעם יש בזה ולמה יגרעו כהנים ולוים משם זה של 'קהל'? ונראה לי בס"ד כי כהנים לוים וישראלים כל אחד יש לו תואר אדם וכמו שאמרו אדם אתם ואמרו רבותינו ז"ל (יבמות סא.) אתם קרוים 'אדם' ואין העכו"ם קרוים 'אדם'. וידוע דהם בחג"ת [חסד גבורה תפארת] דהיינו כהן בחסד לוי בגבורה ישראל בתפארת קו האמצעי וידוע כי בקו האמצעי כלולים גם השני קוין ימין ושמאל שהם חו"ג [חסד וגבורה] ולכן כהן ולוי אין להם אחוזה בארץ כי רק ישראל שהם בתפארת שהוא נקרא גופא וחשיב גופא יש להם אחוזה בארץ כי גופא שליט בכל אבל כהן ולוי שהם אחוזים בימין ושמאל בלבד שהם ענפים ולבר מגופא אין להם אחוזה בגוף הארץ נמצא ישראלים יש להם תואר אדם לעצמן וכלולים בהם גם כהנים ולוים והרי בישראל כלול גם כהן ולוי שכל אחד מהם נקרא בשם 'אדם'. הרי בישראל איכא תלת 'אדם' חד שלהם ושנים של כהן ולוי הכלולים בהם ושלש פעמים אדם עולה מספר קהל [45×3=135] ולכן כל שיש לו אחוזה בארץ מפני שהוא אחוז בגופא שהוא התפארת דמלבד שיש לו אדם לעצמו יש בו ב' פעמים אדם מצד הקוין הכלולין בו אקרי 'קהל' כי ג' פעמים אדם עולה 'קהל' וכל מי שאין לו אחוזה מפני שהוא רק אחוז בענפים שהם יד ימין ויד שמאל ואין לו אחיזה בגופא לא אקרי 'קהל' כי הוא אין לו רק תואר אדם אחד.

אֶלָּא מֵעַתָּה נַיְיתוֹ פַּר בְּהוֹרָאָה! וְכִי תֵּימָא, הָכִי נָמֵי – טָפִי לְהוּ שְׁבָטִים.
The Gemara challenges: If that is so, that the priests are characterized as a congregation, let them bring a bull as an unwitting communal offering if they perform a transgression on the basis of the ruling of the court. And if you would say indeed it is so, that is difficult, as the number of tribes has increased to thirteen.
אֶלָּא אָמַר רַב אַחָא בְּרַבִּי יַעֲקֹב: שִׁבְטוֹ שֶׁל לֵוִי לָא אִיקְּרוּ קָהָל, דִּכְתִיב: ״הִנְנִי מַפְרְךָ וְהִרְבִּיתִךָ וּנְתַתִּיךָ לִקְהַל עַמִּים וְגוֹ׳״. כֹּל שֶׁיֵּשׁ לוֹ אֲחוּזָּה – אִיקְּרִי קָהָל, וְכֹל שֶׁאֵין לוֹ אֲחוּזָּה – לָא אִיקְּרִי קָהָל.
Rather, Rav Aḥa, son of Rabbi Ya’akov, said: The tribe of Levi is not characterized as a congregation, as it is written: “Behold, I will make you fruitful and multiply you, and I will make of you a congregation of peoples; and I will give this land to your descendants after you for an everlasting possession” (Genesis 48:4). It is derived from here that any tribe that has an ancestral possession bequeathed to it is characterized as a congregation, and any tribe that does not have an ancestral possession bequeathed to it is not characterized as a congregation. The tribe of Levi has no ancestral land, and the priests who are from the tribe of Levi have no ancestral land.
אִם כֵּן, חָסְרִי לְהוּ שְׁנֵים עָשָׂר שְׁבָטִים! אָמַר אַבָּיֵי: ״אֶפְרַיִם וּמְנַשֶּׁה כִּרְאוּבֵן וְשִׁמְעוֹן יִהְיוּ לִי״. אָמַר רָבָא, וְהָא כְּתִיב: ״עַל שֵׁם אֲחֵיהֶם יִקָּרְאוּ בְּנַחֲלָתָם״, לְנַחֲלָה הוּקְשׁוּ וְלֹא לְדָבָר אַחֵר!
The Gemara challenges: If so, the twelve tribes are lacking in number, as without the tribe of Levi there are only eleven. Abaye said that it is stated: “Ephraim and Manasseh shall be like Reuben and Simeon to me” (Genesis 48:5), and they are counted as two tribes. Rava said: But isn’t it written: “After the name of their brethren shall they be called in their inheritance” (Genesis 48:6), indicating that it is with regard to inheritance that they are likened to tribes, but not with regard to another matter?
וְלָא? וְהָא חֲלוּקִין בַּדְּגָלִים! כְּנַחֲלָתָן כָּךְ חֲנִיָּיתָן, כְּדֵי לְחַלֵּק כָּבוֹד לַדְּגָלִים.
The Gemara challenges: And are they not considered independent tribes concerning other matters as well? But aren’t they separate with regard to the banners under which the Jewish people traveled in the wilderness? There were three tribes represented by each banner, and the three tribes under the banner of Manasseh were Manasseh, Ephraim, and Benjamin. The Gemara answers: In accordance with the division of the tribes according to their inheritances, so was the division of the tribes in their encampment around the Tabernacle. This was in order to honor the banners, so that there would be three tribes affiliated with each banner.
וְהָא חֲלוּקִים בַּנְּשִׂיאִים! הָהוּא, לַחֲלוֹק כָּבוֹד לַנְּשִׂיאִים. דְּתַנְיָא: שְׁלֹמֹה עָשָׂה שִׁבְעָה יְמֵי חֲנוּכָּה, וּמָה רָאָה מֹשֶׁה לַעֲשׂוֹת שְׁנֵים עָשָׂר יְמֵי חֲנוּכָּה? כְּדֵי לַחֲלוֹק כָּבוֹד לַנְּשִׂיאִים.
The Gemara asks: But aren’t they separate with regard to the matter of princes of the tribes, as the tribes of Ephraim and Manasseh had separate princes? The Gemara answers: That was in order to honor the princes, and there is no proof that they are two different tribes with regard to other matters. This is as it is taught in a baraita : Solomon set seven days of dedication of the Holy Temple, and what did Moses see that led him to set twelve days of dedication for the Tabernacle? He did so in order to honor the tribal princes, so that the prince of each tribe would bring his offering on his own day. Due to the honor each prince deserved, Ephraim and Manasseh are considered two tribes.
מַאי הָוֵי עֲלַהּ?
The Gemara asks: What conclusion was reached about Rabbi Shimon’s opinion? Does he hold that a sin-offering brought by several partners is different from a communal sin-offering, as Rav Yosef explained, or does he hold that there is no difference between them, as Abaye explained?
תָּא שְׁמַע, דְּתַנְיָא: רַבִּי שִׁמְעוֹן אוֹמֵר, חָמֵשׁ חַטָּאוֹת מֵתוֹת: וְלַד חַטָּאת, וּתְמוּרַת חַטָּאת, וְחַטָּאת שֶׁמֵּתוּ בְּעָלֶיהָ, וְחַטָּאת שֶׁנִּתְכַּפְּרוּ בְּעָלֶיהָ, וְחַטָּאת שֶׁעָבְרָה שְׁנָתָהּ. וְאִי אַתָּה יָכוֹל לוֹמַר וְלַד חַטָּאת בְּצִבּוּר, שֶׁאֵין צִבּוּר מַפְרִישִׁין נְקֵבָה. וְאִי אַתָּה יָכוֹל לוֹמַר תְּמוּרַת חַטָּאת בְּצִבּוּר, שֶׁאֵין תְּמוּרָה בְּצִבּוּר. וְאִי אַתָּה יָכוֹל לוֹמַר חַטָּאת שֶׁמֵּתוּ בְּעָלֶיהָ בְּצִבּוּר, שֶׁאֵין צִבּוּר מֵתִים.
The Gemara suggests: Come and hear proof, as it is taught in a baraita that Rabbi Shimon says: There are five sin-offerings that are left to die, as they may not be sacrificed: The offspring of a sin-offering born after its mother was consecrated as a sin-offering; the substitute of a sin-offering, which assumes sacred status but may not be sacrificed; a sin-offering whose owners have died; a sin-offering whose owners’ sin was atoned for with another offering; and a sin-offering whose first year has passed, as a sin-offering may be brought only within the animal’s first year. And you cannot state a case of the offspring of a communal sin-offering, as the congregation does not designate a female as a sin-offering, And you cannot state a case of a substitute of a communal sin-offering, as there is no substitute for a communal offering. And you cannot state a case of a sin-offering whose owners have died in the case of a communal sin-offering, as the public does not die.
שֶׁנִּתְכַּפְּרוּ בְּעָלֶיהָ וְשֶׁעָבְרָה שְׁנָתָהּ – לֹא שָׁמַעְנוּ, יָכוֹל יָמוּתוּ? אָמַרְתָּ: יִלְמוֹד סָתוּם מִן הַמְפוֹרָשׁ, מַה מָּצִינוּ בִּוְלַד חַטָּאת וּתְמוּרַת חַטָּאת וְשֶׁמֵּתוּ בְּעָלֶיהָ – בְּיָחִיד דְּבָרִים אֲמוּרִים וְלֹא בְּצִבּוּר, אַף שֶׁנִּתְכַּפְּרוּ בְּעָלֶיהָ וְשֶׁעָבְרָה שְׁנָתָהּ – בְּיָחִיד דְּבָרִים אֲמוּרִים וְלֹא בְּצִבּוּר.
With regard to a sin-offering whose owners’ sin was atoned for and a sin-offering whose first year has passed, we did not hear whether the halakha applies to communal sin-offerings as well. One might have thought they too shall be left to die. You say: One shall derive the vague from the explicit. What did we find with regard to the offspring of a sin-offering, the substitute of a sin-offering, and a sin-offering whose owners died? We found that these matters are stated only with regard to an individual sin-offering, but not with regard to a communal sin-offering. So too, these matters of a sin-offering whose owners’ sin was atoned for and a sin-offering whose first year has passed are stated only with regard to an individual sin-offering, but not with regard to a communal sin-offering. Likewise, one may derive that an individual’s sin-offering must be left to die, while a sin-offering owned by partners is not left to die.
וְכִי דָּנִין אֶפְשָׁר מִשֶּׁאִי אֶפְשָׁר? רַבִּי שִׁמְעוֹן בְּחַד מָקוֹם גְּמִיר.
The Gemara asks: And does one derive the halakha of the possible from the impossible? Some of these cases are by their very nature not relevant to communal sin-offerings. One cannot derive the halakha from them with regard to cases that could be relevant to communal sin-offerings. The Gemara answers: Rabbi Shimon learns all these halakhot of sin-offerings that are left to die as a tradition in one place, i.e., as a single halakha . In cases where not all the categories of sin-offerings left to die apply, no category of sin-offerings that are left to die applies.
הַדְרָן עֲלָךְ הוֹרוּ בֵּית דִּין
MISHNA: In a case where an anointed priest, i.e., the High Priest, issued an erroneous ruling for himself permitting performance of an action prohibited by Torah law, if he issued the ruling unwittingly and then unwittingly performed the transgression in accordance with his ruling, he is liable to bring a bull as a sin-offering for an unwitting transgression by the anointed priest. If he issued the ruling unwittingly, and performed the transgression intentionally, or if he issued the ruling intentionally and performed the transgression unwittingly, he is exempt from liability to bring any offering, as there is a principle: The legal status of the ruling of an anointed priest for himself is like that of the ruling of the court for the general public. Therefore, the High Priest is liable to bring the bull as a sin-offering for his unwitting transgression in a case when the court would be liable to bring the bull as a communal sin-offering for an unwitting transgression performed by the general public.
מַתְנִי׳ הוֹרָה כֹּהֵן מָשִׁיחַ לְעַצְמוֹ שׁוֹגֵג וְעָשָׂה שׁוֹגֵג – מֵבִיא פַּר. שׁוֹגֵג וְעָשָׂה מֵזִיד, מֵזִיד וְעָשָׂה שׁוֹגֵג – פָּטוּר, שֶׁהוֹרָאַת כֹּהֵן מָשִׁיחַ לְעַצְמוֹ כְּהוֹרָאַת בֵּית דִּין לַצִּבּוּר.
GEMARA: The mishna teaches: If he issued the ruling unwittingly and then unwittingly performed the transgression in accordance with his ruling, he is liable to bring a bull. The Gemara asks: Isn’t this obvious? This is certainly a case of an unwitting transgression, for which the Torah deems him liable to bring an offering.
גְּמָ׳ שׁוֹגֵג וְעָשָׂה שׁוֹגֵג – מֵבִיא פַּר. פְּשִׁיטָא!
Abaye said: What are we dealing with here? We are dealing with a case where he issued an erroneous ruling and forgot the reason that was the basis upon which he issued the ruling, and at the moment that he erred and performed the transgression, he said: I am hereby performing this action with my ruling in mind. As, lest you say: Since if the reason that was the basis upon which he issued the ruling became known to him at that moment, perhaps he would have retracted his ruling, therefore if he nevertheless performed his transgression, his status is like that of an intentional transgressor, and let him not be liable to bring an offering; to counter this, the tanna teaches us that this too is a case of an unwitting transgression.
אָמַר אַבָּיֵי: הָכָא בְּמַאי עָסְקִינַן? כְּגוֹן שֶׁהוֹרָה, וְשָׁכַח מֵאֵיזֶה טַעַם הוֹרָה, וּבְשָׁעָה שֶׁטָּעָה אָמַר: הֲרֵינִי עוֹשֶׂה עַל דַּעַת הוֹרָאָתוֹ, דְּמַהוּ דְּתֵימָא: כֵּיוָן דְּאִילּוּ מִתְיְדַע לֵיהּ, [שֶׁמָּא] הָדַר בֵּיהּ – כְּמֵזִיד דָּמֵי וְלָא לִחַיַּיב, קָא מַשְׁמַע לַן.
§ The mishna teaches: If he issued the ruling unwittingly, and performed the transgression intentionally, or if he issued the ruling intentionally and performed the transgression unwittingly, he is exempt. The Gemara asks: From where are these matters, the halakhot unique to the sin-offering for an unwitting transgression by the anointed priest, derived? They are derived from a verse, as the Sages taught in a baraita : It is written: “If the anointed priest shall sin so as to bring guilt upon the people” (Leviticus 4:3), from which it is derived that the liability of the anointed priest is incurred like that of the general public. The Gemara discusses this derivation. As one might have thought that the verse is superfluous: Could this not be derived through logical inference?
מֵזִיד וְעָשָׂה שׁוֹגֵג כּוּ׳. מְנָא הָנֵי מִילֵּי? דְּתָנוּ רַבָּנַן: ״לְאַשְׁמַת הָעָם״, הֲרֵי מָשִׁיחַ כְּצִבּוּר. שֶׁיָּכוֹל, וַהֲלֹא דִין הוּא:
