    Tosafot

    We derive it from 'his ox.' Rav says that if one owns a stone, knife or package, they cannot be considered a bor. It is Rav’s opinion that a bor is ownerless by definition. If so, from where can we learn that if one’s stone, knife or package damaged somebody, that the owner is liable? The Gemara says that it can be derived from shor, his ox. His ox is his property and he is liable for damage that it does, so too, he is liable for his stone that is his property. We have learned that shor has three avos. From which one do we learn that one is liable for the damage caused by his stone? This is one of Tosafot topics. We must keep in mind that when we learn the liability for a stone from bor or shor, it takes on the laws of shor or bor. For example, according to Shmu’aill who holds that we learn the liability for a stone from bor, one is not liable for damage to vessels, since a bor is not liable for damaging vessels. From which av of shor are we learning that one is liable for damage done by his stone, knife or package? It is keren that is the source from which we learn that one is liable for damaged caused by his property. We cannot use shain or regel as a source, for shain and regel are exempt in a public domain and that which is derived from them would have the same rule and also be exempt in a public domain. The Gemara is specifically speaking about a stone that damaged in a public domain, so the only source can be keren, which is liable in a public domain. Using keren as a source is not without problems. Theoretically, for anything that is derived from keren there should be a distinction between a tam and a muad. The Gemara makes no mention of such a distinction about damage caused by one’s stone. Why not? As far as one’s stone knife or load, we cannot distinguish between a tam and a muad, for it is only logical to make such a distinction about live animals. When dealing with live animals one can say that the first three times the animal damaged were an irregularity and he only pays half. After three times the animal has shown that he regularly damages and is liable for full payment. This distinction between the first three times and afterwards cannot be made for inanimate objects. Another problem with using shor as a source: And if you ask: How can we learn from shor, that one is liable for damages done by his inanimate objects? The comparison can be refuted with the argument: How can you use shor as a source from which to learn that one is liable for damaged caused by his stone? Shor has the characteristic that it is alive and has intent to harm, which the stone, knife and load do not have? Tosafot answers: And Rashbam explains: That they, the stone, knife and load, derived from bor and shor by the method of a common characteristic. Our Mishna said that there is a common characteristic from which we learn other forms of damaging. Later the Gemara (6a) discusses what additional forms the Mishna mean. The first suggestion by Abaye is the case presently under discussion. The Gemara there argues that if they were declared ownerless, according to both Rav and Shmuel they can be derived directly from bor, and there is no need for them to be derived from the common characteristic. If they were not declared ownerless, the Gemara says that according to Shmuel they can be learned directly from bor, the common characteristic system is not needed. There seems to have been a text which reads that, according to Rav they can be derived from shor. In the context of that Gemara this would mean that they can be learned directly from shor, and there is no need for the common characteristic method. Tosafot, however, holds that this is definitely not true. He has shown us that the inanimate objects cannot be derived directly from shor but only through the common characteristic method. And later (6a) where the Gemara discusses what can be learned from the common characteristic, where Abaye says that it comes to teach liability for one’s stone and knife, we do not have the text: if according to Rav who says that they are all learned from shor, they are shor, which implies that the common characteristic system is not needed. For according to Rav, Abaye’s statement that they are derived from the common characteristic works out well because it is derived from the common characteristic method as we explained. We mentioned earlier that when one derives a new rule from an already existing rule, the new rule has the same laws as the existing one. but there is a difficulty, since we are now saying that we are learning the inanimate objects not only from shor but also from bor, and then one should be exempt when they damage vessels as is the law by bor? Perhaps, that is in fact the rule that if the inanimate objects damage a vessel the damager is exempt? Tosafot proves that this is not so. And later in Hamainee’ach (28a) Rav says that one is liable when they, his inanimate objects, damage vessels, where the Mishna discusses one whose jug was broken in a public domain, because he holds that they are derived from shor where there is no exemption for breaking vessels. This is a contradiction to what Tosafot has just said; that inanimate objects that are one’s property are derived from shor and bor and accordingly, there should be an exemption for breaking vessels.

    Your property This characterization of bor as “your property” is imprecise as far as bor is concerned, because a bor is not one’s property. The bor that the Torah speaks about is in the public domain. Obviously, it is not the property of the one who dug it. And so too, in so far as aish is concerned, the characterization of “your property” is imprecise, for it is plain that if one kindled his neighbor’s silo with another person’s fire; he is liable, even though the fire is not his property.

    A subcategory [if while] asleep Later, on this page, the Gemara cites the opinion of Rav that Maveh mentioned in our Mishna means a person who damages. At the end of (4a) the Gemara asks: The Mishna says that one of the common characteristics of the four avos is that they are all likely to damage. Is a person likely to damage? The Gemara responds we are speaking about a sleeping person. It is clear from the Gemara that a sleeping person is an av. When the Gemara suggests that perhaps a sleeping person is a toldoh, the Gemara could have refuted that suggestion by arguing that later (4a) the Gemara says that our Mishna is speaking about a sleeping person who is likely to damage and he is called an av. However, the Gemara does not present this refutation because anyhow he refutes the suggestion correctly.

    But didn't we learn [that] a person [is] always forewarned? The Gemara rejects the suggestion that a sleeping person is a toldoh, because the Mishna later says that a person is always muad even while sleeping. How does the fact that a person is always muad, prove that a sleeping person is not a toldoh? Perhaps a sleeping person is a toldoh and yet he is always liable? The Gemara does not mean to ask that a sleeping person is also an av, as the Gemara expounds about a person who injures another person in the Gemara in Chapter Kaitzad (later 26b) from the verse “a wound in place of a wound”, for the Gemara does not cite the verse here. Rather, the intent of the Gemara when quoting this Mishna is to show that a sleeping person is legally the same as a person who is awake and Rav Papa was not referring to a sleeping person when he said that the toldoh is sometimes not the same as the av.

    Saliva or moisture Rashi says that כיחו is saliva and ניעו is moisture that runs from the nose. Tosafot proves that Rashi’s interpretation of ניעו is incorrect and offers his own explanation. Rashi explained that ניעו is moisture of the nose. And this is difficult to Rabbeinu Tam: For in Chapter Dam HaNeedoh (needoh 55b) the Gemara teaches in a Braita “כיחו וניעו and moisture of the nose”. Obviously ניעו is not moisture of the nose. And it appears that כיחו is that which emits from the throat by the strength of one’s cough, and ניעו is that which emits from the mouth by relatively light shaking.

    To exempt in the public domain Rovo is not sure whether צרורות pays from the choicest assets of the damager or not. The Gemara asks: if so, in what way is צרורות a toldoh of regel? The Gemara answers: It is a toldoh of regel as far as being exempt in a public domain. It seems that it makes sense to Rovo that צרורות should have the exemption of regel in a public domain, but he is not sure whether צרורות should have the severity of regel to pay from the choicest. And if you ask: Why is it more apparent to Rovo that צרורות takes on the character of regel and is exempt in a public domain, while he is uncertain whether צרורות pays from the choicest assets as regel does? Tosafot explains that it depends on how one views the reduction in payment of צרורות. And we can answer: Since the law of regel would require that צרורות pays full damages and the halochoh to Moshe from Sinai comes to teach us that he only pays half damages, if so, we see that the halochoh to Moshe from Sinai comes to be lenient, Rovo therefore give צרורות the leniency of regel and not to be stringent, and Rovo is therefore unsure of whether to apply the stricter ruling of regel that one pays from the choicest.

    But why is it characterized [as] a subcategory of trampling? Tosafot is concerned with the basis of the Gemara’s question. There seems to be a very simple reason why it is called regel, it is exactly regel because it is a usual occurrence, as is regel. Why does the Gemara neglect that reality? Although it is similar to regel in that this type of damage is common, even so the Gemara questions; why is this called regel? Because the similarity is not sufficient reason to classify it as regel. Since its rules are distinct from regel, that צרורות pays only half damages, according to Rovo צרורות should be called a name of its own. The Gemara then answers that it does have at least some laws of regel that it is exempt in a public domain and therefore it can be properly called a toldoh of regel. See Otzar HaTosafot note 511.

    As Rav Yosef translates There are three possible reasons why the Gemara speaks specifically of Rav Yosef as the one translating in the Targum language. A) He was the author. There are many who believe that Rav Yosef was the author of the Targum of נביאים and כתובים. That would of course justify the Gemara referring to the Targum of Rav Yosef. Tosafot in Shabbat (115a ד"ה ובידו) disagrees with this opinion because the Gemara there refers to a Targum of Iyov in the times of the Tanoim that predates Rav Yosef. B) Rav Yosef was blind. There is a prohibition to say the words of the written law by heart. Rav Yosef could not read the words, so he always spoke of the words of Tanach in Targum. C) Rav Yosef was an expert in Targum. Tosafot will choose the reason he feels is best. The Gemara mentioned Rav Yosef because he was an expert in Targum. Expertise is required because there are many versions of Targum. And this reason is not as has been explained elsewhere (Shabbat 115a) תוספות ד"ה לא ניתנו, that because Rav Yosef was blind. And the Gemara in (Gittin 60b) says and the written Torah you may not say by heart. And that is why he said Targum. This reason is not acceptable because of the verse “it is a time to do for Hashem”, (Tehilim 119) the Gemara says there (Gittin 60a), based on this verse that it is permitted to violate the prohibition against saying the words of the written Torah by heart. And you have no “time to do” that permits one to violate this prohibition greater than this, where Rav Yosef who was blind would not be able to say the words of the Torah at all, if we were to enforce the prohibition in this case.

    מאי שנא אש דכח אחר מעורב בו טעם זה של כח אחר מעורב בו פעמים שתופסו לקולא ופעמים לחומרא כל אחד לפי מקומו דודאי קולא וחומרא יש בו וכאן תופסו לחומרא ולומר שעל כן חייבה בו תורה שאף ע"פ שבעל התקלה אינו מדליק את הגדיש ממש מ"מ מיד שהוא מדליק את האש מצוי הוא להתערב עמו מיד כח אחר שמוליכו ומזיק וכן הטעם באבנו וסכינו שהניחן בראש גגו שמצויין ליפול ברוח מצויה.

    משורו למדנו כתוב בתוספות ולקמן גבי צד השוה דקאמר אביי לאיתויי אבנו וסכינו לא גרסינן וכו' אי נמי אגב שמואל נקטיה. מיהו קשה דאם כן רב היכי מחייב בהו כלים כיון דמשור ובור קא אתו דיו לבא מן הדין להיות כנדון. ושמא לא אמרינן דיו מפלגא דינא דהיינו מחד המלמדין אלא אם כן הקולא שוה בשניהם. ובתוספות פירשו במסקנא דמשור ומאש קאתו. ולא נהירא דמה להנך שכן דרכן לילך ולהזיק. תלמיד רבינו פרץ ז"ל.

    תולדה ישן הוה מצי למיפרך וכו' ככתוב בתוספות. ומורי פירש דשפיר קאמר אב נעור תולדה ישן דאמרינן לקמן אדם דרכו להזיק בישן דאורחיה הוא. והקשה מורי הרב וכי משום דישן אורחיה הוא על כן יקרא לכל אדם דרכו להזיק והא איכא נעור דאין דרכו להזיק. ותירץ כיון דאשכחנא שם אדם דדרכו להזיק קורא התנא דרכו להזיק לכל אדם ועל כן שפיר קאמר אי לימא אב וכו' דכיון דתנא דמתניתין קרי ליה אדם אם כן נימא אב נעור תולדה ישן. ותימה דמאי פריך לרב פפא דאמר תולדותיהן לאו כיוצא בהן אפילו למאן דאמר תולדותיהן כיוצא בהן תיקשי לרב דמאי ניהו אב ותולדה. ונראה לי דהכי פריך כיון דאמר דתולדותיהן לאו כיוצא בהן תיקשי לרב מאי ניהו אבות ותולדות אבל למאן דאמר תולדותיהן כיוצא בהן מסתמא יותר נראה להעמיד אב בנעור דעביד במזיד ותולדה ישן. אי נמי סבר הוא כדאמרינן לקמן אדם דרכו להזיק כשהוא ישן והיינו אב. ה"ר יחיאל. ע"כ ממהר"י כהן צדק ז"ל.

    שם בגמ' מ"ש בור הסוגיא כאן תמוה שהפסיק בדברי רב וחוזר להקשות בדברי שמואל אבל לפי מ"ש בסמוך א"ש דקאי ג"כ אדברי רב לפי שאם לא היינו מוצאים הסברא דתחילת עשייתן לנזק באבנו וסכינו ומשאו ודאי היינו אומרים דלא הוי כיוצא בהם כיון שאין להם מעלה אחרת שתתחייב בעיקר התשלומין דממונא לא מיקרי מעלה כ"א ע"י צירוף דהרבה דברים מצינו בממון בעלים שהם פטורים לכך הוצרך לומר דעיקר התשלומין אף לרב היינו דתחילת עשייתן לנזק אלא שחוזרת אח"כ למקומה לשור כיון שהוא ממון בעלים:

    בתוספות בד"ה משורו למדנו היינו קרן דשן ורגל פטירי בר"ה עכ"ל אין להקשות דלפי מסקנת התוספות דאתיא משור ובור וע"כ ג"כ לא ס"ל לתוספות דאחר הלימוד במה"צ חוזרת למקומה לכל דיני שור דא"כ לא הוי מקשי מידי דלפטרו בה כלים א"ו דלא ס"ל דחוזרת למקומה א"כ תקשי דאמאי לא מפרשי דאתיא משן ורגל ובור והא דמחייבי בר"ה היינו דומיא דבור אלא דלק"מ כיון דלרב דאמר משורו למדנו הוי תולדת השור לא שייך להחמיר בתולדה מן האב ומש"ה מפרשים התוס' דאתיא מקרן ומבור אלא שתוס' הקשו בסוף הדיבור שניתן לה קולת הבור לפטור בה כלים וזה שייך שפיר להקל בתולדה יותר מאב וזה הוי לאו כיוצא בהן. אבל לפמ"ש ג"כ לא קשה מידי דחיוב כלים הוא לפי שחוזרת למקומה לדיני שור ודו"ק:

    בא"ד ובאבנו וכו' אין לחלק בין תמה למועדת וכו' דקדוק לשון התוספות מכוון דאחר שפרשו שא"א לומר דהוי תולדה דשן דא"כ אין להחמיר בה יותר מבאב א"כ גם עתה שנלמד מקרן הרי מחמרינן בה יותר מבאב במה שהיא מועדת מתחילתה לכן פי' שפיר דלא שייך לחלק בה בין תמה למועדת וילפינן לה שפיר מקרן דשור המועד ודו"ק:

    בגמרא אי בהדי דאזלי קמזקי כחו הוי אין הקושיא דכחו הוי ממש בכלל גופו ולא שייך ביה אבות ותולדות דאם כן לרב לא מצינו שום תולדה באמת למבעה והמשנה אמרה ד' אבות מכלל דאית תולדות לכולהו ועוד שהרי בכל נזקין כחו לאו כגופיה אלא בבהמה הוי צרורות אלא דהקושיא היא שכחו חייב כמו גופו ועיין ברש"י שהוסיף לכתוב וחייב וק"ל. ולפ"ז א"ש מ"ש שם רש"י כי קאמר ר"פ תולדה לאו כאב דידיה אתולדה דמבעה ע"כ. וזה תמוה מאד למה לא הוצרך לפרש כן בכל הסוגיא אבל לפמ"ש יש ליישב דלפי דבאמת תולדה דמבעה היינו כחו ולא שייך לומר בזה כיוצא או לאו כיוצא מכלל האבות שהרי בכולהו כחו לאו כגופו לכך פי' כאן תולדה כיוצא לאב דידה ומטעם זה לא פריך כאן מ"ש דכל שאינו בכלל האבות לא שייך מ"ש דשפיר שנא ושנא כמ"ש לעיל ודו"ק:

    בגמרא בחצי נזק צרורות דהלכתא גמיר' לה פרש"י ואע"ג דחצי נזק של נגיחה הוי קנס כדאמרינן לקמן האי פ"נ ממונא הוא והלכך לאו תולדה דקרן היא וכו'. יש כאן מקום תימה דהא כל סוגיא כאן אליבא דר"פ קיימא ולר"פ ודאי ס"ל דכל ח"נ אף של קרן הוי ממונא כדאיתא לקמן בהדיא דף ט"ו וכן בכתובות פ' א"נ וא"כ לפרש"י קשה דלר"פ יש לה להיות תולדה דקרן ועמ"ש בסמוך ישוב נכון:

    שם לרבא דמיבעיא ליה אמאי קרי ליה תולדה דרגל לפוטרו בר"ה נראה מסוגית הש"ס דדוקא לרבא משני הכי ולא לר"פ וכן הסכימו כל הפוסקים שהדין בח"נ לשלם מעליה דאע"ג דמיבעיא ליה לרבא כיון דחזינן דפשיטא ליה לר"פ עבדינן כוותיה ועוד דבתראה הוא. וזה תימא שהרי כ"ז אינו מדברי ר"פ עצמו אלא דסוגית הש"ס שקיל וטרי אליביה מדקאמר לאו כיוצא בהם וא"כ מנ"ל דפשיטא ליה לר"פ יותר מלרבא דלמא לר"פ ג"כ מיבעיא ליה והא דקרי ליה תולדה דרגל היינו לפוטרה בר"ה כמו לרבא. ומהרש"א הרגיש בזה וכתב וצ"ל דקים ליה לתלמודא דפשיטא ליה לר"פ וזה דוחק אלא משמע דמכאן מוכח דפשיטא ליה ונראה לי דלק"מ דבודאי לר"פ לא מצינו לשנויי דקרי ליה תולדה דרגל לפוטרה בר"ה דאכתי תקשה דיש לקרותה טפי תולדה דקרן כיון דמשלמת ממש ח"נ כמותה ואי משום דהאי פ"נ ממונא הוא הא לר"פ ס"ל דח"נ של קרן הוא ג"כ ממון ולא קנס ואי משום דאתיא מכח רגל הא נשיכה גם כן מכח שן קאתי ואפ"ה לא הוי תולדה דידה כיון דלאו אורחיה א"כ כמו כן צרורות ע"כ לאו אורחיה כ"כ כמו רגל אלא לאו אורחיה קצת מיקרי בסוגית הש"ס וכמו כן קרן לר"פ דס"ל דממונא הוא מוכח דלא אמרי' דקרן לגמרי לאו אורחא דא"כ הוי קנס אלא צ"ל דהוי אורחא קצת ולאו בחזקת שימור קיימא כן כמה פעמים וכ"כ תוס' להדיא וא"כ היה לו לקרות שפיר תולדה דקרן ולומר בה תולדה לאו כיוצא בהן דקרן חייבת בר"ה והיא פטורה והוי שפיר טפי כיון שעכ"פ היא כיוצא בה בעיקר תשלומין מה שאין כן לרגל לא דמיא בעיקר תשלומין לכך לא מצינן לתרץ כן אליבא דר"פ אלא צ"ל דקרי לה תולדה דרגל לשלם מעליה וא"כ היא דומה לרגל ג"כ בעיקר התשלומין ולא מצינו לקרותה תולדה דקרן ולומר דלאו כיוצא בה שהקרן משלמת מגופיה והיא משלמת מעליה דהיאך יתכן לומר שהתולדה חמורה יותר מהאב ולא מצינו כזה בשום מקום לכך קרי ליה תולדה דרגל וא"ש דלאו כיוצא בה שאב משלם נ"ש ותולדה ח"נ. וכל זה לר"פ אבל לרבא א"ש דרבא מצי שפיר סבר דח"נ קרן הוא קנס דכן הלכה וא"כ לא דמיא צרורות כלל לקרן דקנס וממון אינם ענין כלל זה לזה וקרן משונה מכל נזקין שלא מצינו בשום א' שיהא קנס. ועוד דמאן דס"ל ח"נ קנסא ס"ל דלאו אורחא כלל אבל צרורות הוי אורחא נגד קרן וא"כ לא שייך כלל לקרן. ומה שהקשה הש"ס לרבא אמאי קרי ליה תולדה דרגל ע"כ היינו שיש להם לקרות שם בפני עצמה וע"ז משני שפיר לפטרה בר"ה ודו"ק וא"כ א"ש דרש"י פי' לעיל ואע"ג דפ"נ קנסא היינו לפי המסקנא אליבא דרבא ואליבא דהלכתא דקיי"ל פ"נ קנסא כן נ"ל ודו"ק היטב:

    בתוספות בד"ה לפוטרו בר"ה וא"ת אמאי פשיטא ליה וכו' וי"ל כיון דמן הדין היה לשלם נ"ש ואתי הלכתא דלא משלם אלא ח"נ א"כ אתיא הלכתא להקל ולא להחמיר עכ"ל. פי' וא"כ דההילכתא הוא להקל מקילינן בה ג"כ לפוטרה בר"ה אבל לשלם מעליה הוי חומרא וצ"ל ג"כ לפ"ז דהתוספות מפרשי כן אליבא דרבא דס"ל פ"נ דקרן הוי קנס דאם נאמר דס"ל פ"נ דקרן הוי ממונא והיינו שמן הדין היה לשלם נ"ש כדאיתא בגמרא דף ט"ו אלא דרחמנא חס עליה א"כ לא שייך לומר דאתיא הלכתא להקל אלא נאמר דהלכתא אתא לדמותה ממש לקרן כיון דכאן וכאן היה הדין לשלם נ"ש וגזירת הכתוב לשלם חציה וא"כ היא ממש כמו קרן ויש לחייבה ג"כ בר"ה כמו קרן א"ו שהתוספות מפרש' דס"ל לרבא פ"נ דקרן הוי קנס שמן הדין היה דלא לשלם כלל כדאיתא התם בגמרא וא"כ בצרורות הוא ממש היפך הקרן דבקרן מצינו שהחמיר הכתוב יותר מהראוי ובצרורות אתי הלכה להקל לכך פטרינן לה ג"כ בר"ה ולפ"ז א"ש:

    וְאִי דְּלָא אַפְקְרִינְהוּ – אִי לִשְׁמוּאֵל, דְּאָמַר: כּוּלָּם מִבּוֹרוֹ לָמַדְנוּ, הַיְינוּ בּוֹר; וְאִי לְרַב, דְּאָמַר: כּוּלָּם מִשּׁוֹרוֹ לָמַדְנוּ, הַיְינוּ שׁוֹר!

    And if it is a case where one did not declare them ownerless, there is still a difficulty. If Rav Pappa’s statement is in accordance with the opinion of Shmuel, who says: We learned that one is liable for damage caused by all obstacles that he places in a public domain, whether or not he declares them ownerless, from the halakhot with regard to one’s pit, these cases are a subcategory of Pit. And if Rav Pappa’s statement is in accordance with the opinion of Rav, who says: We learned that one is liable for damage caused by all obstacles that he places in a public domain that he did not declare ownerless, from the halakhot with regard to one’s ox that gored another animal, these cases are a subcategory of Ox. With regard to the subcategories of Ox, the Gemara already established that their legal status is like that of the primary category of Ox.

    מַאי שְׁנָא בּוֹר – שֶׁכֵּן תְּחִלַּת עֲשִׂיָּיתוֹ לְנֵזֶק, וּמָמוֹנְךָ וּשְׁמִירָתוֹ עָלֶיךָ; הָנֵי נָמֵי – תְּחִלַּת עֲשִׂיָּיתָן לְנֵזֶק, וּמָמוֹנְךָ וּשְׁמִירָתָן עָלֶיךָ! אֶלָּא תּוֹלָדָה דְבוֹר כְּבוֹר, וְכִי קָאָמַר רַב פָּפָּא – אַתּוֹלָדָה דְמַבְעֶה.

    The Gemara asks concerning an obstacle that is a subcategory of Pit: What is different about Pit that it is defined it as a unique category? It is that its initial formation, i.e., the digging of the pit, is done in a manner that can result in damage, and it is your property, and responsibility for its safeguarding, to prevent it from causing damage to others, is incumbent upon you. In these subcategories of Pit, too, their initial formation, i.e., the placement of the obstacle in the public domain, is done in a manner that can result in damage, and they are your property, and responsibility for their safeguarding, to prevent them from causing damage, is incumbent upon you. Rather, it is apparent that the status of a subcategory of Pit is like that of the primary category of Pit, and when Rav Pappa says: There are among them some whose subcategories are dissimilar to them, he is referring to a subcategory of Maveh .

    מַאי נִיהוּ? אִי לִשְׁמוּאֵל, דְּאָמַר: מַבְעֶה זוֹ שֵׁן – הָא אוֹקֵימְנָא תּוֹלָדָה דְשֵׁן כְּשֵׁן. אִי לְרַב, דְּאָמַר: מַבְעֶה זֶה אָדָם – מַאי אָבוֹת וּמַאי תּוֹלָדוֹת אִית בֵּיהּ?

    The meaning of the term Maveh is not clear; therefore, the Gemara asks: What is the primary category of Maveh to whose subcategories the Gemara referred? If one suggests that Rav Pappa said his statement in accordance with the opinion of Shmuel, who says: Maveh , this is the category of Eating, this cannot be Rav Pappa’s intent. But didn’t we already establish that the legal status of a subcategory of Eating is like that of the primary category of Eating? Clearly, Rav Pappa was not referring to subcategories of Maveh . And if one suggests that Rav Pappa said his statement in accordance with the opinion of Rav, who says: Maveh , this is the primary category of Man, which includes damage caused by a person, not by his property or animals, what primary categories and what subcategories are there in that category? The halakha is the same with regard to all damage that a person causes.

    וְכִי תֵּימָא: אָב – נֵיעוֹר, תּוֹלָדָה – יָשֵׁן; וְהָתְנַן: אָדָם מוּעָד לְעוֹלָם, בֵּין עֵר בֵּין יָשֵׁן!

    And if you would say that there is a distinction: The primary category is a case where one causes damage while awake, and a subcategory is a case where one causes damage while asleep; but didn’t we learn in a mishna (26a): The legal status of a person is always that of one forewarned, and he is liable for any damage that he causes, both when he is awake and when he is asleep? Accordingly, that is not the distinction between a primary category and a subcategory.

    אֶלָּא אַכִּיחוֹ וְנִיעוֹ. הֵיכִי דָּמֵי? אִי בַּהֲדֵי דְּאָזְלִי קָמַזְּקִי – כֹּחוֹ הָוֵה! אִי בָּתַר דְּנָיַיח – בֵּין לְרַב בֵּין לִשְׁמוּאֵל, הַיְינוּ בּוֹר! אֶלָּא תּוֹלָדָה דְמַבְעֶה כְּמַבְעֶה. וְכִי קָאָמַר רַב פָּפָּא, אַתּוֹלָדָה דְאֵשׁ.

    Rather, perhaps Rav Pappa was referring to cases where one causes damage with his phlegm or his spittle. The Gemara asks: What are the circumstances where one would be liable for damage in that case? If it is a case where his phlegm and spittle cause damage as they were moving through the air after the person expectorated, that is damage caused by his direct action and there is no room to distinguish between the damage that it caused and any other damage caused by one’s direct action. If it is a case where his phlegm or spittle causes damage after it comes to rest on the ground, e.g., if one slipped in the spittle, fell, and was injured, both according to Rav and according to Shmuel this is a subcategory of Pit, as the spittle is an ownerless obstacle in the public domain. Rather, it is apparent that the status of a subcategory of Maveh is like that of the primary category of Maveh , and when Rav Pappa says: There are among them some whose subcategories are dissimilar to them; he was referring to a subcategory of Fire.

    תּוֹלָדָה דְאֵשׁ מַאי נִיהוּ? אִילֵּימָא אַבְנוֹ, סַכִּינוֹ וּמַשָּׂאוֹ שֶׁהִנִּיחָן בְּרֹאשׁ גַּגּוֹ, וְנָפְלוּ בְּרוּחַ מְצוּיָה וְהִזִּיקוּ; הֵיכִי דָמֵי? אִי בַּהֲדֵי דְּאָזְלוּ קָא מַזְּקִי – הַיְינוּ אֵשׁ,

    The Gemara asks: What is a subcategory of Fire? If we say that it is a case of his stone, his knife, or his load, where he placed them on top of his roof, and they fell off the roof by means of a common wind, and they caused damage, what are the circumstances in which one would be liable for the damage that was caused? If it is a case where those items caused damage as they were moving through the air propelled by the wind, that is a case of Fire.

    מַאי שְׁנָא אֵשׁ – דְּכֹחַ אַחֵר מְעוֹרָב בָּהֶן, וּמָמוֹנְךָ וּשְׁמִירָתוֹ עָלֶיךָ; הָנֵי נָמֵי – כֹּחַ אַחֵר מְעוֹרָב בָּהֶן, וּמָמוֹנְךָ וּשְׁמִירָתָן עָלֶיךָ! אֶלָּא תּוֹלָדָה דְאֵשׁ כְּאֵשׁ, וְכִי קָאָמַר רַב פָּפָּא – אַתּוֹלָדָה דְרֶגֶל.

    If so, what is different about Fire that defines it as a unique category? What is different is that another force, the wind, is involved with the fire in causing damage, as the wind causes the fire to spread, and the fire is your property, and responsibility for its safeguarding, to prevent it from causing damage, is incumbent upon you. In these subcategories of Fire too, another force is involved with the items placed on the roof and causes damage, as the wind causes them to fall, and they are your property, and responsibility for their safeguarding, to prevent them from causing damage, is incumbent upon you. Rather, it is apparent that the status of a subcategory of Fire is like that of the primary category of Fire, and when Rav Pappa says: There are among them some whose subcategories are dissimilar to them, he was referring to a subcategory of Trampling.

    רֶגֶל?! הָא אוֹקֵימְנָא תּוֹלָדָה דְרֶגֶל כְּרֶגֶל! בַּחֲצִי נֶזֶק צְרוֹרוֹת, דְּהִלְכְתָא גְּמִירִי לַהּ.

    The Gemara questions this explanation: A subcategory of Trampling? But didn’t we already establish that the status of a subcategory of Trampling is similar to that of the primary category of Trampling? The Gemara explains: Rav Pappa was referring to one’s liability to pay half the cost of the damage caused by pebbles in a case where they were inadvertently propelled by the foot of a walking animal, which is a halakha learned through tradition and not explicitly written in the Torah.

    וְאַמַּאי קָרֵי לַהּ תּוֹלָדָה דְרֶגֶל? לְשַׁלֵּם מִן הָעֲלִיָּיה.

    The Gemara asks: But if it is a unique halakhic category and the payment is different, why is it characterized as a subcategory of Trampling? The Gemara explains: It is due to the fact that it shares a common aspect with Trampling. One whose animal propels pebbles while it walks and thereby causes damage is liable to pay half of the damages from his superior-quality property, and he does not pay only from the body of his animal, as is the halakha concerning half the cost of the damage paid by the owner of an innocuous ox that gored a person or an animal.

    וְהָא מִבַּעְיָא בָּעֵי רָבָא – דְּבָעֵי רָבָא: חֲצִי נֶזֶק צְרוֹרוֹת – מִגּוּפוֹ מְשַׁלֵּם, אוֹ מִן הָעֲלִיָּיה מְשַׁלֵּם?

    The Gemara asks: But didn’t Rava raise a dilemma with regard to that matter? As Rava raised a dilemma: With regard to one’s liability to pay half the cost of the damage caused by pebbles propelled by the foot of his animal, does one pay damages exclusively from the body of his ox that caused the damage, or does one pay damages from his superior-quality property?

    לְרָבָא מִבַּעְיָא לֵיהּ, לְרַב פָּפָּא פְּשִׁיטָא לֵיהּ.

    The Gemara explains: Although it is a dilemma for Rava, it is obvious to Rav Pappa that one pays from his superior-quality property, and in that sense, he classified the pebbles that cause damage as a subcategory of Trampling.

    לְרָבָא דְּמִבַּעְיָא לֵיהּ, אַמַּאי קָרֵי לַהּ תּוֹלָדָה דְרֶגֶל? לְפוֹטְרָהּ בִּרְשׁוּת הָרַבִּים.

    The Gemara asks: According to Rava, who raises it as a dilemma, why is it characterized as a subcategory of Trampling when its legal status is different both in terms of the extent of one’s liability and in terms of the manner of payment? The Gemara explains: It is classified as a subcategory of Trampling in order to exempt from liability pebbles that cause damage in the public domain, just as damage in the category of Trampling is exempt in the public domain.

    הַמַּבְעֶה וְהַהֶבְעֵר כּוּ׳. מַאי ״מַבְעֶה״? רַב אָמַר: מַבְעֶה זֶה אָדָם, וּשְׁמוּאֵל אָמַר: מַבְעֶה זֶה הַשֵּׁן.

    § One of the primary categories of damage enumerated in the mishna is the category of Maveh and another is the category of Fire. The Gemara asks: What is the meaning of Maveh ? Rav says: Maveh , that is the category of Man, which includes a person who causes damage, but not the property or animal of a person that causes damage. And Shmuel says: Maveh , this is the category of Eating.

    רַב אָמַר מַבְעֶה זֶה אָדָם, דִּכְתִיב: ״אָמַר שֹׁמֵר אָתָא בֹקֶר וְגַם לָיְלָה, אִם תִּבְעָיוּן בְּעָיוּ״.

    The Gemara elaborates: Rav says: Maveh , this is the category of Man, as it is written: “The watchman said: Morning has come, and also night; if you will inquire [ tivayun ], inquire [ be’ayu ]” (Isaiah 21:12). The terms “ tivayun ” and “ be’ayu ,” meaning inquire, refer to a person, who is able to inquire. Accordingly, Maveh relates to an action performed by a person.

    וּשְׁמוּאֵל אָמַר מַבְעֶה זֶה הַשֵּׁן, דִּכְתִיב: ״אֵיךְ נֶחְפְּשׂוּ עֵשָׂו, נִבְעוּ מַצְפֻּנָיו״. מַאי מַשְׁמַע? כְּדִמְתַרְגֵּם רַב יוֹסֵף: אֵיכְדֵין אִיתְבְּלֵישׁ עֵשָׂו, אִתְגַּלִּין מַטְמֹרוֹהִי.

    And Shmuel says: Maveh , this is the category of Eating, as it is written: “How is Esau searched out [ neḥpesu ]; how are his hidden places revealed [ nivu ]” (Obadiah 1:6)? The terms nivu and maveh share a common root. The Gemara asks: From where may it be inferred that nivu connotes Eating? The Gemara explains that it is as Rav Yosef translates the verse into Aramaic: How is Esau searched out [ itbelish ]; how are his hidden places revealed [ itgaleyan ]? The meaning of the Aramaic term itgaleyan means revealed, and that is the meaning of the Hebrew term “ nivu .” Maveh references the animal’s teeth, which are covered when its mouth is closed and revealed when it eats.

    וְרַב, מַאי טַעְמָא לָא אָמַר כִּשְׁמוּאֵל? אָמַר לָךְ: מִי קָתָנֵי ״נִבְעֶה״?

    The Gemara asks: And as for Rav, what is the reason that he did not say that Maveh refers to Eating, as does Shmuel? The Gemara explains that Rav could have said to you: Is it taught in the mishna: Niveh ? Niveh is the passive form of the word maveh , which would be the appropriate form if the reference was to teeth that are revealed. The term in the mishna is maveh , an active form of the verb.

    וּשְׁמוּאֵל, מַאי טַעְמָא לָא אָמַר כְּרַב? אָמַר לְךָ: מִי קָתָנֵי ״בּוֹעֶה״?

    And as for Shmuel, what is the reason that he did not say that Maveh refers to the category of Man, as does Rav? The Gemara explains that Shmuel could have said to you: Is it taught in the mishna: Bo’eh ? Bo’eh is a form of the word maveh connoting an action taken directly, which would be appropriate were the reference to one’s actions that cause damage. The term in the mishna is maveh , which connotes an action that one causes another to take.

    מִכְּדֵי קְרָאֵי לָא כְּמַר דָּיְיקִי וְלָא כְּמַר דָּיְיקִי, רַב מַאי טַעְמָא לָא אָמַר כִּשְׁמוּאֵל? תְּנָא שׁוֹר – וְכׇל מִילֵּי דְשׁוֹר.

    The Gemara notes: After all, the meaning of the term in the verses is not precise according to one Sage, Rav, and it is not precise according to the other Sage, Shmuel. It is apparent that their dispute is not based upon their interpretation of the verses; it must be based on another issue. The Gemara asks again: As for Rav, what is the reason that he did not say that Maveh refers to Eating, as does Shmuel? The Gemara explains: Rav holds that the tanna teaches the primary category of Ox in the mishna. This includes damage caused by an ox and all matters involving damaging actions that are completed by an ox, i.e., the actions included in the categories of Goring, Eating, and Trampling. Perforce, Maveh refers to a different category of damage, i.e., Man.

    וּשְׁמוּאֵל נָמֵי, הָא תְּנָא לֵיהּ שׁוֹר! אָמַר רַב יְהוּדָה: תְּנָא שׁוֹר – לְקַרְנוֹ, וּמַבְעֶה – לְשִׁינּוֹ. וְהָכִי קָאָמַר: לֹא רְאִי הַקֶּרֶן – שֶׁאֵין הֲנָאָה לְהֶזֵּיקוֹ, כִּרְאִי הַשֵּׁן – שֶׁיֵּשׁ הֲנָאָה לְהֶזֵּיקָהּ.

    The Gemara asks: And as for Shmuel too, who interpreted Maveh as Eating, doesn’t the mishna teach the category of Ox, which should include all matters involving damaging actions that are completed by an ox? Rav Yehuda said that according to Shmuel, the tanna teaches Ox specifically with regard to damage caused with its horn, and it teaches Maveh with regard to damage caused with its tooth. And when the mishna contrasts Ox with Maveh , this is what the tanna is saying: The defining characteristic of the primary category of Goring, where there is no inherent pleasure for the animal in the course of its causing damage, is not similar to the defining characteristic of the category of Eating, where there is pleasure for the animal in the course of its causing damage.
