    דוקא מכר דהוה ליה יאוש ושינוי רשות—Specifically by a sale where there is despair and change of possession OVERVIEW The ברייתא differentiates between קרקע and מטלטלין in a case where a stolen item was sold. If it was קרקע the נגזל (שמעון) can testify on behalf the buyer (לוי) against a potential claimant (יהודה), but not by מטלטלין‎. The גמרא asked (regarding the case of קרקע), why mention a sale; the same rule can apply with the גזלן (ראובן) against the outside claimant (יהודה). The גמרא answered that regarding מטלטלין however, we require that there is a sale, for then there is יאוש ושינוי רשות, so the buyer (לוי) acquires it, however if there was no sale, the נגזל (שמעון) would not be able to testify on behalf of the גזלן (ראובן), for since the נגזל can take it from the גזלן (even if there was יאוש), he (שמעון the נגזל) is considered a נוגע בעדות‎. ----------------------------------- פירש הקונטרס וכגון שמכר ראובן ללוי שלא באחריות – The רשב"ם explained that were are discussing a case where, for instance, ראובן (the גזלן) sold the פרה וטלית to לוי without a guarantee – ונראה דפירש כן משום דאי באחריות הוי שמעון נוגע בעדות‎ – And it appears to תוספת that the reason the רשב"ם explained it so (that it was sold without אחריות), is because if it was sold with אחריות, then שמעון would be a נוגע בעדות, and could not testify on behalf of לוי against יהודה‎. תוספות explains – דאף על גב דהוי יאוש ושינוי רשות מפיק לה שמעון מלוי‎ – That even though there was יאוש ושינוי רשות (so seemingly לוי acquires this item and שמעון should not be able to take it away from him), nevertheless שמעון can remove it from לוי‎ – כיון דאין שום הפסד ללוי שיחזור על ראובן – Since לוי suffers no loss, for he can return to ראובן and be compensated for his loss – אבל בקרקע דאינה יאוש ושינוי רשות הדרא ליה‎ – However regarding land (property) [even though there is] יאוש ושינוי רשות, nevertheless it reverts back to the נגזל‎ – כדפירש הקונטרס דאין מועיל יאוש בקרקע – As the רשב"ם explained that יאוש [ושינוי רשות] is not effective by land – תוספות disagrees and question the פ"ה: וקשה לרבינו יצחק דבירושלמי (דכלאים פרק ז) אמר דיאוש מועיל בקרקע‎ – And the ר"י has a difficulty with the רשב"ם, for in תלמוד ירושלמי it states that יאוש is effective for קרקע‎ – דאף על פי שאינה נגזלת מכל מקום מהני בה יאוש – So even though קרקע cannot be stolen (and is considered always ברשות הנגזל), nevertheless יאוש is effective – וגבי עבד משמע בהשולח (גיטין דף לט, ב) דמהני ביה יאוש אף על גב דאיתקש לקרקע – And similarly regarding a slave (עבד כנעני), it seems in פרק השולח that יאוש is effective by an עבד כנעני, even though he is compared to קרקע‎ – ובשמעתין דסיקריקון (שם דף נח, ב) אומר רבינו יצחק דמוכח נמי כן‎ – And, says the ר"י that in the discussion regarding סיקריקון it is also evident that יאוש is effective (even) by קרקע‎. תוספות explains: ונראה דמיירי שלא נתייאש‎ – And it seems that the case of קרקע is where the נגזל was not מייאש‎ – תוספות responds to the obvious question: והוה מצי לפלוגי נמי בפרה וטלית בין לפני יאוש בין לאחר יאוש‎ – And the גמרא could have also differentiated by פרה וטלית itself whether it was לפני יאוש (where he cannot testify), or whether it was after יאוש (where he can testify) – אלא מילתא דשכיחא נקט דבקרקע אין רגילין להתייאש כשישראל גזלה‎ – Rather the reason he chose to differentiate between קרקע and מטלטלין is because the תנא mentions something which is common, since regarding קרקע it is not common to be מייאש, when a ישראל stole it; the reason he is not מייאש – שאם לא יוכל להוציאה מידו משום דלא ציית דינא יוציאנה מיד בנו: For the נגזל assumes that if he cannot take it away from the גזלן, for he does not obey the בית דין, I will take it away eventually from his son. SUMMARY There is a dispute between רשב"ם and תוספות whether יאוש is קונה by קרקע, or not. THINKING IT OVER תוספות writes that the גמרא could have differentiated by a פרה וטלית whether it was לפני יאוש or לאחר יאוש‎. Why did not תוספות (also) say that we could have differentiated by קרקע whether it was לפני יאוש or לאחר יאוש‎?!

    ונוקמה ביורש‎—And let us establish it by an heir Overview The גמרא explained that the case of מעיד לו עליה (by the פרה וטלית) must be where the גזלן sold it (for then there is יאוש ושינוי רשות), otherwise (if it was still in the sגזלן' possession), the rule would be אין מעיד לו עליה‎. The גמרא asks so let us establish it in a case where the גזלן died (but did not sell it) and it is now in the possession of his heir (so there is still יאוש ושינוי רשות). Our תוספות discusses whether in such a case the rule would be מעיד לו עליה‎. -------------------------------- תוספות asks: ואם תאמר והא יורש אין מעיד לו עליה דהדרא ליה כדאמר בהגוזל בתרא (בבא קמא דף קיא, ב) – And if you will say; but if it is by a יורש, the נגזל would not be able to testify for him, since it is returned to the נגזל, as the גמרא states in פרק הגוזל בתרא‎ – דכל דבר המסויים כגון פרה וטלית חייבין להחזיר מפני כבוד אביהם – That any specific item, which the heirs of a גזלן inherited, for instance a פרה וטלית, the heirs are required to return it to the נגזל, because of their father’s honor (even if there was יאוש [ושינוי רשות]) – תוספות answers: ויש לומר דהא אוקימנא בריש הגוזל קמא (שם דף צד, ב) כשעשה תשובה‎ – And one can say, that we have established in the beginning of פרק הגוזל קמא that this rule that the יורשים are required to return their father’s stolen item to the נגזל, is in a case where the father repented and wanted to return the stolen item – ולא הספיק להחזיר עד שמת והכא איירי בלא עשה תשובה: However, he did not have the opportunity to return it before he died, however here it is a case where the father did not do תשובה; in which case the יורשים are not obligated to return it (for we are not concerned for כבוד אביהם, since he did not do תשובה). SUMMARY The rule that יורשים must return items their father stole (to the נגזל), because of כבוד אביהם is only if the father did תשובה‎. THINKING IT OVER What would be the ruling if the father did תשובה and attempted to return the stolen item, however the נגזל refused to accept it from him, are the children obligated to return it to the נגזל‎?

    אלא כדרבין בר שמואל‎—Rather it is like Rovin Bar Shmuel OVERVIEW The גמרא concludes that the ברייתא of מכר לו וכו', which distinguishes between בית and פרה וטלית, is not discussing a case of גזלן but rather is teaching us the ruling of רבין בר שמואל regarding a sale of קרקע, where the seller cannot testify on behalf of the buyer against a מערער‎. Our תוספות clarifies the situation of the ברייתא and of רבין בר שמואל‎. ------------------------------ ואיירי ברייתא דוקא שלא באחריות דאז יכול להעיד על פרה וטלית – And the ברייתא, which discusses both קרקע and מטלטלין, is specifically in a case where the sale was without a guarantee, for only then can the seller testify regarding the פרה וטלית on behalf of the buyer. This is concerning the ברייתא‎ – ומילתא דשמואל איירי בכל ענין ורבותא נקט אפילו שלא באחריות: However, regarding the ruling of רבין בר שמואל in the name שמואל (which only discusses קרקע) this ruling is in all cases (whether it was sold with אחריות, or without אחריות) and he mentions a novelty that even if it was sold שלא באחריות, nevertheless the seller cannot testify on behalf of the buyer. SUMMARY The ברייתא is in cases without אחריות and in sשמואל' case it does not matter. THINKING IT OVER We understand from תוספות that if ראובן sold the קרקע to לוי even without אחריות, he cannot testify on his behalf (against יהודה), since ראובן has a vested interest that the property remain by לוי so that שמעון (the מלוה of ראובן) will have from where to collect his debt. Otherwise (if יהודה retains the property) שמעון will not have collected his debt and ראובן will be called a לוה רשע ולא ישלם (he borrowed money and did not pay it back). However if the field remains by לוי and שמעון takes it away, should not ראובן be considered a לוה רשע ולא ישלם regarding לוי, since לוי paid him money and received nothing in return. It seemingly should make no difference to ראובן who is losing out on his account; whether it is the מלוה (who is not paid back and lost his money) or whether it is the buyer (who paid money and received nothing). Why do we say that ראובן is a נוגע בעדות, what difference is there to ראובן, whether יהודה takes the field and the מלוה loses or if לוי takes the field and לוי loses on account of ראובן, since שמעון the מלוה of ראובן takes it away from him?!

    הא דאקשינן ולוקמה בגזלן וכן הא דאקשינן בסמוך ולוקמה ביורש, לאו אאוקמתא דרב ששת קא מקשה, דהא ברייתא ליכא לאוקומה לא בגזלן גופיה ולא ביורשו, דהא מכר קתני, אלא אברייתא גופא קא מהדר לברורי למה ליה לתנא דלמתניה במוכר ולא אוקמיה לדיניה בגזלן גופיה או ביורש דידיה.

    ולוקמה ביורש כלומר, ולאחר יאוש, וכמאן דאמר רשות יורש כרשות לוקח דמי, דהא איכא יאוש ושנוי רשות, וכשלא הניח להם אחריות נכסים. ואף על גב דאמרינן (ב"ק קיא, ב) הניח להם פרה וחורש בה חמור ומחמר אחריה וכל דבר המסוים חייבים להחזיר מפני כבוד אביהם, התם כשעשה תשובה, כדאיתא בפרק איזהו נשך (ב"מ סב, א).

    אבל ראובן שגזל פרה או טלית או כל דבר המיטלטל לשמעון ומכרה ללוי אחר יאוש ונמצא עכשו בה יאוש ושנוי רשות ואין פרה או טלית חוזרין לשמעון לעולם ובא יהודה וערער על לוי אם הגזלן קיים אין שמעון מעיד שהרי מ"מ ראובן חייב לו בדמיה ואם יזכה בה יהודה מן הדין תביעתו שעל ראובן נפקעת שהרי הוברר הדבר שמשל יהודה היתה ונוח לו להעיד שאינה של יהודה כדי שתעמוד מאליה ביד לוי ויזקיק את ראובן לדין לשלם לו דמיה ואם מת ראובן הגזלן יכול שמעון להעיד שהרי קנאה לוקח ביאוש ושנוי רשות ואע"פ שסתם גזלה אין בה יאוש מ"מ אתה מפרשה שנתיאש בבירור ואף דמים מיורשי הנגזל אין לו שהרי אמרו הגוזל ומאכיל את בניו או שהניח לפניהם ואכלו הם הואיל ונתיאשו הבעלים ושאין גזלה קיימת בשעת תביעת הנגזל פטורים מלשלם בשלא הניח להם אביהם אחריות נכסים כמו שביארנו במקומו:

    וְלוֹקְמַהּ בְּגַזְלָן!

    The Gemara asks: And according to the understanding of Rav Sheshet, that the baraita is disqualifying one whose field was stolen from testifying on behalf of one who purchased the field from the robber, why is it necessary to discuss a case involving a buyer, when it would be simpler to establish it with regard to testifying for the robber himself?

    מִשּׁוּם דְּקָא בָּעֵי לְמִיתְנָא סֵיפָא: מָכַר לוֹ פָּרָה, מָכַר לוֹ טַלִּית – דְּדַוְקָא מָכַר, דְּהָוֵה לֵיהּ יֵאוּשׁ וְשִׁינּוּי רְשׁוּת; אֲבָל לֹא מָכַר, דְּהָדְרָא לֵיהּ – לָא; תְּנָא רֵישָׁא נָמֵי מָכַר.

    The Gemara answers: The tanna of the baraita discusses a case involving a buyer because he wants to teach the latter clause: If he sold a cow to him, or if he sold a cloak to him, he can testify about it for the buyer. As in this clause, the tanna specifically needs to discuss a case where the robber sold it, because then it is a case of despair by the owners due to the robbery, and there is also a change in possession due to the sale, and the one who was robbed can no longer reclaim the stolen item. He is therefore no longer biased in his testimony and can testify for the one who purchased the item. But in the latter clause, if the robber did not sell it, in which case the stolen item is returned to the robbery victim, he cannot testify, as he prefers that the item be in the possession of the robber, so that he can recover it from him. Therefore, the tanna taught in the first clause as well about a case where he sold it.

    וְסֵיפָא נָמֵי – נְהִי דְּמִיָּיאַשׁ מִגּוּפַיהּ, מִדְּמֶיהָ מִי מִיָּיאַשׁ? לָא צְרִיכָא, דְּמִית גַּזְלָן – דִּתְנַן: הַגּוֹזֵל וּמַאֲכִיל אֶת בָּנָיו, וְהִנִּיחַ לִפְנֵיהֶם – פְּטוּרִים מִלְּשַׁלֵּם.

    The Gemara asks: And in the latter clause as well, where there is despair and change in possession, granted that he despairs of recovering the item itself, but did he despair of being reimbursed for its value? While it is true that he lost his ownership of the item, he is still entitled to payment. Therefore, he is still biased in his testimony. The Gemara answers: No, it is necessary in a case where the robber died, in which case the robbery victim cannot collect even the value of the stolen item, and is no longer biased in his testimony. As we learned in a mishna ( Bava Kamma 111b): In the case of one who robs another of food and feeds it to his own children, or who left a stolen item to them as an inheritance, the children are exempt from paying the victim of the robbery after their father’s death. Since he is no longer able to collect the value of the stolen item, he is not biased in his testimony and can testify on behalf of the buyer.

    וְלוֹקְמַהּ בְּיוֹרֵשׁ!

    The Gemara asks: And why not establish the entire baraita with regard to testifying for the robber’s heir? This would demonstrate the contrast that the tanna wanted to teach. In the case of a stolen field, which always must be returned to its owner, the robbery victim is biased in his testimony because the field can be recovered. Therefore, it is in his interest to establish that it is in the possession of the robber’s heirs. In the case of movable property, which cannot be recovered after the death of the robber, he is not biased in his testimony.

    הָנִיחָא לְמַאן דְּאָמַר: רְשׁוּת יוֹרֵשׁ לָאו כִּרְשׁוּת לוֹקֵחַ דָּמֵי – שַׁפִּיר; אֶלָּא לְמַאן דְּאָמַר: רְשׁוּת יוֹרֵשׁ כִּרְשׁוּת לוֹקֵחַ דָּמֵי – מַאי אִיכָּא לְמֵימַר?

    The Gemara notes: This works out well according to the one who says that the transfer of an item to the possession of an heir is not like the transfer of an item to the possession of a buyer, but is viewed as an extension of the possession of the legator. According to this opinion, it is well that the baraita did not establish its case with regard to the robber’s heir, as the robbery victim would be able to recover the item, and would be considered biased in his testimony. But according to the one who says that the transfer of an item to the possession of an heir is like the transfer of an item to the possession of a buyer, and the item is not recoverable in either case, what can be said to explain why the baraita does not state its case with regard to an heir?

    וְעוֹד קַשְׁיָא לֵיהּ לְאַבָּיֵי: מִפְּנֵי שֶׁ״אַחְרָיוּתוֹ עָלָיו״ וְ״אֵין אַחְרָיוּתוֹ עָלָיו״?! מִפְּנֵי שֶׁ״הִיא חוֹזֶרֶת לוֹ״ וְ״אֵינָהּ חוֹזֶרֶת לוֹ״ מִיבְּעֵי לֵיהּ!

    And furthermore, this explanation was difficult for Abaye to understand, as according to Rav Sheshet’s explanation, is it accurate to state, as the baraita does, that the distinction exists between the cases of land and movable property because in the first clause the financial responsibility to compensate the buyer for the land is upon him, and in the latter clause the financial responsibility to compensate the buyer for the movable property is not upon him? That is not the crucial distinction. The tanna should have taught instead that the difference is: Here he cannot testify because the stolen field returns to him, and here he can testify because the stolen item does not return to him.

    אֶלָּא כִּדְרָבִין בַּר שְׁמוּאֵל – דְּאָמַר רָבִין בַּר שְׁמוּאֵל מִשְּׁמֵיהּ דִּשְׁמוּאֵל: הַמּוֹכֵר שָׂדֶה לַחֲבֵירוֹ שֶׁלֹּא בְּאַחְרָיוּת – אֵין מֵעִיד לוֹ עָלֶיהָ, מִפְּנֵי שֶׁמַּעֲמִידָהּ בִּפְנֵי בַּעַל חוֹבוֹ.

    The Gemara offers a new explanation of the baraita : Rather, explain instead in accordance with the statement of Ravin bar Shmuel, as Ravin bar Shmuel says in the name of Shmuel: One who sells a field to another even without a guarantee that if the field will be repossessed the seller will compensate the buyer for his loss cannot testify with regard to ownership of that field on behalf of the buyer, because he is establishing the field before his creditor.

    וְדַוְקָא בַּיִת אוֹ שָׂדֶה, אֲבָל פָּרָה וְטַלִּית – לָא מִיבַּעְיָא

    The Gemara clarifies this by noting: And this is the case specifically in the case of a house or a field. But in the case of a cow or a cloak, he is not biased in his testimony, and can testify on behalf of the buyer. The Gemara explains: It is not necessary to say that this is the halakha
