טבל וחולין מעורבין זה בזה‎— Tevel and Chulin are intermingled O VERVIEW The ברייתא stated that if a ישראל and a נכרי bought a field in partnership the produce is an admixture of טבל and חולין according to רבי‎. There is a dispute between רש"י and תוספות as to the exact status of this produce and how it can be מתוקן‎. ------------------------------------- פירש בקונטרס אין לך כל חטה וחטה שאין חציה טבל וחציה חולין‎ – רש"י explained that there is no single wheat that is not half טבל and half חולין‎ – וצריך לעשר מיניה וביה ולא ממנו על טבל גמור ולא מטבל גמור עליו‎ – And so it is necessary to tithe from this mixture itself, and not to tithe from this mixture on ‘regular’ טבל, and not from טבל גמור on this mixture; the reason for this restriction – מפני שמפריש מן החיוב על הפטור ומן הפטור על החיוב – Since he is separating from grain which requires מעשר to grain which is exempt from מעשר, or from the פטור on the חיוב‎ – אבל כי מפריש מיניה וביה מעשר מן החיוב שבו על החיוב שבו‎ – However if he is מפריש from this mixture itself he is tithing from the חיוב on the חיוב contained therein – ומן הפטור שבו על הפטור שבו‎ – And from the פטור on the פטור therein – ואפילו חלקו בספקן הן עומדים דאין ברירה – And this rule applies even after the ישראל ונכרי divided the grain, their doubtful status still remains since we maintain אין ברירה‎ – In summation; according to רש"י whenever a division takes place we do not assume that each party received the half initially designated as his share, but rather each item in the inheritance (each grain, for instance) belongs half to one party and half to the other party [it is only that each party agrees to relinquish his rights in the half that the other party took]. תוספות disagrees with פרש"י: וקשה דאמר לקמן דאי קנין פירות לאו כקנין הגוף דמי והאחים שחלקו לקוחות הן – And there is a difficulty with פרש"י, for the גמרא states later, that if קנין פירות is not like קנין הגוף, and the brothers who divided the estate are buyers from each other; if we make these two assumptions – לא משכחת דמייתי בכורים אלא חד בר חד – We cannot find a case that one brings ביכורים, unless he is a single son, the son of a single son until יהושע; this is what the גמרא states, and תוספות asks – הא אפילו למאן דאמר אין ברירה יש לו בודאי חלק בו דמחייב בבכורים – However even according to the one who maintains אין ברירה, nevertheless he certainly has a portion which is obligated in ביכורים‎ – והמותר שהוא חולין מצי מקדיש ליה כדאמרינן בפרק הספינה (בבא בתרא דף פא, ב) – And the remainder which is חולין he can be מקדיש it, as the גמרא states in פרק הספינה‎ – תוספות rejects a possible resolution according to רש"י: ודוחק לומר דלא משכחת דמייתי בכורים כהלכתן שלא יצטרך להקדיש קאמר‎ – And it is difficult to say that the גמרא means that we cannot find a case that one brings ביכורים properly, without needing to be מקדיש part of it – דלישנא משמע דלא מייתי כלל קאמר – For the expression לא משכחת indicates that the גמרא means that he cannot bring it at all (even with מקדיש); the question is why not according to רש"י – תוספות has an additional question on פרש"י: ועוד בפרק יש בכור (בכורות דף מח, ב) גבי חמש סלעים ולא חצי חמש‎ – And furthermore in פרק יש בכור regarding the discussion of ‘ five סלעים but not half of five סלעים’ – קאמר דכולי עלמא אית להו דרב אסי דאמר האחין שחלקו מחצה יורשין ומחצה לקוחות – The גמרא there states that all agree with ר"א who maintains, the brothers who divided the estate are considered as half inheritors and half buyers. This concludes the citation from the גמרא there. תוספות continues – משמע אבל אי לקוחות הן פטורין אפילו למאן דאמר חמש ואפילו חצי חמש – This implies that if they are considered לקוחות they would be exempt even according to ר"י who maintains חמש ואפילו חצי חמש; the reason is – דאפילו חצי חמש ליכא – For there is even no חצי חמש‎ – תוספות offers his view: לכך נראה דאין תקנה לטבל זה דכיון דאין ברירה שמא הגיע לו כל חלקו של עובד כוכבים- Therefore it appears to תוספות that there is no way to rectify this טבל, for since we maintain אין ברירה, perhaps the ישראל received the entire portion of the עכו"ם – או חציו ולא ידעינן כמה‎ – Of half his portion, but we do not know how much of the sנכרי' portion the ישראל received – ואי מעשר מיניה וביה שמא מעשר מחלקו והשאר חלקו של עובד כוכבים – So if he will be מעשר from the produce itself, perhaps the מעשר is from his share but the rest is the sנכרי' share – או איפכא או מקצתו‎ – Or the opposite, or partially his and partially the sנכרי'. Therefore one cannot be מפריש מיניה וביה‎ – ומיהו יכול לתקנן שיפריש עליו ממקום אחר ויפריש גם עליו ממקום אחר – However he can rectify the produce by separating מעשר for it from another place – ואחרון אחרון מקולקל עד שלא ישאר כי אם מעט‎ – And each last מעשר in this progression is questionable, until there will remain only a small amount which is questionable – וכל המעשרות והתרומות יתנם לכהן וללוי: And all the מעשרות and תרומות he should give to the כהן and לוי‎. S UMMARY According to רש"י when dividing a partnership each party owns a half of each piece (grain), while according to תוספות it is indeterminable (if we maintain אין ברירה). T HINKING IT OVER 1. If we assume that if one has a קנין פירות he is מביא ואינו קורא, why does תוספות write that והמותר שהוא חולין מצי מקדיש ליה, why is there any מותיר, since he is obligated to bring even the fruits where he only has a קנין פירות‎?! 2. תוספות writes at the very end 'וכל המעשרות וכו' יתנם לכהן וללוי'. Seemingly part of this מעשר was separated מספק, why is he required to give it to the לוי, the owner should say המוציא מחברו עליו הראיה; prove that these crops where actually טבל‎?!
ולביתך מלמד שאדם מביא בכורי אשתו‎—And to your household; this teaches that a person brings his wife’s ביכורים O VERVIEW ריש לקיש maintains that if one buys a field only for the produce (קנין פירות) he is not obligated to being ביכורים‎. ר' יוחנן asked on ר"ל that the ברייתא states that a man can bring his wife’s ביכורים (since the תורה writes ולביתך). A husband only has קנין פירות in his wife’s property, so how can he bring her fruits as ביכורים‎? Our תוספות clarifies this question. ------------------------ תוספות asks: ואם תאמר והא מן התורה אין לבעל פירות בנכסי אשתו אלא תקנתא דרבנן בעלמא היא‎ – And if you will say; but מה"ת the husband has no rights to the פירות of his wife’s assets, rather it is a Rabbinic enactment that he ‘eats’ the פירות – אם כן על כרחך גזירת הכתוב הוא – Therefore perforce we must say that it is a special decree of the תורה, that he can bring his wife’s ביכורים, so what is the question on ר"ל‎?! תוספות answers: ויש לומר דרך נשים שנותנות פירות לבעליהן וכי האי גוונא איירי קרא – And one can say; that it is common among women to give their fruits (of their assets) to their husbands, and the פסוק of ולביתך is discussing such a case – וכענין זה אמרינן בריש קידושין (דף ד, א) אי כתב רחמנא מעשה ידיה לאביה דקא מיתזנא מיניה‎ – And the גמרא says a similar thing in the beginning of מסכת קידושין; ‘if the תורה would have just written that her handiwork belongs to the father, I would say that this is because she is fed by him’ this concludes the citation from that גמרא‎ – ואף על גב דמדאורייתא אינו חייב במזונות בתו אלא דאורחא דמילתא הוא שהוא זן אותה: But even though that מה"ת a father is not obligated to feed his daughter, nevertheless since the usual manner is that he feeds her, therefore we can assume that is the reason the תורה granted him מעשה ידיה‎. S UMMARY The תורה may incorporate the customs of the people as a basis for certain תורה rules even though the custom is not obligatory עפ"י תורה‎. T HINKING IT OVER It appears from תוספות that a husband may bring his wife’s ביכורים only if she gives him her פירות‎. However by מעשה ידיה it seems that in all cases the father receives מעשה ידיה, even in cases where he is not feeding her. Why the difference?
מתה אין לא מתה לא‎—She died, yes; she did not die, no O VERVIEW Previously ר' יוחנן brought a ברייתא (based on the פסוק of ולביתך), which indicated that קנין פירות is כקנין הגוף‎. Subsequently ר"ל asked a question on ר"י from the ברייתא of מתה אשתו which indicates that קנין פירות is לאו כקנין הגוף‎. Our תוספות explains the nature of this latter question. --------------------------- תוספות asks: ואם תאמר מאי קושיא דרבי יוחנן דאמר כתנא דלביתך דמה נפשך פליג – And if you will say; what is the question of ר"ל, since ר"י can follow the תנא of the ברייתא of לביתך, for in any event the two ברייתות of לביתך and מתה argue with each other?! תוספות answers: ויש לומר דאיכא לאוקמה במתה כי הך‎ – And one can say that we can establish the ברייתא of לביתך (which seemingly indicates כקנין הגוף דמי) in a case of מתה like this ברייתא of מתה, so the ברייתות do not necessarily conflict, which makes ר"ל question understandable. תוספות has an additional question: ואם תאמר ולישני דהך דמתה בשלא זכתה האשה פירות נכסיה לבעל‎ – And if you will say; so let ר"י answer that this ברייתא of מתה is in a case where the woman did not transfer the פירות of her assets to her husband in which case he does not even have קנין פירות, therefore he cannot bring them as ביכורים‎ – תוספות answers: ויש לומר דברייתא קתני אף בתר דתקון רבנן פירות לבעל‎ – And one can say; that the ברייתא of מתה was taught even after the רבנן enacted that the פירות of the wife belong to the husband so he has a קנין פירות and nevertheless he can only be מביא וקורא if she died, but not when she is alive – תוספות offers another answer to his question why we cannot establish the ברייתא where she was not מזכה to him her פירות: ועוד דהוה ליה כקונה פירות בשוק ואחר כך קנה שדה דאינו קורא – And additionally if she was not מזכה her פירות to him, he merely took them and then she died, it is like one who buys fruit in the market and then he bought the field where these fruits grew, where the rule is that he cannot be קורא‎ – כדאמרינן במסכת בכורים (פ"א) – As the גמרא [in תלמוד ירושלמי] states in מסכת בכורים‎ – תוספות responds to an anticipated difficulty: אבל לריש לקיש שהיו לו פירות תחילה אתי שפיר‎ – However according to ר"ל that he had the פירות initially it is properly understood – דבמתה מביא וקורא כיון דמעיקרא אגיד בה לפירות: That when she died he is מביא וקורא since initially he was attached to the field through the פירות‎. S UMMARY The two ברייתות do not necessarily conflict. The ברייתא of מתה is after the רבנן gave him her פירות‎. If the woman was not מזכה her פירות, the husband cannot be קורא even after she dies. Even according to ר"ל, if she was מזכה the פירות then he may be מביא וקורא after she dies. It is not like קונה פירות ואח"כ שדה‎. Since he had a vested interest. T HINKING IT OVER In the first question תוספות writes, 'ומאי קושיא' (but not 'ולישני'); however in the second question תוספות writes 'ולישני' (but not 'ומאי קושיא'); why the different expressions?!
בצרן ושיגרן ביד שליח‎—He harvested them and sent them in the hand of an agent O VERVIEW ר' יוסי בר חנינא stated in a ברייתא that if he harvested the produce and sent it for ביכורים through a שליח and the שליח died on the way to ירושלים, the rule is that the master may bring these ביכורים to ירושלים but he does not read פרשת ביכורים, because the תורה writes ולקחת והבאת that the taking and the bringing must be as one. -------------------------------- פירוש רבינו שמואל בהספינה (בבא בתרא פא, ב) בצרן הבעל ושגרן ביד שליח‎ – The רש ב"ם explains in פרק הספינה; the owner harvested them and sent it through a שליח‎ – דאם בצרן שליח והביאן השליח בירושלים שליח ודאי אין יכול לקרות‎ – For if the שליח harvested it and the שליח brought it to ירושלים, the שליח certainly cannot read פרשת ביכורים‎ – כדתנן במסכת בכורים (פרק א' משנה ה') – As the משנה teaches in מסכת בכורים, for he cannot say אשר נתת לי ה' – אבל הבעלים קורין דיכולין לומר הנה הבאתי דשלוחו של אדם כמותו – However if the שליח both harvested and brought the ביכורים, the owners could read, for they can say, ‘behold I brought’ since one’s agent is considered as himself – תוספות disagrees with the רשב"ם: וקשה לרבינו תם למאי דחשיב לבצירה לקיחה למה ליה למימר ומת שליח – And the ר"ת has a difficulty with this רשב"ם, for according to the רשב"ם who considers the בצירה to be the לקיחה, why did ריב"ח need to say, ‘and the שליח died’ – הוה ליה למתני בצרן הוא ושגרן ביד השליח או שבצרן שליח והביאן הוא‎ – He could have said, ‘and the owner harvested them and sent them with the שליח’, or he could have said, ‘ the שליח harvested them and he brought it’; in these two cases he is מביא ואינו קורא since we require לקיחה והבאה כאחד – תוספות answers (according to שיטת הרשב"ם): ויש לומר דאשמועינן רבותא דאף על גב דמת שליח וגמרו הבעלים הבאה‎ – And one can say; that ריב"ח is informing us of a novelty that even though the שליח died and the owner completed the הבאה‎ – דאיכא לקיחה ומקצת הבאה בבעלים אפילו הכי אינו קורא דבעינן לקיחה וכל הבאה באחד‎ – So there is לקיחה בבעלים, and a partial הבאה בבעלים, and nevertheless he is not קורא, for we require the לקיחה and the entire הבאה כאחד, but here part of the הבאה (which the שליח brought) was not כאחד‎ – תוספות offers another answer for the רשב"ם – ואי גרסינן או מת אתי נמי שפיר וזו אף זו קתני‎ – And if the text reads 'או מת' (instead of ומת) it will also be understood, and the ברייתא is teaching us in a manner of this (without מת) and even this (when מת) – תוספות offers an alternate explanation as to the nature of לקיחה: ורבינו תם מפרש דבצירה לאו היינו לקיחה ובצרן אורחא דמילתא נקט‎ – And the ר"ת )who asked on the רשב"ם) explains that בצירה is not the same as לקיחה, and ריב"ח mentioned ‘ובצרן’, as an aside – שבעלים בוצרים כדי לעשות בעין יפה לפי שאין שיעור לבכורים‎ – Since the owners harvest the ביכורים in order to give the ביכורים with a ‘good eye’, since there is no requisite amount for ביכורים, so to ensure that it is a fitting amount the owners do not trust their workers but rather do it themselves, but it is not לקיחה‎ – ולקיחה היינו לקיחה מתוך הבית‎ – And the 'לקיחה' of ריב"ח that refers to taking the ביכורים out from the house – וחדא קתני בצרן ושגרן ביד השליח ומת שליח בדרך דאז הוא רגילות שמביאן אחר‎ – And the ברייתא is teaching one case; ‘ he harvested it ( not relevant) and sent it with the שליח (at this point the לקיחה and the [partial] הבאה was כאחד [by the שליח]) and the שליח died on the way’, in which case it is usual that another person (שליח) brings it – ולא הוי לקיחה והבאה באחד: So therefore it is not לקיחה והבאה כאחד (since two שלוחים were involved in the הבאה). S UMMARY According to the רשב"ם the לקיחה is the בצירה, while according to the ר"ת the לקיחה is taking it out from the house. T HINKING IT OVER 1. According to the רשב"ם that we say שלוחו של אדם כמותו, so even if the לקיחה was done by the בעלים (בצרן), and the הבאה by the שליח, it should be considered לקיחה והבאה כאחד, since שלוחו של אדם כמותו‎?! 2. According to the ר"ת, can the בעלים be קורא, when there is only one שליח (since שליח של אדם כמותו); two שלוחים‎?
מביא ואינו קורא‎—He brings, but does not read Overview ריב"ח taught that we require לקיחה והבאה כאחד, and if it is not כאחד the rule is מביא ואינו קורא‎. Our תוספות has some difficulty with this ruling. ----------------------------------- תוספות asks: ואם תאמר ונימא ירקבו כדאמרינן בפרק בתרא דמכות (דף יח, ב) – And if you will say; but let us say that the ביכורים should rot, as ר' אלעזר אמר ר' אושעיא says in the last פרק of מסכת מכות‎ – הפריש בכורים קודם החג ועבר עליהן החג ירקבו משום דנראו לקריאה ונדחו‎ – ‘He separated ביכורים before the holiday of סוכות, and the holiday passed, they should rot’, since initially these ביכורים were fit for ‘reading’ and were pushed away. The גמרא there continues – וכל שאין ראוי לבילה בילה מעכבת בו והכא נמי כשבצרן נראו לקריאה וכששיגרן נדחו – For anything which is not fit for mixing, the lack of mixing prevents it from being acceptable’, so, תוספות asks, here too when he harvested them they were fit for קריאה and when he sent them with the שליח they were pushed aside – תוספות answers: ויש לומר דאמר בירושלמי דמסכת בכורים (פרק א' הלכה ה') – And one can say; that it says in תלמוד ירושלמי on מסכת בכורים‎ – רבי אסי אמר ריש לקיש בשם רבי אושעיא כשליקטן לשלחן ביד אחר‎ – ר"א said that ר"ל said in the name of ר"א; when he gathered the produce for ביכורים with the intent to send them with someone else, only then can he send them with a שליח (an it will be מביא ואינו קורא) – אבל אם לקטן להביאן הוא לא ישלחם ביד אחר – However if he gathered them with the intent that he will bring them to ירושלים, he should not send them with someone else – שכל הבכורים שנראו לקריאה אין ניתרין אלא בקריאה‎ – For all ביכורים which were fit for קריאה cannot be ‘permitted’ (to be eaten by the כהן) only with קריאה‎ – ואמרינן התם מתניתין פליגא הפריש בכורים ומכר שדהו מביא ואינו קורא – And the ירושלמי asks there; it seems that our משנה argues with ר"א, for the משנה states; ‘ he separated ביכורים and sold his field, he brings but does not read’ – קיימנוה כשנתן דעתו למכור משעה ראשונה – The ירושלמי answers; we have established that משנה that he intended to sell his field from the first hour (before he harvested), therefore it was never נראה‎ – ולפי זה אם הפריש בכורים קודם החג על מנת להביאן אחר החג לא ירקבו‎ – So according to this (regarding the rule of ר"א) if he separated ביכורים before סוכות with the intention to bring them after סוכות (so it was never נראה), they are not left to rot – אלא אחר החג מביא ואינו קורא: Rather after סוכות he is מביא ואינו קורא‎. S UMMARY ביכורים which were fit to be מביא וקורא and then they were not fit to be קורא, they are left to rot; however if they were never fit to be קורא (either because he planned to send them with a שליח, or he intended to bring them after סוכות) the rule is מביא ואינו קורא‎. T HINKING IT OVER תוספות writes )from the ירושלמי) that if at time of the לקיטה he intends to send it with a שליח the rule is מביא ואינו קורא, since it was never נראה‎. However previously תוספות said that if the שליח brought it, the בעלים can be מביא וקורא (and it is considered לקיחה והבאה כאחד), since שלוחו של אדם כמותו‎. Why therefore does the ירושלמי state that he is מביא וקורא, seemingly it was נראה ונדחה‎?!

טבל וחולין מעורבבין זה בזה פירש רש"י ז"ל אין לך כל חטה וחטה שאין מחציתה טבל ומחציתה חולין ואם בא לתרום לעשר מיניה וביה מעשר משלם ונמצא מעשר מן החיוב שבו על החיוב שבו ומן הפטור שבו על הפטור שבו ואם בא לעשר עליו ממקום אחר מעשר כנגד מחציתו. והקשו עליו בתוספות דאם כן מאי קאמרינן לקמן [גיטין מח, א] אי לאו דאמר רבי יוחנן קנין פירות כקנין הגוף דמי לא מצא ידיו ורגליו בבית המדרש דאמר רבי אסא אמר רבי יוחנן האחין שחלקו לקוחות הן ומחזירין זה לזה ביובל, ולא משכחת לה דמייתי ביכורים אלא חד בר חד עד יהושע בן נון, ואם כדברי רש"י ז"ל אפילו לרבי יוחנן דאית ליה אין ברירה ולקוחת הוו ומחזירין ביובל מכל מקום חלק ירושתו יש לו בהן ומביא חלקו ואף לפי שהשאר הוו חולין הרי [בנדפס: הוא] יכול להקדיש וכדאיצטרכינן למימר לריש לקיש במוכר שדהו לפירות כדאיתא בפרק המוכר את הספינה. וכי תימא דהכא הכי קאמר לא משכחת דמייתי בכורים כהלכתן בלא הקדש, הא ליתא, דאם כן הוה ליה לפרושי הכין בהדיא ולא לימא לא משכחת דמייתי ביכורים דמשמע דלא משכחת דמייתי בכורים כלל, אלא שמע מינה דלמאן דאמר אין ברירה ולקוחות הן לא חשבינן לה במה שהגיע לחלקו עכשיו כיורש כלל לא בכולו ולא במחציתו. והכין נמי מוכח בבכורות בפרק יש בכור לנחלה [מח, ב] גמרא מי שלא בכרה אשתו וילדה שני זכרים. ולפיכך פירשו בתוספות טבל וחולין מעורבין זה בזה, דלא הוברר חלקו של ישראל כלל ושמא הגיע לו כל חלקו של נכרי או מחציתו או פחות או יותר ולפיכך למאן דאמר אין ברירה ולקוחות הוו ומחזירין זה לזה ביובל וקבר נמי קנין פירות לאו כקנין הגוף לא משכחת דמייתי ביכורים כלל מדאורייתא אלא חד בר חד עד יהושע והכא נמי לית ליה תקנה לתקוני מיניה וביה דדילמא מה שיפריש הוא מחלקו של נכרי ונמצא מפריש מן הפטור על החיוב וממקום אחר לא יוכל להפריש דדילמא כל מה שהגיע לו הוי מחלקו של נכרי ונמצא מפריש מן החיוב על הפטור. מיהו אין לו תקנה עד שיפריש עליו ממקום אחר ואיהו מתוקן ממה נפשך אבל המעשרות מקולקלין ואותן המעשרות יש להן כמו כן תקנה שיפרש עליהן ממקום אחר אבל יצטרך ליתנן לכהן וכן יעשה עד שלא ישאר כי אם מעט.
ולביתך מלמד שאדם מביא בכורים מאשתו וקורא ואם תאמר והלא אכילת פירות נכסי מלוג לאו דאורייתא אלא דרבנן ואתיא קרא לחיובי קריאה בתקנתא דרבנן. ויש לומר דהכי אתא קרא לאשמועינן שאם תקנה אשה פירות נכסיה לבעלה שיהא הבעל מביא וקורא ודברה תורה בהן לפי שרגילות הנשים לתת פירות נכסיהן לבעליהן, ויש אומרים שהתנו מתחלה שיאכל הוא פירות נכסי מלוג שלה וזהו מהר [בנדפס: ומתן] הכתוב בתורה, וכמו שאמרו במדרש מהר פירא ומתן פראפורנין והוא נכסי מלוג.
מתה אין לא מתה לא ואיכא למידק דהא משמע דהאי ברייתא פליגא אההיא דלוביתך, ואם כן לימא רבי יוחנן אנא דאמרי כאידך תנא דולביתך. ונראה לי דאין הכי נמי אלא שלא רצה רבי יוחנן להעמיד דבריו בתנאי [בנדפס: כתנאי] וריש לקיש נמי כי אקשינן ליה מהנך מתנייתא לא אמר אנא דאמרי כתנא דמתה אשתו דלא בעי חד מינייהו לאוקמי מימריה בתנאי [כתנאי]. ובתוספות תירצו דהכי קא מקשה מתה אין לא מתה לא ומינה דברייתא דלביתך במתה דוקא, ואם תאמר אם כן מאי קא אתא קרא דולביתך לאשמועינן, יש לומר דההיא בשמתה לאחר קצירה ותחלת הבאה וקא משמע לן חדושא דאף על גב דקצירה ותחלת הבאה לא כדאי [בנדפס: נראו] לקריאה אפילו הכי מביא וקורא. ואינו מחוור בעיני, דהיאך אפשר לומר כן והא רבי שמעון בן לקיש עצמו אמר לעיל דולביתך חדוש הוא וכדקאמר שאני התם דכתיב ולביתך אלמא התם קנין פירות הוא אלא שחדש בו הכתוב ועשאו כקנין הגוף ואי מתה קנין הגוף אית ליה בגוה, וכי תימא משום דבשעת קצירה ותחלת הבאה לא היה לו בהקנין הגוף אלא קנין פירות אם כן מאי קא מקשה הכא מינה לרבי יוחנן מתה אין לא מתה לא דמשמע דמתה לבסוף חשיב כקנין הגוף, והא איהו הוא דמודה בה לעיל דהא אינו אלא כקנין פירות. והראשון נראה לי עיקר.

ישראל וגוי שלקחו שדה בשותפות וחלקו התבואה הרי כלה טבל וחלין מעורבין ואפי' אותה שביד גוי ואין אומרין הוברר הדבר שזו של ישראל וזו של גוי אלא כל גרעין מהם מעורבין ובסוריא מיהא הואיל ומדברי סופרים הוא יש ברירה וחלק ישראל חייב חלק גוי פטור אפי' לקחם ישראל וברירה זו יש מפרשים בה הוברר הדבר שזה גדל בחלקו של ישראל וזה בחלקו של גוי וקשה לפרש דהלא יש בשבולת אחת כמה חטים והיאך מתברר במה גדל זה ובמה גדל זה ואף בשבלים קשה לפרשה שהרי גרעין אחד מעלה כמה שבלים ומתוך כך מפרשים אותה בשחלקו בקמתה והוא שאמרו בתלמוד המערב שבמסכת דמאי פרק ששי במה פליגין כשחלקו שדה בקמתה אבל גדיש כנגד גדיש אף רשב"ג מודה לר' שכל קלח וקלח שתפות הוא וכן כתבוה גדולי המחברים:

כל שאדם מביא בכורים מנכסי אשתו אפי' היה בא בדרך ובכורי אשתו בידו ושמע שמתה אשתו מביא וקורא ושמא תאמר ולאו כל דכן הוא שהרי עכשו ירשם והם שלו מכל מקום שמא היית סביר לומר בזו שלא לקרות מפני שאין הלקיחה וההבאה כאחד שמתחלה היה בהבאתם כעין שליח ועכשו הן שלו וכבר אמרו בצרן בעל הבית ושגרן ביד שליח ומת שליח בדרך מביא ואינו קורא שנאמר ולקחת והבאת עד שתהא לקיחה והבאה באחד ואין צריך לומר אם הביאם השליח שאינו קורא אלא אפי' הביאם בעל הבית הואיל וביד השליח היו בדרך והוא הדין בלא מת שליח אלא שלקחם בעל הבית מידו משהתחיל להביאם ויש מפרשים דוקא בצרם שליח אבל בצרם בעל הבית והוליכם לשליח והביאם שליח ומת בדרך מביא וקורא שהרי לקיחה והבאה בבעלים ונמצא שהם מפרשים הבצירה לקיחה ומכל מקום לדעתנו הבצירה אינה קרויה לקיחה אלא כשלוקחם כדי להביאם ואם בצר האב ומת בנו מביא וקורא שמ"מ בצירה והבאה בבעלים:

טֶבֶל וְחוּלִּין מְעוֹרָבִין זֶה בָּזֶה, דִּבְרֵי רַבִּי. רַבָּן שִׁמְעוֹן בֶּן גַּמְלִיאֵל אוֹמֵר: שֶׁל גּוֹי – פָּטוּר, וְשֶׁל יִשְׂרָאֵל – חַיָּיב.
the produce grown in that field is considered to be untithed produce and non-sacred produce mixed together; this is the statement of Rabbi Yehuda HaNasi. Rabban Shimon ben Gamliel says: The portion of the gentile is exempt from terumot and tithes, and the portion of the Jew is obligated.
עַד כָּאן לָא פְּלִיגִי אֶלָּא דְּמָר סָבַר ״יֵשׁ בְּרֵירָה״. וּמַר סָבַר ״אֵין בְּרֵירָה״; אֲבָל דְּכוּלֵּי עָלְמָא – יֵשׁ קִנְיָן לְגוֹי בְּאֶרֶץ יִשְׂרָאֵל לְהַפְקִיעַ מִיַּד מַעֲשֵׂר!
The Gemara explains the inference: They disagree only with regard to the following issue: That one Sage, Rabban Shimon ben Gamliel, holds that there is retroactive clarification, i.e., when they divide the produce, it will be clarified who owned what produce from the outset. And one Sage, Rabbi Yehuda HaNasi, holds that there is no retroactive clarification, and therefore, since it grew in a mixed state, it retains that status even after they divide the produce. However, everyone agrees that a gentile has the capability of acquisition of land in Eretz Yisrael to cause the abrogation of the sanctity of the land, removing it from the obligation to tithe its produce, as the gentile’s portion is considered to be non-sacred produce.
הָכָא נָמֵי בְּסוּרְיָא; וְקָסָבַר כִּיבּוּשׁ יָחִיד לָא שְׁמֵיהּ כִּיבּוּשׁ.
The Gemara answers: Here, also, it is referring to a case in Syria, and he holds that the conquest of an individual is not called a conquest, and a gentile has the capability of acquisition of land in Syria to cause the abrogation of the sanctity of the land.
אָמַר רַב חִיָּיא בַּר אָבִין, תָּא שְׁמַע: הַמּוֹכֵר שָׂדֵהוּ לְגוֹי – לוֹקֵחַ וּמֵבִיא בִּיכּוּרִים מִפְּנֵי תִּיקּוּן הָעוֹלָם. מִפְּנֵי תִּיקּוּן הָעוֹלָם – אִין, מִדְּאוֹרָיְיתָא – לָא!
Rav Ḥiyya bar Avin said: Come and hear a proof from the mishna: One who sells his field to a gentile must purchase and bring the first fruits from the field that he sold, for the betterment of the world. Rav Ḥiyya bar Avin infers: For the betterment of the world, yes, he must bring the first fruits; however, by Torah law, no, he is not required. This teaches that the acquisition of a gentile causes the abrogation of the sanctity of the land.
אָמַר רַב אָשֵׁי: שְׁתֵּי תַּקָּנוֹת הֲווֹ – מֵעִיקָּרָא הֲווֹ מַיְיתִי מִדְּאוֹרָיְיתָא; כֵּיוָן דַּחֲזוֹ דְּקָא מִקְּרִי וּמְזַבְּנִי, דְּסָבְרִי בִּקְדוּשְׁתַּיְיהוּ קָיְימָן, תַּקִּינוּ לְהוּ דְּלָא לַיְתוֹ;
Rav Ashi said: There were two ordinances concerning this issue. Initially, those who sold their fields to gentiles would bring first fruits by Torah law, as they held that the acquisition of a gentile does not abrogate the sanctity of the land. Once the Sages saw that the Jews would sell their land to gentiles when they had the opportunity, because these Jews thought that the fact that the Jew would still have to bring the first fruits indicates that the land retains its sanctity, and therefore there is no reason not to sell the land to gentiles, they instituted for those who sell land to gentiles that they should not bring the first fruits, to emphasize that the land should not be sold to gentiles. This was the first ordinance.
כֵּיוָן דַּחֲזוֹ דְּמַאן דְּלָא סַגִּי לֵיהּ – מְזַבֵּן, וְקָא מִשְׁתַּקְּעָן בְּיַד גּוֹיִם, הֲדַר תַּקִּינוּ לְהוּ דְּלַיְתוֹ.
Once the Sages saw that those who were not able to subsist would sell their land despite this ordinance, and the fields would remain in the possession of the gentiles and would not be redeemed, they went back and instituted that they should bring the first fruits in order to penalize the seller, to encourage him to repurchase the field. This was the second ordinance. Therefore, one cannot prove from the mishna whether or not the acquisition of a gentile abrogates the sanctity of the land.
אִיתְּמַר: הַמּוֹכֵר שָׂדֵהוּ לְפֵירוֹת, רַבִּי יוֹחָנָן אָמַר: מֵבִיא וְקוֹרֵא. רֵישׁ לָקִישׁ אָמַר: מֵבִיא וְאֵינוֹ קוֹרֵא.
§ It was stated: With regard to one who sells his field for just its produce, meaning that he retains ownership over the field itself and he sells the rights to all of its produce to someone else, Rabbi Yoḥanan says: The purchaser brings first fruits from this field to the Temple and recites the verses in the Torah associated with the bringing of the first fruits, in which he thanks God for: “The land which You, Lord, have given me” (Deuteronomy 26:10). Reish Lakish says: Although the buyer brings the first fruits, he does not recite the verses, since it is not his field.
רַבִּי יוֹחָנָן אָמַר מֵבִיא וְקוֹרֵא – קִנְיַן פֵּירוֹת כְּקִנְיַן הַגּוּף דָּמֵי. רֵישׁ לָקִישׁ אָמַר מֵבִיא וְאֵינוֹ קוֹרֵא – קִנְיַן פֵּירוֹת לָאו כְּקִנְיַן הַגּוּף דָּמֵי.
The Gemara explains the reason behind the dispute: Rabbi Yoḥanan says he brings the first fruits and recites the verses because he maintains that the acquisition of an item for its produce is considered to be like the acquisition of the item itself. Even though the field itself does not belong to him, it is as if he acquired the field because all of the produce belongs to him in practice. Reish Lakish says that he brings the first fruits and does not recite the verses because he holds that the acquisition of an item for its produce is not considered to be like the acquisition of the item itself.
אֵיתִיבֵיהּ רַבִּי יוֹחָנָן לְרֵישׁ לָקִישׁ: ״וּלְבֵיתְךָ״ – מְלַמֵּד, שֶׁאָדָם מֵבִיא בִּיכּוּרֵי אִשְׁתּוֹ, וְקוֹרֵא.
Rabbi Yoḥanan raised an objection to Reish Lakish from a baraita concerning the bringing of first fruits, as the verse states: “And you shall rejoice in all of the good that the Lord your God has given to you and to your house” (Deuteronomy 26:11). The phrase “your house” often refers to a wife. Therefore, the Sages said: This teaches that a man brings his wife’s first fruits, and he recites the relevant verses. This is true despite the fact that a husband acquires the field of his wife only for the produce. It seems from this baraita that the acquisition of a field’s produce is considered to be like the acquisition of the field itself.
אֲמַר לֵיהּ: שָׁאנֵי הָתָם, דִּכְתִיב ״וּלְבֵיתֶךָ״.
Reish Lakish said to him: It is different there, as it is written explicitly: “And to your house,” which teaches that with regard to first fruits, there is a scriptural decree that a field belonging to one’s wife is also included in the mitzva. This does not prove that in general the acquisition of a field’s produce is considered to be like the acquisition of the field itself.
וְאִיכָּא דְּאָמְרִי: אֵיתִיבֵיהּ רַבִּי שִׁמְעוֹן בֶּן לָקִישׁ לְרַבִּי יוֹחָנָן: ״וּלְבֵיתֶךָ״ – מְלַמֵּד, שֶׁאָדָם מֵבִיא בִּיכּוּרֵי אִשְׁתּוֹ וְקוֹרֵא – הָתָם הוּא דִכְתִיב ״וּלְבֵיתֶךָ״, אֲבָל בְּעָלְמָא – לָא! אֲמַר לֵיהּ: טַעְמָא דִּידִי נָמֵי מֵהָכָא קָאָמֵינָא.
And there are those who say that they had a different exchange: Rabbi Shimon ben Lakish raised an objection to Rabbi Yoḥanan from that baraita : It is written: “And to your house,” which teaches that a man brings his wife’s first fruits, and he recites the relevant verses. Reish Lakish infers from this: There, it is that he brings the first fruits and recites the verses despite having acquired only the rights to the produce from his wife’s field, as it is written explicitly: “And to your house”; but generally, no, one who acquired only a field’s produce would not recite the verses. Rabbi Yoḥanan said to him: I also state my reason from here, as I see the halakha of a man bringing the produce from his wife’s field not as an exception, but as the source for the general principle that the acquisition of a field’s produce is considered to be like the acquisition of the field itself.
אֵיתִיבֵיהּ: הָיָה בָּא בַּדֶּרֶךְ וּבִיכּוּרֵי אִשְׁתּוֹ בְּיָדוֹ, וְשָׁמַע שֶׁמֵּתָה אִשְׁתּוֹ – מֵבִיא וְקוֹרֵא. מֵתָה – אִין, לֹא מֵתָה – לָא!
Reish Lakish raised an objection to Rabbi Yoḥanan based on a baraita : If he was traveling on the road to Jerusalem and the first fruits of his wife’s field were in his possession, and he heard that his wife died, then he brings the first fruits and recites the verses. One can infer: If she died, yes, he brings the fruits and recites the verses, as he has now inherited the field itself; but if she did not die, then no, he does not recite the verses, because acquisition of a field’s produce is not considered to be like the acquisition of the field itself.
הוּא הַדִּין דְּאַף עַל גַּב דְּלֹא מֵתָה; וּמֵתָה אִצְטְרִיכָא לֵיהּ – סָלְקָא דַּעְתָּךְ אָמֵינָא לִיגְזוֹר מִשּׁוּם דְּרַבִּי יוֹסֵי בַּר חֲנִינָא –
The Gemara answers: The same is true in that case, that even though she did not die he also brings the fruits and recites the verses, but it was necessary for the baraita to mention the possibility that she died, because it might enter your mind to say that there should be a rabbinic decree in this case due to the statement of Rabbi Yosei bar Ḥanina concerning a similar halakha .
דְּאָמַר רַבִּי יוֹסֵי בַּר חֲנִינָא: בְּצָרָן, וְשִׁגְּרָן בְּיַד שָׁלִיחַ, וּמֵת שָׁלִיחַ בַּדֶּרֶךְ – מֵבִיא וְאֵינוֹ קוֹרֵא, שֶׁנֶּאֱמַר: ״וְלָקַחְתָּ״–״וְהֵבֵאתָ״ – עַד שֶׁתְּהֵא לְקִיחָה וַהֲבָאָה בְּאֶחָד; קָא מַשְׁמַע לַן.
As Rabbi Yosei bar Ḥanina says: If one harvested his first fruits and sent them in the possession of an agent, and the agent died on the way, then someone else brings the fruits but does not recite the verses, as it is stated: “And you shall take…and you shall bring” (see Deuteronomy 26:2–3), and this juxtaposition teaches that the verses are not recited until the taking and bringing will be accomplished by one person. One might have said that since the husband took the fruits as the owner of the fruits alone and not the field, as the field was owned by his wife, and then he became the owner of the field as well and is bringing the fruits as the full owner, he should not recite the verses. Therefore, the baraita teaches us that he is considered to be the full owner before his wife’s death, because the acquisition of a field’s produce is considered to be like the acquisition of the field itself.
וְאָזְדוּ לְטַעְמַיְיהוּ, דְּאִיתְּמַר: הַמּוֹכֵר שָׂדֵהוּ
