לאיזו שארצה אגרש בו פסול‎—I will divorce with it whichever one I want, it is invalid O VERVIEW The משנה states if a person (who has two wives with the same name) says to a scribe ‘write a גט for me, and I will use it to divorce whichever one of my wives that I will decide’; the גט is פסול‎. Our תוספות broadens this ruling. -------------------------------- בגמרא מפרש משום דאין ברירה – The גמרא explains the reason for this ruling because there is no concept of ברירה‎ – ואומר רבינו יצחק דאפילו מאן דסבר בעלמא יש ברירה הכא מודה‎ – And the ר"י states that even according to the one who maintains elsewhere that יש ברירה, nevertheless here he will admit that אין ברירה by a גט‎. תוספות explains – משום דוכתב לה לשמה משמע שיהא מבורר בשעת כתיבה‎ – Because the פסוק of וכתב לה, from which we derive that a גט needs to be written לשמה, indicates that it needs to be specified at the time of writing, who is being divorced – וכן משמע בגמרא דקאמר אי איתמר בהא בהא קאמר רבי יוחנן דאין ברירה‎ – And so it seems from the גמרא where it states, ‘if it would be taught (that ר"י maintains אין ברירה) in this case (of גט), we could think that only in this case does ר"י maintain אין ברירה, but not in other cases (inheritance), for this case is different – משום דבעינן לה לשמה‎ – Because we require לה לשמה’, therefore ברירה is ineffective (however in other cases he could maintain יש ברירה). This concludes the citation from the גמרא‎ – משמע אף על גב דבעלמא יש ברירה הכא פסול משום דכתיב וכתב לה: Indicating that even if we maintains generally יש ברירה, nevertheless here by גט it would be פסול (in a ברירה case) since the תורה wrote 'וכתב לה'. S UMMARY Even those who maintain יש ברירה will agree that by גט it is אין ברירה since the תורה writes וכתב לה‎. T HINKING IT OVER זעירי and רב אסי argue on ר"י (who maintains אין ברירה) and maintain that in the last case (of האומר ללבלר) she is פסול לכהונה, indicating they hold יש ברירה (regarding פסול כהונה), but nevertheless the גט is פסול and she is still married; proving that even though זעירי ורב אסי maintains אין ברירה, but regarding the כשרות of a גט we say אין ברירה‎. Why did not תוספות use this proof?!
בעדי מסירה ורבי אלעזר היא‎—With the transferring witnesses and it is according to Rabi Elozor O VERVIEW The גמרא concluded, based on the inference from our משנה that if a man has two wives with the same name, he may be מגרש one of them (even though that from the גט, it is not evident which wife he is מגרש), that our משנה follows the view of ר"א that ע"מ כרתי, and therefore since the ע"מ see which wife he is divorcing, it is a proper גט‎. ---------------------------- אבל לרבי מאיר בעינן שיהא מוכח מתוך החתימה שנכתב לשם זה האיש ואשה זו‎ – However according to ר"מ (who maintains עדי חתימה כרתי) he cannot divorce either wife, because we require that it should be evident from the signature that this גט was written for the sake of this man and this woman, and it is not evident from the signed גט for which wife it was written – ולא מהני עדי מסירה – And the ע"מ will not help to establish the לשמה, because we need it to be מוכח מתוך הגט, which was signed by the ע"ח. תוספות anticipates a difficulty: וההיא דהמגרש (לקמן פו, ב) שנים ששלחו ב' גיטין ושמותיהן שוין – And regarding that משנה in פרק המגרש where two people sent two גיטין, each to his respective wife, where all the names were the same [and the גיטין became mixed up], the משנה rules – נותן שניהם לזו ושניהם לזו וקאמר רבי ירמיה בגמרא הא דלא כרבי אלעזר – He gives both גיטין to this woman and both גיטין to the other woman, and ר"י stated in the גמרא there, ‘this משנה is not according to ר"א’ – משמע דכרבי מאיר ניחא‎ – implying that according to ר"מ the משנה is understood; however תוס' just said that we require that it be מוכח מתוכו, and here since the names are the same it is not מוכח מתוכו‎?! תוספות responds התם מיירי כדפרישית לעיל כשכתבו דורות או סימן או כהן שניכר מתוך החתימה‎ – There we are discussing a case, as I previously explained, where they wrote the previous generations, or some identifying sign, or one of them was a כהן, so it is evident from the signed גט who the parties are – ועדי מסירה אין מכירין באבותיהן או בסימן הכתוב – However the ע"מ did not recognize their forefathers or the sign indicated in the גט‎. תוספות asks: ואם תאמר למאן דחייש לקמן בפרקין (דף כז, א) לשני שוירי ולשני יוסף בן שמעון‎ – And if you will say; according to the one who, later in this פרק, is concerned for two cities called שוירי and for two people called יוסף בן שמעון; this concern is – אף על גב דלא הוחזקו אם כן לרבי מאיר יפסלו כל הגיטין‎ – Even if it was not established that there are two שוירי or two יב"ש; according to this מ"ד all גיטין should be פסול according to ר"מ who requires מוכח מתוכו‎ – דלא משכחת תו שום גט שיהא מוכח מתוכו – Since you can no longer find any גט that it should be מוכח מתוכו that this man from this city is divorcing his wife because perhaps there is another man with the same name from the same city (or another city with the same name) who is divorcing his own wife! תוספות answers: ואומר רבינו יצחק דדוקא בגט הנמצא הוא דחייש שמא מאחר נפל – And the ר"י says that only by a גט which was lost an found are we concerned that perhaps it fell from another יב"ש (even though לא הוחזקו) – אבל חשיב שפיר מוכח מתוכו כיון דלא הוחזקו אלא שוירי אחד ויוסף בן שמעון אחד‎ – However by a regular גט it is indeed considered מוכח מתוכו since we know of only one שוירי and one יב"ש – תוספות asks: ואם תאמר דתנן בפרק גט פשוט (בבא בתרא דף קסז, א) כותבין גט לאיש אף על פי שאין אשתו עמו‎ – And if you will say; for the משנה in פרק גט פשוט teaches, ‘we write a גט for a man even though his wife is not with him’ – ופריך בגמרא וליחוש לשני יוסף בן שמעון הדרים בעיר אחת‎ – And the גמרא there asks, ‘but let us be concerned for two יב"ש who live in the same city, and their wives also have the same names – דלמא ממטי לה גיטא לאיתתיה דהאיך‎ – Perhaps he will bring the גט to the other s יב"ש' wife’, and she will be divorced illegally – ומשני הכי אמר רב שני יוסף בן שמעון הדרים בעיר אחת אין מגרשין אלא זה בפני זה – And the גמרא there answered, ‘this is what רב taught; two יב"ש who live in one city, cannot divorce their wives only in the presence of each other’. This concludes the citation of the משנה and גמרא‎. תוספות continues with his question – והשתא היכי מיירי אי בלא הוחזקו הא מסקינן לקמן (כז, א( דלא חיישינן‎ – But now, what case are we discussing; if it not established that there are two יב"ש, there is no concern, since the גמרא concluded later that we are not concerned for two יב"ש, if it is לא הוחזקו, so there is no need for any תקנה and no concern – ואי בהוחזקו אם כן לרבי מאיר אפילו זה בפני זה אין מגרשין‎ – And if it is הוחזקו, so according to ר"מ, they cannot divorce even in the presence of each other, for we require מוכח מתוכו (which it is not), so the תקנה is useless – עד שיכתבו כהן או דורות או שום סימן ואז ליכא למיחש למידי‎ – Unless they write כהן or previous generations or some sign, and in that case there is no concern at all, since we will notice the distinction in the גט – ואי לרבי אלעזר הא עדי מסירה ידעי שפיר אם זו היא אשתו או לאו כדאמר הכא – And if it is according to ר"א, so the ע"מ properly know if this is his wife or not as the גמרא states here?! How can we understand that גמרא in ב"ב‎?! תוספות answers: ואומר רבינו יצחק דאין עדי מסירה מדקדקים לראות אם זו אשתו – And the ר"י says that the עדי מסירה are not that careful to see if this is his wife – כיון שמכירים שמו ושמה וכתוב בגט שמו ושמה‎ – Since they recognize his name and her name and his and her names are written in the גט, so they assume that the woman receiving the גט is his wife – ולא חיישינן שמא יתננו לאשת חבירו ששמו כשמו ושמה כשמה‎ – And the ע"מ are not concerned that perhaps the husband will give the גט to his friend’s wife whose name is like his name and her name is like his wife’s name – וגם לא מסקי אדעתייהו להבחין אם יש יוסף בן שמעון אחר בעיר – And also it does not enter in the minds of the ע"מ to verify whether there is another יב"ש in the city – וכשבאה לבית דין להתירה להנשא מעידים עדי מסירה בפני בית דין‎ – So when the woman comes to בי"ד with her גט, so that בי"ד should permit her to remarry, the ע"מ will testify before the בי"ד – שראו שבעלה נתן לה גט אף על פי שלא דקדקו אם היא היתה אשתו‎ – That they saw that her husband gave her a גט, even though they were not meticulous to verify whether she was actually his wife – ולהכי פריך ניחוש דלמא ממטי לה גיטא לאיתתיה דהאי‎ – So therefore the גמרא asked (how can you לכתחלה write a גט for the husband without the wife), ‘let us always be concerned that perhaps he will bring this גט to his friend’s wife – דאפילו אין יודעין הכותבין אם הוחזקו אין להם לכתוב דזימנין דהוחזקו ולא ידעי – For even if those who are writing the גט are unaware whether הוחזקו or not (so seemingly there is no concern), nevertheless they should not write a גט (without the wife present) for occasionally it may be הוחזקו and the scribes and the ע"מ are unaware – ומשני שני יוסף כולי אין מגרשין אלא זה בפני זה‎ – And the גמרא answers two י ב"ש, etc. do not divorce except in the presence of each other – וכשבאה לבית דין להתירה שיילי בית דין לעדי מסירה אם היו שם שני יוסף בן שמעון – So when she comes to בי"ד to be permitted to remarry, בי"ד ask the ע"מ, (in a case where it was הוחזקו) whether there were there two יב"ש, by the מסירת הגט – תוספות responds to an anticipated difficulty: ולא רצה לתרץ דאין מגרשין אלא אם כן מכירין עדים שזו היא אשתו – And the גמרא did not want to answer that ( if there are two יב"ש in a city) they can’t divorce unless the ע"מ recognize that this is his wife, so there will no longer be the concern perhaps he is divorcing is friend’s wife – דאין זו תקנה טובה דאם כן בטורח ימצאו עדי מסירה: For this is not a good enactment, for if indeed this will be the resolution, it will be difficult to find ע"מ; most people are not that familiar with knowing who are the respective wives of the husbands. S UMMARY If there are two יב"ש, according to ר"מ they cannot divorce their wives unless there is a clear distinction between them mentioned in the גט, for we require מוכח מתוכו‎. The concern of ב' יב"ש is only by נפל and only if הוחזקו‎. The requirement that by ב' יב"ש they need to divorce in each other’s presence is because the ע"מ may not (recognize the wives and not) be aware that there are ב' יב"ש (even if הוחזקו). T HINKING IT OVER תוספות writes regarding the גמרא of ב' יב"ש הדרים בעיר אחר that אין מגרשין אלא זה בפני זה, that it cannot be in a case where לא הוחזקו, because 'הא מסקינן לקמן דלא חיישינן'. Seemingly there is a much simpler proof, for if that גמרא is in a case where לא הוחזקו, what does the גמרא answer that אין מגרשין אלא זב"ז, but we do not know even that there are two יב"ש, so when will we institute this תקנה‎?! Obviously we are חושש only if הוחזקו, for then we can implement that אין מגרשין אלא זב"ז‎!

גמרא אמר רבה זאת אומרת שני יוסף בן שמעון דגרין בעיר אחת מוציאין שטר חוב על אחרים. כלומר דלא חיישינן, אלא האי דנפיק מתותי ידיה גבי ביה, כי היכי דלא חיישינן בגט, שמא נפל מזו ומצאתו זו. ואף על גב דלגבי שני יוסף בן שמעון איכא למיחש שמא מסרו לו לקנותו ולגבות בו ואותיות אין נקנות במסירה, אליבא דרבא, כדאיתא ביבמות פרק האשה שהלכה (יבמות קטו, ב) גבי עובדא דיצחק ריש גלותא, דאזל מקורטובא ובא לאספמיא, ולגבי גט ליכא למיחש להכי, דהא כולי עלמא ידעי דאין אשה מתגרשת בגט חברתה, מכל מקום אילו היינו חוששין [בנדפס: לכך], שמא נתנו לה חברתה, לצור על פי צלוחיתה.
גמרא אי הכי רישא דקתני מצאו בן עירו ואמר לו שמי כשמך וכו' שני הוא דלא מצי מגרש ביה הא ראשון מצי מגרש ביה והא אמרינן בבבא בתרא פרק גט פשוט (בבא בתרא קעב, ב)
ולא אחר יכול להוציא עליהן שטר חוב דאמר ליה חברו ששמו כשמי מסרו לך, כדי לגבות ממנו [בכת"י: ממני], הכא נמי אמאי מתירין אשת הראשון בגט זה, נחוש שמא השני כתבו לאשתו ונמלך עליו שלא ליתנו, ונתנו לזו.
אלא מאי אית לך למימר, בעדי מסירה ורבי אלעזר היא, הכא נמי בעדי מסירה ורבי אלעזר היא. אבל בלא עדי מסירה, חיישינן לנפילה. ורבינו תם לא גריס ורבי אלעזר היא, דאפילו כרבי מאיר נמי אתיא, ובדאיכא סהדי דמסריה ניהליה באפייהו. אבל ר"י ז"ל אמר, דודאי גרסינן ליה, דלרבי מאיר דאמר עדי חתימה כרתי בעינן שיהא מוכיח מתוך עדי החתימה, הא לאו הכי לא הוי גיטא, וכדפרישית בריש מכילתין. והא דתנן לקמן בפרק המגרש (גיטין פו, ב) שנים ששלחו שני גיטין ושמותיהן שוין, ונתערבו זה בזה, נותן שניהם לזו, ושניהם לזו, ופרכינן ולרבי אלעזר דאמר עדי מסירה כרתי, והא לא ידעי בהי מינייהו מיגרשא. דמשמע, דלרבי מאיר ניחא. ההיא, במשולשין בגט, ומוכיח מתוך הגט הי אשתו של זה והי אשתו של זה, אלא שאין השליח ועדי המסירה מכירין בשלוש האבות. ובריש מכילתין הארכתי בה יותר בסייעתא דשמיא. ובתוספות הביאו ראיה לדברי רבינו תם ז"ל, מהא דתנן (בב"ב פרק גט פשוט (בבא בתרא קסז, א)) כותבין גט לאיש אף על פי שאין אשתו עמו, ופריך עלה בגמרא וליחוש לשני יוסף בן שמעון בעיר אחת, דילמא כתב גיטא ואזיל וממטי ליה לאיתתיה דהאי. ומשני, הכי אמר רב, שני יוסף בן שמעון בעיר אחת, אין מגרשין נשותיהן אלא זה בפני זה. ואם איתא, דבעינן שיהא מוכיח מוך הגט, הכא היכי דמי, אי במוכיח וכגון ששלשו, תו ליכא למיחש ואפילו במגרש שלא בפני חבירו, ואי בשאין מוכיח מתוכו, אפילו במגרש בפני חבירו הרי אינו גט לרבי מאיר, ואי לרבי אלעזר הא בעי עדי מסירה, ואינהו ידעי שפירתא זו אשתו אם לאו. ואם תאמר, דחיישינן לשני יוסף ואף על גב דלא הוחזקו, הא ליתא, דהא לא חיישינן בדלא הוחזקו. ועוד נראה לי, דהתם אי אפשר לומר כן, דאם כן מאי קא משני שני יוסף בן שמעון בעיר אחת אין מגרשין אלא זה בפני זה, דאי חיישינן ולא ידעינן מאי, דמי איכא למימר דבדקינן כולה מדינתא. ור"י ז"ל תירץ, דעדי מסירה אין דרכם לדקדק ולראות אם זו אשתו, כיון שהם רואין שמו ושם אשתו כתובין בגט, ואם נתנו לאשת חברו, כשבאה לבית דין להתירה לינשא, ומביאין עדי מסירה אמרו בפני בית דין שראו שנתן לה בעלה גט זה, אף על פי שלא דקדקו אחרי אותה שקבלה את הגט, והילכך אף על פי שכותבים דורות או סימן או כהן, אין אנו סומכים בכך, עד שיגרש בפני חברו, דאז ליכא למיחש לשמא נתן את הגט לאשת חברו, שלא היה האחר טובל [בנדפס: שותק]. אי נמי יש לומר, שאז ידקדקו העדים יותר. זו היא שיטתם של רבותינו בעלי התוספות ז"ל.

כבר ביארנו במשנתנו שכל שיש לו שתי נשים ששמותיהן שוים וכתב לגרש את הגדולה ונמלך אינו מגרש בו את השניה ולפי דרכך למדת שהראשונה מיהא שנכתב לשמה יכול לגרש בו אע"פ ששמה כשם האחרת וכשתבא לבית דין בגיטה יתירוה לינשא ומגבין אותה כתובתה ואין הבעל יכול לטעון קטנה גרשתי ונפל לה ואת מצאתו שאין חוששין לנפילה ומגבין אותה כתבתה כענין שני יוסף בן שמעון שאחד מהם יכול להוציא שטר חוב על אחר דעלמא ואין הנתבע יכול לומר מחבירך לויתי ונפל לי השטר ואתה מצאתו ובזו אין צורך לעידי מסירה וכשאמרו בסוף השמועה אלא מאי אית לך למימר בעידי מסירה כו' אין גורסין בה הכא נמי בעידי מסירה שלא הוזקקנו לעידי מסירה אלא לרישא וכן מצאתיה בספרים מדוייקים ואף למי שגורס כן אינו אמור אלא דרך דחיה כלומר אין ללמוד מכאן שיהא אחד משני יוסף בן שמעון יכול להוציא שטר חוב על אחרים דדילמא הכא נמי בעידי מסירה שראו שזו היא שנתגרשה או שזהו שהלוה:
ומכל מקום לענין פסק בזו מיהא אין צורך לעידי מסירה כלל שאין חוששין לנפילה כלל ומכל מקום בראשונה שאמרו כתב לגרש את אשתו ונמלך ומצאו בן עירו ואמר לו שמי כשמך ושם אשתי כשם אשתך שאין זה מגרש בו הא ראשון מגרש בו ומתירין אותה ומגבין לה כתבתה צריך לפרש שהרי שני יוסף בן שמעון אין אחר יכול להוציא עליהם שטר חוב שהרי הנתבע יכול לומר לא אני לויתי ושמא חברי לוה ואף זה יטעון שמא חברי כתב ונתנו לך מפני שנתן עיניו בך ואע"פ שמ"מ אם הוא אומר חברי כתבו לאשתו ונפל לו ומצאתו אינו כלום דלנפילה לא חיישינן בכתב ונתנו לך מיהא נחוש אי נמי שמא האחר כתבו לשם אשתו ונמלך והשליכו מדעת וזו מצאתהו או שמא אחר שנתגרשה האחרת והותרה בבית דין מסרתו לזו ואחר שכן לא נגבה לה כתובה וכן לא נתירה לינשא אלא שהעמידוה בעידי מסירה שמעידים שזו היא שנתגרשה ומשיאין ומגבין על פיהם שאף בשטר חוב כן ואין צורך לגרוס ור' אלעזר היא שאף לר' מאיר עידי מסירה בכי הא מהנו ופירושו בעידי מסירה בזולת עידי החתימה ואע"פ שבתוספות כתבו דלר' מאיר לא מהני כלל דמוכיח מתוכו בעינן והרי גט זה אין גירושיו נכרתים מתוך עידי חתימה שבו ועידי מסירה הוא שמשלימין את הדבר אין דבריהם נראין שהרי בפרק אחרון אמרו שנים ששלחו שני גיטין שוים ונתערבו נותן שניהם לזו ושניהם לזו והעמידוה דלא כר' אלעזר אלמא דכר' מאיר אתיא והרי לא נכר מתוך החתימה באי זו מתגרשת ואע"פ שהם נדחקו בפירושה אין צורך בכך ומי שגורס ר' אלעזר היא נראה שהוא גורסו מפני שמן הסתם אין אדם טורח לעידי חתימה ולעידי מסירה ופירושה בעידי מסירה לבד וכדעת ר' אלעזר או שמא פירשו כר' אלעזר מתוך ששיטת המשנה מוכחת כדבריו והוא כתב לגרש ואע"פ שאיפשר לפרש בכלם חתם מכל מקום האחרונה ר"ל אמר ללבלר כתוב לא שייך ביה חתימה:
וכל שהוציאה בפנינו אשה את גיטה ויש בעיר ששמה ושם בעלה שוים לה צריך שתביא ראיה בעידי מסירה אם להיתר נשואיה אם לגוביינת כתובתה ומ"מ יש בה תקון בדרך אחרת ונזכר באחרון של בתרא קס"ז ב' והוא שהקשו שם במה שאמרו שכותבין וחותמין גט לאיש אע"פ שאין אשתו עמו ניחוש דילמא יהיב ליה לאחריתי ששמה כשם אשתו ושם בעלה כשמו שנתן עיניו בה ותירץ זאת אומרת שני יוסף בן שמעון הדרין בעיר אחת אין מגרשין נשותיהם אלא זה בפני זה ויש מפרשים זה בפני זה הבעל ואשתו בפנינו ויש מפרשים בה שיהו שני היוסף בן שמעון במעמד אחד בפנינו והיא צריכה לברר אחת מדרכים אלו ולמדת מ"מ שצריך שיהו העדים והסופר מכירין את האיש ואת האשה אלא שגדולי המפרשים כתבו באחרון של בתרא שדי להם בהכרא אפי' על פי אשה או קרוב דומיא דחליצה ואני מפקפק בה כמי שכתבתי שם ומ"מ כל שבשעת הסכנה כותבין ונותנין אע"פ שאין מכירין ויראה שעל זה סומכין עכשו להקל בכך שכל שעת הדחק שעת סכנה היא:
כל מקום ששנו חכמים גט פסול פוסל לכהנה חליצה פסולה פוסלת מן האחים שלא תתיבם עוד להם שמכל מקום שם חליצה עליה וכיון שחלץ שוב לא יבנה וכל שפוסלה לאחים פוסלת לכהנה מדברי סופרים והחליצה אינה אלא ביום וברגל ימין וכל שחלצה בלילה או מעל רגל שמאל חליצתו פסולה אבל אם חלצה לקטן אינה חליצה כלל וכן אם חלצה באנפיליא ר"ל שחלצה מנעל של בגד שעל רגלו אינה חליצה כלל שאינו קרוי מנעל:

יָתֵר מִיכֵּן – הָיוּ לוֹ שְׁתֵּי נָשִׁים וּשְׁמוֹתֵיהֶן שָׁווֹת, כָּתַב לְגָרֵשׁ אֶת הַגְּדוֹלָה – לֹא יְגָרֵשׁ בּוֹ אֶת הַקְּטַנָּה.
Moreover, if one had two wives and their names were identical, and he wrote a bill of divorce to divorce the older one and then reconsidered, he may not divorce the younger one with it.
יָתֵר מִיכֵּן – אָמַר לְלַבְלָר: ״כְּתוֹב, לְאֵיזוֹ שֶׁאֶרְצֶה אֲגָרֵשׁ״ – פָּסוּל לְגָרֵשׁ בּוֹ.
Moreover, if he said to the scribe: Write a bill of divorce for whichever one of them that I will want and I will divorce her with it, this bill of divorce is unfit for him to divorce either wife with it.
גְּמָ׳ כָּתַב לְגָרֵשׁ אֶת אִשְׁתּוֹ וְנִמְלַךְ וְכוּ׳: וְאֶלָּא רֵישָׁא בְּמַאי?
GEMARA: The second clause of the mishna considers a case where one wrote a bill of divorce with which to divorce his wife but later reconsidered, and a resident of his town with identical personal details found him and desired to use the bill of divorce. The Gemara asks: But then with what case is the first clause of the mishna, where a man discovers that a scribe had written a bill of divorce with identical personal details to his own, dealing; isn’t that also a case of a bill of divorce that was written for someone else? Why did the tanna cite two seemingly identical cases?
אָמַר רַב פָּפָּא: בְּסוֹפְרִין הָעֲשׂוּיִין לְהִתְלַמֵּד עָסְקִינַן. אָמַר רַב אָשֵׁי: דַּיְקָא נָמֵי, דְּקָתָנֵי ״סוֹפְרִין מַקְרִין״, וְלָא קָתָנֵי ״סוֹפְרִין קוֹרְאִין״; שְׁמַע מִינַּהּ.
Rav Pappa said: We are dealing with scribes who are practicing writing; the bill of divorce in the first case was written as an exercise and not because someone requested that it be written. Rav Ashi said: The language of the mishna is also precise, as it teaches: Scribes dictating, i.e., to their students, and it does not teach: Scribes reading the names on their own. The Gemara concludes: Indeed, learn from this phrasing that this is the correct understanding of the mishna.

By employing the introductory term: Moreover, the mishna indicates that each case teaches an additional novelty beyond that of the previous case. The Gemara asks: What novel element warrants the use of the term: Moreover? The Gemara answers by quoting a baraita : The school of Rabbi Yishmael taught that not only this bill of divorce, which was written for practice and which was not written for the sake of divorce, is unfit, but even that bill of divorce, which was written for the sake of divorce but the husband then reconsidered and did not use it, is unfit to be used by someone else.
וְלֹא זֶה – שֶׁנִּכְתַּב שֶׁלֹּא לְשׁוּם גֵּירוּשִׁין דִּידֵיהּ; אֶלָּא אַף זֶה – שֶׁנִּכְתַּב לְשׁוּם גֵּירוּשִׁין דִּידֵיהּ, פָּסוּל. וְלֹא זֶה – שֶׁלֹּא נִכְתַּב לְשׁוּם גֵּירוּשִׁין הָא; אֶלָּא אַף זֶה – שֶׁנִּכְתַּב לְשׁוּם גֵּירוּשִׁין הָא, פָּסוּל.
And not only this bill of divorce, which was not written for the sake of his own divorce, is unfit, but even that bill of divorce, which was written for the sake of his own divorce, albeit for a particular wife, is unfit to be used for divorcing his other wife. And not only this bill of divorce, which was not written for the sake of this wife’s divorce, but even that bill of divorce, which was written for this wife’s divorce, as he instructed the scribe to write the bill of divorce for the sake of whichever wife he decides to divorce, is unfit to use in divorce.
מַאי טַעְמָא? אִי כְּתַב ״וְנָתַן סֵפֶר כְּרִיתוּת בְּיָדָהּ״, הֲוָה אָמֵינָא לְמַעוֹטֵי הַאיְךְ קַמָּא, דְּלָא עֲבִיד לְשׁוּם כְּרִיתוּת; אֲבָל כָּתַב לְגָרֵשׁ אֶת אִשְׁתּוֹ וְנִמְלַךְ, דַּעֲבִיד לְשׁוּם כְּרִיתוּת – אֵימָא כָּשֵׁר; כְּתַב רַחֲמָנָא: ״וְכָתַב״.
The Gemara explains: What is the reason that a bill of divorce must be written for the sake of the woman who is being divorced? It is stated in the verse that deals with divorce: “And he writes for her a scroll of severance and gives it in her hand” (Deuteronomy 24:1). This teaches the following: If the Merciful One had written only: And he gives a scroll of severance in her hand, I would say that the verse serves to exclude this case of the first clause of the mishna, where it was done not for the sake of severance, as the scribe wrote the bill of divorce as a mere exercise; however, if one wrote a bill of divorce to divorce his wife but then reconsidered, where it was done for the sake of severance, I would say that it is valid for another man to use for divorcing his wife. Therefore, the Merciful One writes in the Torah: “And he writes,” meaning that the bill of divorce must be written exclusively for the sake of his own divorce.
אִי כְּתַב רַחֲמָנָא ״וְכָתַב״, הֲוָה אָמֵינָא לְמַעוֹטֵי הַאי, דְּלָא אִיהוּ קָא כָתֵיב לַהּ; אֲבָל יֵשׁ לוֹ שְׁתֵּי נָשִׁים, דְּאִיהוּ קָא כָתֵיב לַהּ – אֵימָא כָּשֵׁר; כְּתַב רַחֲמָנָא: ״לָהּ״ – לִשְׁמָהּ.
The Gemara continues the explanation: If the Merciful One had written only: And he writes, I would say that the verse serves to exclude this case mentioned previously, where the man using the bill of divorce was not the one who wrote it; but if a man has two wives with the same name, so that the man using the bill of divorce is writing it, say that it is a valid bill of divorce. Therefore, the Merciful One writes in the Torah: “And he writes for her,” teaching that a bill of divorce must be written for the sake of a specific wife.
וְסֵיפָא לְמָה לִי? הָא קָא מַשְׁמַע לַן – דְּאֵין בְּרֵירָה.
The Gemara asks: And why do I need the last clause of the mishna, which deals with a man who writes a bill of divorce for whichever wife he later chooses? The earlier clauses made clear that one must write the bill of divorce for the sake of the woman who is being divorced. The Gemara answers: This teaches us that there is no retroactive clarification, i.e., that one does not say that since he gave the bill of divorce to this wife, it is clarified retroactively that he had written the bill of divorce for her sake; rather, he must write it for her sake from the outset.
כָּתַב לְגָרֵשׁ אֶת הַגְּדוֹלָה – לֹא יְגָרֵשׁ בּוֹ אֶת הַקְּטַנָּה: קְטַנָּה הוּא דְּלָא מָצֵי מְגָרֵשׁ בֵּיהּ, הָא גְּדוֹלָה – מָצֵי מְגָרֵשׁ בֵּיהּ.
§ The mishna teaches: If he wrote a bill of divorce to divorce the older of his two wives and then reconsidered, he may not divorce the younger wife with it, even though the two wives share the same name. The Gemara deduces from this: It is the younger one whom he is not able to divorce with it, but he is able to divorce the older wife with it, as it was written for her from the outset. This is the case even though the younger wife would be able to collect payment of her marriage contract and remarry if she were to present this bill of divorce, as the court would think it was written for her.
אָמַר רָבָא: זֹאת אוֹמֶרֶת, שְׁנֵי יוֹסֵף בֶּן שִׁמְעוֹן הַדָּרִין בְּעִיר אַחַת – מוֹצִיאִין שְׁטַר חוֹב עַל אֲחֵרִים.
Rava said: That is to say that one of two people with identical names, e.g., Yosef ben Shimon, who live in one city, can present a promissory note to claim a debt from others, and the borrower cannot claim that the promissory note was written for the other Yosef ben Shimon.
אֲמַר לֵיהּ אַבָּיֵי: אֶלָּא מֵעַתָּה, רֵישָׁא דְּקָתָנֵי: שְׁמִי כְּשִׁמְךָ – פָּסוּל לְגָרֵשׁ בּוֹ; שֵׁנִי הוּא דְּלָא מָצֵי מְגָרֵשׁ בֵּיהּ, הָא רִאשׁוֹן מָצֵי מְגָרֵשׁ בֵּיהּ?! וְהָא אָמְרִינַן: ״וְלֹא אַחֵר יָכוֹל לְהוֹצִיא עֲלֵיהֶן שְׁטַר חוֹב״!
Abaye said to him: If that is so, then according to your reasoning, from the earlier clause of the mishna that teaches that if one man requests a bill of divorce from another, saying: My name is the same as your name, the bill of divorce is unfit for the second person to divorce his wife with it, one could infer that the second man is the one who is not able to divorce with it, but the first man is able to divorce with it even though they have the same names. But didn’t we say in a mishna ( Bava Batra 172a): With regard to two people with identical names, neither of them can present a promissory note to the other, and another person cannot present a promissory note to them, as each one can deny that he is the one who owes the money? Here too, there is a concern lest the wife of the other use the bill of divorce to collect payment of her marriage contract even though the bill of divorce was not written for her.
אֶלָּא מַאי אִית לָךְ לְמֵימַר? בְּעֵדֵי מְסִירָה, וְרַבִּי אֶלְעָזָר הִיא;
Rather, what have you to say to explain how the first man can divorce his wife with this bill of divorce, and how it can be used as a reliable proof of divorce? One can say that the ruling of the mishna applies in a case where there are witnesses who observe the transmission of the bill of divorce, and they confirm in court which woman was given the bill of divorce. And this mishna is in accordance with the opinion of Rabbi Elazar, who holds that presence of witnesses at the transmission of the bill of divorce is essential to its taking effect, so there is no concern that the wife of the other man will claim payment of her marriage contract.
הָכָא נָמֵי – בְּעֵדֵי מְסִירָה, וְרַבִּי אֶלְעָזָר הִיא.
Here too, in the case of two wives of the same man who have the same name, the ruling of the mishna applies in a case where there are witnesses who observe the transmission of the bill of divorce. And this mishna is in accordance with the opinion of Rabbi Elazar, and there is no concern that the other wife will claim payment of her marriage contract. Therefore, one should not deduce from this, as Rava did, that one of two people with the same name can present a promissory note to claim a debt from others.
אָמַר רַב: כּוּלָּן פּוֹסְלִין בִּכְהוּנָּה, חוּץ מִן הָרִאשׁוֹן. וּשְׁמוּאֵל אָמַר: אַף רִאשׁוֹן נָמֵי פּוֹסֵל.
§ Rav says: All of the bills of divorce that the mishna categorizes as unfit to use for divorce still disqualify the women who receive them from marrying into the priesthood, as she is considered a divorced woman with regard to the halakha of marrying a priest, except for the first bill of divorce mentioned in the mishna. Unlike the other cases, that one was not written for the sake of divorce at all but was written only as part of a scribe’s training. And Shmuel says: Even the first bill of divorce disqualifies her from marrying into the priesthood.
וְאַזְדָּא שְׁמוּאֵל לְטַעְמֵיהּ, דְּאָמַר שְׁמוּאֵל: כׇּל מָקוֹם שֶׁשָּׁנוּ חֲכָמִים ״גֵּט פָּסוּל״ – פָּסוּל וּפוֹסֵל. ״חֲלִיצָה פְּסוּלָה״ – פְּסוּלָה, וּפוֹסַלְתָּהּ מִן הָאַחִין.
And Shmuel follows his own line of reasoning, as Shmuel says: Any place where the Sages taught in a mishna: An invalid bill of divorce, it indicates both that it is invalid to be used as a bill of divorce and that it nevertheless disqualifies the one who receives it from marrying a priest. Similarly, where the Sages taught: An invalid ḥalitza , it indicates both that the ḥalitza is invalid and that it nevertheless disqualifies the yevama from entering into levirate marriage with the other brothers.
בְּמַעְרְבָא אָמְרִי מִשְּׁמֵיהּ דְּרַבִּי אֶלְעָזָר: שְׂמֹאל וְלַיְלָה – פְּסוּלוֹת וּפוֹסְלוֹת,
In the West, Eretz Yisrael, they say in the name of Rabbi Elazar: If ḥalitza was performed on the left foot of the yavam , or at night, these acts of ḥalitza are invalid, and they nevertheless disqualify the yevama from entering into levirate marriage with the other brothers.
