הא בשכיב מרע‎—This is by a שכיב מרע O VERVIEW One ברייתא states that if someone stated הולך מנה לפלוני and that פלוני passed on, the rule is that it should be given to the heirs (of this פלוני). רב אבא בר ממל explained that (even) this ברייתא can maintain הולך לאו כזכי and nevertheless it is given ליורשיו, because the grantor was a שכיב מרע, and דברי שכיב מרע ככתובים וכמסורים דמי (as long as he does not retract), therefore it is like the שכ"מ said זכי and the פלוני was זוכה, so his יורשין inherit it. It would seem that this is true if the שכ"מ died before the intended recipient died (since the recipient acquired it at the death of the שכ"מ), but not if the מקבל predeceased the שכ"מ, for then he never acquired it that it should be transferred to his heirs. תוספות maintains that this is not so. ---------------------- אומר רבינו יצחק אף על גב דמת מקבל בחיי נותן ולא קני אלא אחר מיתת נותן‎ – The ר"י stated that this ruling of יתנו ליורשיו applies even though the recipient (פלוני) died during the lifetime of the grantor (the שכ"מ), and the rule is that one does not acquire a מתנת שכ"מ, only after the death of the grantor, so seemingly if the מקבל died בחיי נותן, there is no one to receive these monies and it should be returned to the שכ"מ – אפילו הכי קנו יורשין דדעת נותן הוא‎ – Nevertheless the יורשין acquire it (after the death of the נותן) for it is presumed that the intent of the grantor is – דכיון שישנו למקבל בשעת מתן מעות שיזכה המקבל אחר מיתתו או הוא או יורשיו – That since the recipient existed when the money was given to the שליח, the grantor intends that the recipient or his heirs should acquire these monies after his (the grantor’s) death. תוספות adds an additional חידוש: ואפילו לא נולדו יורשי מקבל עד אחר מיתת נותן קנו‎ – And even if the heirs of the recipient were not born until after the death of the grantor, nevertheless they are still קונה‎. This is valid – אפילו למאן דאמר המזכה לעובר לא קנה – Even according to the one who maintains that one who is מזכה for a fetus, the fetus does not acquire it, nevertheless here the יורשין are קונה‎ – דדברי שכיב מרע כשמת כמסורים למקבל משעת נתינת שכיב מרע או אמירתו: Because the words of a שכ"מ once he dies are considered as if they were already delivered to the recipient from the time the שכ"מ either gave the item or he said to give the item. S UMMARY The מתנת שכ"מ is given to the heirs of the מקבל even if at the time the שכ"מ died the מקבל was already dead and the יורשין were not born, because it is the intent of the שכ"מ to give it to the heirs, and the מתנת שכ"מ becomes effective retroactively from the time the gift was given or ordered. T HINKING IT OVER תוספות anticipated how can יורשין who were not yet born acquire the gift. It would seem that if they were already born there would be no difficulty as to how they are קונה‎. However at this point (before תוספות explained that it belonged to the מקבל retroactively), how can the יורשין who are alive בשעת מיתת שכ"מ acquire the gift, since they were not alive at the time it was given?
ורבי יהודה הנשיא בשם רבי יעקב אומר הולך לאו כזכי‎—And ר"י הנשיא in the name of ר"י says, הולך is not like זכי O VERVIEW The גמרא cites a ברייתא in which ר"י הנשיא states (in the name of ר"י) that הולך is not כזכי (and the sender may retract). תוספות will reconcile this with another ברייתא where it is evident that רבי maintains הולך כזכי‎. ------------------------- תוספות anticipates a difficulty: ואף על גב דרבי אית ליה בפרק התקבל (לקמן סג, א) הולך ותן לה זכה לה התקבל לה‎ – And even though רבי maintains in פרק התקבל that if the husband said to the שליח (לקבלה of the woman) ‘ הולך and give it to her, acquire it for her, or accept it for her’, in all these cases the rule is if the husband – רצה לחזור לא יחזור דהולך ותן כזכי – Wishes to retract (and have the גט returned to him), he may not retract, for הולך and תן are like זכי; this seems to contradict what ר"י הנשיא rules here (in the name of ר' יעקב שאמר משום ר"מ) that הולך is לאו כזכי‎! תוספות responds: התם משום שאמר השליח אשתך אמרה התקבל לי גטי‎ – There by a גט, since the שליח said, ‘your wife said ( to me) ‘ accept the גט on my behalf”, therefore he cannot retract – דמסתמא על דעת כן נותן לו כל זמן שאינו אומר בהדיא אי אפשי שתקבל לה: For presumably the husband is giving the גט to the שליח with this intent (that the שליח should accept it as a שליח לקבלה) as long as the husband does not explicitly state, ‘I do not want that you should accept the גט on her behalf’. S UMMARY רבי generally maintains הולך לאו כזכי except in a case where it is evident that the שליח is acting on behalf of the מקבל, then הולך is כזכי unless the grantor explicitly excludes the שליח from being זוכה for the מקבל‎. T HINKING IT OVER 1. תוספות explains that even though רבי maintains הולך לאו כזכי, nevertheless by a גט where the שליח states אשתך אמרה התקבל לי גיטי, we assume that when the husband said הולך he meant זכי‎. In our ברייתא here ר' נתן (also) maintains הולך לאו כזכי (like רבי), however in the ברייתא later (of ואשתך אמרה התקבל וכו'), he maintains that הולך לאו כזכי, not like תוספות assumes. Why is it so that ר' נתן does not follow the logic of תוספות‎? 2. תוספות contradicts ר"י הנשיא here with רבי later. However why cannot we simply answer that רבי maintains הולך כזכי; however here ר"י הנשיא was stating the view of ר' יעקב in the name of ר"מ (but it is not the view of רבי)!
וחכמים אומרים יחלוקו‎—And the חכמים say, they should divide it O VERVIEW The גמרא cited a ברייתא concerning where monies were sent to a recipient and he died before he received the monies. There are differing opinions as to where the monies should go. The חכמים rule that the monies be divided between the (heirs of) the grantor and the heirs of the recipient; seemingly because we are unsure what should be done with the monies. תוספות will discuss whether this is a universal ruling (that when in doubt divide) or not. ------------------------ כל תיקו שבש"ס מפרש בשערים דרבינו האי דחולקים – In the ספר שערים of רבינו האי גאון it is explained that every time the גמרא concludes with תיקו (meaning the issue is unresolved) the ruling is that we divide the monies in dispute among the litigants. תוספות disagrees: ואין נראה לרבינו יצחק אלא היכא דאשכחן בהדיא יחלוקו‎ – And the ר"י disagrees for generally when in doubt we do not rule יחלוקו, unless where we find that the גמרא states explicitly יחלוקו, for otherwise – דאדרבה אומרים אוקי ממונא בחזקת מריה: On the contrary we rule that the money should remain in the possession of the (original) owner. S UMMARY Regarding the ruling of תיקו it is the view of רב האי that we say יחלוקו, while the ר"י maintains that we say אוקי ממונא בחזקת מריה‎. T HINKING IT OVER According to the ר"י that generally we rule אוקי ממנוא בחזקת מריה, why indeed do the חכמים rule here יחלוקו and not אוקי ממונא בחזקת מריה (קמא)?
וכאן אמרו שודא עדיף‎—And here they said שודא is preferable O VERVIEW The ברייתא, regarding the case where a gift was sent and the intended receiver passed on, states that וכאן אמרו the שליח may do as he pleases. Later the גמרא explained this ruling, that the וכאן אמרו כל מה שירצה שליח וכו' maintains שודא‎. It is not clear what שודא means. תוספות will offer two interpretations. -------------------------- מכאן מדקדק רבינו תם דאין לפרש שודא כמו שפירש בקונטרס בפרק הכותב (כתובות פה, ב) – The ר"ת infers from the גמרא here, that we do not interpret שודא as רש"י interpreted it in פרק הכותב‎ – גבי שניהם קרובים שניהם שכנים שניהם תלמידי חכמים שודא דדייני‎ – Regarding the case where both of them were relatives, both of them were neighbors, or both of them were ת"ח in which case the rule is שודא דדינא, and רש"י explained there – דהיינו שידקדק הדיין את מי היה אוהב יותר ולמי היה בדעתו ליתן‎ – That שודא דדייני means that the judge should scrutinize and find out whom did the grantor love more and to whom was the grantor’s intent to give it (and the דיין should award it to that party) – וכאן נמי פירש בקונטרס כמו התם‎ – And רש"י here too explained שודא as he did there in כתובות‎. The ר"ת however infers from this גמרא, not like רש"י – אלא יתן הדיין למי שירצה כי הכא דקאמר מה שירצה שליח יעשה וקרי ליה שודא: But rather that שודא means that the דיין should give it to whomever he wants, just like here where the ברייתא states, ‘ the שליח should do whatever he wants’, and the גמרא refers to this option as שודא, indicating that שודא means that the דיין (or in this case the שליח), may disburse the funds as they see fit. S UMMARY רש"י maintains that שודא requires a judgment call by the דיין as to who was the intended receiver, while the ר"ת maintains that the דיין has free rein by שודא‎. T HINKING IT OVER תוספות proves from our גמרא that since we refer to the sשליח' doing what he wishes, as שודא, this indicates that שודא has no connection to evaluating the intent of the giver. However רש"י interprets the phrase מה שירצה שליח יעשה to mean how the שליח assesses the intent of the giver. How can תוספות disprove this interpretation (besides [merely] stating that the obvious explanation of מה שירצה שליח does not lend itself to sרש"י' explanation)?
רבי אליעזר אומר אחד בריא ואחד כולי‎—רבי אליעזר states; whether he is a בריא or whether he is, etc. O VERVIEW The גמרא cites a משנה wherein there is a מחלוקת whether a שכ"מ can divide his estate through saying alone (the view of the חכמים), or does it require a קנין (the view of ר"א). In the סיפא of this משנה there is a מחלוקת whether the rule of דברי שכ"מ ככתובין וכמסורין דמי applies only on שבת (the view of ר"א), or on the weekdays as well (the view of ר' יהושע). Our תוספות discusses the גירסא whether it is ר' אלעזר or ר' אליעזר in the רישא of the משנה (which is cited here). ------------------ אומר רבינו תם דרבי אלעזר גרס דבסיפא פליגי רבי אליעזר ורבי יהושע‎ – The ר"ת says that the גירסא is ר' אלעזר (and not ר' אליעזר), for in the סיפא of this משנה there is a dispute between ר' אליעזר and ר"י, where – רבי אליעזר אומר בשבת דבריו קיימין אבל לא בחול ורבי יהושע כולי‎ – ר' אליעזר maintains that on שבת the words of the שכ"מ are substantiated (and no קנין is required) however not in the weekdays (where a קנין is required); but ר"י, etc. maintains that we always say דבריו קיימין‎.This is the מחלוקת in the סיפא‎ – אבל ברישא פליגי בין בחול בין בשבת מדלא ערבינהו – However in the רישא, the חכמים and ר"א argue both in the weekdays and on שבת‎. We know this is true since the משנה did not mix together these two מחלוקת‎. תוספות brings an additional proof that the מחלוקת in the רישא is even on שבת: ועוד מדפרכי רבנן לרבי אלעזר מאימן של בני רוכל דלמא בשבת היה דמודה בה רבי אלעזר‎ – And in addition since the רבנן challenged ר"א with the story of the mother of בני רוכל (this proves that ר"א דרישא is discussing שבת as well), for otherwise what refutation is there from that story; perhaps the mother said תינתן כבינתי לבתי on שבת where ר"א agrees that אמירת שכ"מ is effective. תוספות offers an additional proof that ר' אלעזר of the רישא is referring to שבת also: ועוד דקאמר התם קונים משכיב מרע ואפילו בשבת ולא לחוש לדברי רבי אלעזר – And furthermore, ר' לוי ruled there that one is קונה from a שכ"מ (for his transfers) and even if it is שבת, but not because we are concerned for the view of ר' אלעזר, but rather שלא תטרף דעתו of the שכ"מ. This concludes the גמרא‎ – ואי אדרבי אליעזר קאי הא מודה הוא בשבת דדבריו קיימים – And if ר' לוי was referring to ר' אליעזר (when he said, ולא לחוש לדברי ר"א), how can that be, for ר' אליעזר admits that on שבת the אמירת שכ"מ is effective so why would we need to make a קנין‎! Obviously, ר' לוי was referring to ר' אלעזר (who maintains that even on שבת the אמירת שכ"מ is ineffective), but not to ר' אליעזר‎. תוספות anticipates a difficulty (with the proof from ר' לוי): ואף על גב דרבי מאיר קאמר התם דלרבי אליעזר בחול דבריו קיימים ולא בשבת‎ – And even though ר"מ stated there (the reverse of the משנה) that according to ר"א on the weekdays his words are effective, but not on שבת (this would seemingly invalidate the previously mentioned proof) – תוספות rejects this refutation: התם לא קאי ארבי מאיר אלא אמתניתין‎ – There ר' לוי was not referencing ר"מ (who maintains according to ר"א that בשבת the אמירה is ineffective), but rather ר' לוי was referencing our משנה (which states that according to ר"א the אמירת שכ"מ is effective on שבת, therefore ר' לוי could not be discussing ר' אליעזר of the סיפא, but rather ר' אלעזר of the רישא‎. תוספות proves that [even] according to ר"מ we need to distinguish between ר"א of the רישא and ר"א of the סיפא: ועוד דאמר הכא דרבי מאיר כרבי אלעזר והולך מנה משמע דבחול מיירי‎ – And furthermore the גמרא concludes here, that ר"מ is according to ר"א, and the phrase 'הולך מנה' (which is being discussed here) indicates that we are discuss a weekday – ורבי מאיר אית ליה התם דלרבי אליעזר בחול דבריו קיימים‎ – However ר"מ maintains there in ב"ב that according to ר' אליעזר the words of a שכ"מ are effective in the weekdays (without depending on the ruling of מצוה לקיים דברי המת), why do we say here that ר"מ follows ר"א and we give it ליורשי מי שנתלחו לו because of מצוה לקיים דברי המת‎ – אלא ודאי ג' מחלוקת בדבר: But rather we are compelled to assume that there are three differing opinions in this matter. S UMMARY The חכמים (and ר"י) maintain we always say דברי שכ"מ כככתובים וכמסורים דמי; however ר' אליעזר of the סיפא maintains that אמירת שכ"מ is effective only on שבת (and according to ר"מ the reverse is true); the opinion of ר' אלעזר of the רישא is that אמירת שכ"מ is never effective. T HINKING IT OVER 1. One of תוספות proofs was from אמן של בני רוכל, that if we assume that ר"א agrees that בשבת דבריו קיימין, then perhaps the story אמן של בני רוכל took place on שבת‎. However this proof can be refuted for perhaps the חכמים ‘knew’ that the story happened בחול‎! 2. תוספות assumes that the רישא is ר' אלעזר and the סיפא is ר' אליעזר‎. Perhaps it is the opposite?!

הא ד בעא מיניה רבי אחא ברבי יאשיה מרבי דוסתאי ברבי ינאי אמאי עבדת הכי. נראה דהכי פירושא אמאי מהדרת ליה ניהלייהו, שהרי כבר זכית בו בשבילי וכדתניא (לעיל בע"א) הולך פקדון זה לפלוני שיש לו בידי אם בא לחזור אינו חוזר וכיון שכן, פושע אתה וחייב לשלם, ואהדר ליה דאונס היה דאותן בני אדם תקיפין היו ואילו אומרים הרוגו הורגין, ואמר ליה אותן בני אדם יש להם סוסים ופרדים שרצים אחריהם וקרובין למלכות הן.
אמר לו אין, אי הכי שפיר עבדת כלומר בכי הא ודאי אונס הוא ופטור אתה. והכי איתא בירושלמי (במכילתין פ"א ה"ה) גבי מעשה זה דר' דוסתאי בר' ינאי אמר ר' חגאי הדה דתימא בהן דלא יכול למקמא טאבות ברם ההוא דיכיל מקמה גרמה טאבות מפק לו מן הדין ויהבינון להדין.
ירושלמי (שם) מנה זה לפלוני טול מנה זה לפלוני יהא מנה זה לפלוני בידך, אם רצה להחזיר יחזיר. וגרסינן נמי התם: תן מנה זה לפלוני ומת אם רצו היורשים לכופו אינן יכולין, אין צריך לומר באומר זכה לו באומר התקבל לו.
משמע דהתקבל עדיף מתן וצריך לדקדק אי הוי כזכה כיון שהוא משוה אותן כאן ואפילו במתנה ליקני ואם בא לחזור אינו חוזר.
הולך מנה לפלוני והלך ובקשו ולא מצאו תני חדא יחזרו למשלח ותניא אידך [יחזרו] ליורשי מי שנשתלחו לו. ואוקמה רבי אבא בר ממל דכולי עלמא הולך לאו כזכה ולא קשיא הא בבריא הא בשכיב מרע. ופירש הר"י ז"ל (מובא בתוס') ואף על גב דלא קני אלא לאחר מיתת הנותן אפילו הכי קני אף על גב דמית מקבל בחיי נותן כי לכך נתכוון הנותן שכיון שישנו למקבל בשעת מתן מעות יזכה לאחר מיתה אם הוא קיים ואם לאו יזכו יורשיו של מקבל ואפילו נולדו יורשיו של מקבל לאחר מיתת מקבל, משום דדברי שכיב מרע לענין לקנות לאחר מיתתו חשובין ככתובין וכמסורין משעת נתינתו או אמירתו של שכיב מרע למקבל לזכות לאלתר. ושמא נאמר שאין אנו צריכין לכל זה, דהכא הכי קאמר דכולי עלמא הולך לאו כזכה ולא קשיא הא בבריא הא בשכיב מרע כלומר כי אמרינן הולך לאו כזכה הני מילי בבריא אבל בשכיב מרע כיון דדבריו ככתובין וכמסורין אלים דיבוריה למיהוי הולך דידיה כזכי, וכדאמרינן לקמן ( ) בבריא כולי עלמא לא פליגי כי פליגי בשכיב מרע, ובפלוגתא דרבי אלעזר ורבנן וכו' כלומר דמאן דסבירא ליה כרבנן דדברי שכיב מרע ככתובין הולך דידיה אלים למיהוי כזכי ומאן דאית ליה כרבי אלעזר דדברי שכיב מרע לא עדיפי מבריא הולך דידיה נמי לאו כזכי. כנ"ל. ורב זביד אוקמינהו לתרווייהו בשכיב מרע, הא דאיתיה למקבל בשעת מתן מעות, הא דליתיה למקבל בשעת מתן מעות. ורב פפא אוקמינהו בבריא הא דמית מקבל בחיי נותן הא דמית נותן בחיי מקבל. וכולהו הולך לאו כזכה סבירא להו במתנה והילכך מית המקבל בחיי נותן יחזרו למשלח דהא שליח לא זכה לו ואף על גב דמית ליה נמי נותן לאחר מיתת מקבל עד שלא החזיר לו שליח מחזיר ליורשי משלח דכיון דמית ליה מקבל בחייו נתבטל שליחותו לגמרי והרי הן פקדון אצלו מחמת נותן ולא שייך בהא מצוה לקיים דברי המת שכבר נתבטלו דבריו בחייו, אבל מית נותן בחיי מקבל מיד זכה לו שליח משום מצוה לקיים דברי המת ואף על גב דמית ליה לבסוך מקבל, יחזיר ליורשיו שהרי זכה בחייו לו וליורשיו.
ואיבעית לן לימא הולך כזכה תנאי היא דתניא הולך מנה לפלוני הלך ובקשו ולא מצאו וכו', ואהדרינן,
לא בבריא כולי עלמא לא פליגי, והכא במאי עסקינן בשכיב מרע ובפלוגתא דרבי אלעזר ורבנן. תנא קמא דאמר יחזרו למשלח אף על גב דמית כרבי אלעזר דאמר אחד בריא ואחד מסוכן נכסים שאין להם אחריות אין נקנין אלא במשיכה, ויש אומרים דאמרו יחזרו ליורשי מי שנשתלחו לו, כדרבנן דרבי אלעזר דאמרי דברי שכיב מרע ככתובין וכמסורין דמי, ואף על גב דלא מית נמי משום דכיון שמסרם לשליח לדעת שיתן לו מעתה מיד זכה לו שליח דהולך דשכיב מרע כזכי דמי. ומיהו דוקא בשמסרם לשליח אבל באומר תנו לא, דאף על גב דאמרינן דדבריו ככתובין וכמסורין הני מילי במה שהוא מצוה לתת לאחר מותו דהיינו מתנת שכיב מרע אבל במה שהוא נותן במתנת בריא לא, אלא דהכא הכי קאמר כיון דדבריו ככתובין וכמסורין במתנותיו מה שאין כן בבריא אף הולך דידיה כזכי אף על גב דבבריא ליתיה כנ"ל. ולהאי אוקמתא קיימא לן כיש אומרים דקאי כרבנן וקיימא לן נמי כרבי מאיר דאמר מצוה לקיים דברי המת וכדאמרינן בשילהי שמעתין (טו, א) אמר רב יוסף הלכה כרבי שמעון הנשיא.

בריא שמינה שליח למתנה ואמר לו הולך מנה זה לפלני שאני נותן לו והלך ומצאו שמת יחזרו לראובן שכל שבמתנה אין הולך כזכי והלכך לא זכה המקבל עד שיגיע לידו והואיל ומת קודם שיזכה בהם לא זכו בו יורשיו ויחזרו למשלח ואם מת המשלח גם כן רואין אם מת זה שנשתלחו לו בחיי נותן יחזרו ליורשי נותן שהרי המקבל לא זכה בהם כלל שיזכו בהם יורשיו אבל אם מת נותן תחלה ינתנו ליורשי מקבל שבשעת מיתת הנותן זכה בהם המקבל מטעם מצוה לקיים דברי המת שהוא נאמר אף בבריא והואיל וזכה באותה שעה זכו בהם יורשיו:
היה הנותן שכיב מרע ומינה שליח ואמר לו הולך מנה זה לפלני שנמצא זוכה משעת המתנה שדברי שכיב מרע ככתובין וכמסורין דאמו אם היה המקבל חי בשעה שאמר השכיב מרע כן זכה ואם מת אחר כן ינתנו ליורשיו אבל אם בשעה שאמר השכיב מרע כן לא היה המקבל חי אלא שהשכיב מרע היה סבור עליו שהוא חי יחזרו ליורשי משלח שהרי לא זכה המקבל מאחר שלא היה חי באותה שעה שאין קנין למת זה שביארנו במתנה זו שאם שכיב מרע היה זכה המקבל מיד לא סוף דבר בשמת אלא אע"פ שלא מת השכיב מרע המשלח שכל שלא חזר מתנתו מתנה וינתנו ליורשי מי שנשתלחו לו ומכל מקום אם רצה לחזור אפי' הגיע ליד המקבל יכול לחזור ואע"פ שבשכיב מרע אף במתנה הולך כזכי הרי אף אם זיכה לו על ידי אחר בהדיא יכול לחזור כמו שביארנו בתשיעי של בתרא:
כבר ידעת שהבריא אין קונין ממנו אלא באחד מדרכי ההקנאות נכסים שיש להם אחריות בכסף ושטר וחזקה ושאין להם אחריות במשיכה ושאר מיני ההקנאות כמו שמפורשות במקומן אבל שכיב מרע קונין ממנו באמירה בעלמא שדבריו ככתובין וכמסורין דמו:
כבר ביארנו שאף בבריא אומרין מצוה לקיים דברי המת וכמו שמפורש בהדיא בסוגיא זו ושכיב מרע מיהא אין צריך בו למצוה זו שדבריו ככתובים וכמסורים דמו:

תוספות בד"ה הא בשכ"מ אור"י אע"ג כו' דכיון שישנו למקבל בשעת מתן מעות כו' עד סוף הדיבור. לכאורה נראה מדבריהם שכתבו בשעת מתן מעות משמע דדוקא כה"ג שמסר המעות ליד השליח אמרינן דמסתמא היה דעת הנותן שיזכה המקבל משעת מתן מעות משא"כ בלא מתן מעות לא אמרינן הכי וכעין שכתבתי בסמוך בלשון רש"י ז"ל אלא דממה שכתבו בסוף הדיבור משעת נתינת שכ"מ או אמירתו אלמא דבאמירה לחוד דהיינו סתם מתנת שכ"מ נמי דינא הכי דקנה למפרע משעת הצוואה וכן נראה מלשון התוספות לקמן בד"ה ורבי יהודא הנשיא ונראה דלא משמע להו לפרש כפי' רש"י ז"ל דטעמא משום דהולך דשכ"מ היינו כזכי ואפשר משום דס"ל דא"א לומר כן דקי"ל כל דליתא בבריא ליתא בשכ"מ אלא בזה לחוד דאמירה דידיה היינו ככתובים וכמסורים ולא משמע להו לחלק בסברא זו שכתבתי ומצאתי בשם הרמ"ה ז"ל לכך הוכרחו לפרש בענין אחר דבאמת טעמא דמילתא דשכ"מ היינו משום דכמסורין דמי למפרע והתמיה על הרב ב"י בח"מ סי' קכ"ה שהביא לשון רש"י ולשון הטור שהם דברי התוספות ולא הרגיש שיש מחלוקת לדינא ביניהם ואף שיש לדחוק דשעת אמירתו שכתבו התוספות היינו נמי בהולך דוקא אלא שלא מסר לידו עכשיו כגון שהמנה מונח אצל השליח מקודם אבל בצוואת שכ"מ גרידא לא מ"מ מסתימת לשון התוס' שלא זכרו כלל הלשון הולך כזכי בשכ"מ וכן מסתימת לשונם בד"ה ור' יהודה הנשיא משמע להדיא דבכל ענין איירי וא"כ מה שכתבו בתחלת דבריהם בשעת מתן מעות היינו משום דלשון הברייתא איירי בהכי ולאו דוקא אלא ה"ה לשעת אמירה בצוואה גרידא כן נ"ל ודו"ק:
רש"י בד"ה מספקא להו אי כזכי דמי או לא ואי מצוה לקיים או לא עכ"ל. וקשיא לי מי הכריחו לפרש דמספקא להו בתרתי מילי דהא בחדא מינייהו סגי נהי דבמה שלא רצה לפרש דלא מספקא להו אלא אי מצוה לקיים אבל בהולך פשיטא להו דלאו כזכי מצינן למימר משום דמשמע לרש"י ז"ל דמילתא דחכמים קאי נמי ארישא דברייתא היכא דלא מת המשלח ובהא ליכא ספיקא אלא בהולך כזכי ועי"ל דלשיטת רש"י ז"ל דשודא היינו לפי מה שראה השליח בדעת המשלח אם נתן בעין יפה ולפ"ז נראה ברור דזה לא שייך אלא לענין ספיקא דהולך כזכי משום דהולך תרי לישני משמע כדאיתא בפ' התקבל וא"כ תלוי שפיר בשודא אם הנותן נתן בעין יפה מסתמא פי' בדעתו לזכות לו מיד והולך וזכי קאמר וכן להיפך משא"כ לענין מצוה לקיים לא שייכא האי שודא שהרי אין תלוי הדבר בדעת הנותן. ומש"ה הוצרך רש"י ז"ל לפרש דמספקא להו לרבנן בהולך כזכי אבל אי קשיא הא קשיא דילמא לא מספקא להו אלא בהולך כזכי אבל במצוה לקיים סברי דלא אמרי' ואפ"ה סברי שפיר דבין ברישא ובין בסיפא אמרינן שודא וצ"ע:

אָמַר לֵיהּ אַמַאי תַּעָבִיד הָכִי. פירש רש"י שנתרצית להחזיר מיד. וקשה אמאי לא פירש על מה שאמר טב רמו ליה? ונראה לי בס"ד דאי משום הא הוה ליה למימר 'אמאי עבדת הכי' לשון עבר אך 'תיעבד' משמע לשון הווה ורגיל יען כי מוכיחו על סברתו בעיקר הדין דמשמע דהוא רגיל בכל האי גוונא לפסוק הדין דרשאי להחזיר ולית ליה האי הלכתא דאם בא לחזור אינו חוזר. והא דלא הוכיחו רבי יוסי לרבי דוסתאי אחר שפירש מהם יש לומר דהיה בכעס עמו על הדבר הזה ולא רצה לדבר עמו עד שבאו אצל רבי אחאי וקבל עליו לפניו.
אוֹתָם בְּנֵי אָדָם, הֵם אַמָּה וְכוֹבָעָן אַמָּה וּמְדַבְּרִים מֵחֶצְיְהֶם, וּשְׁמוֹתֵיהֶם מְבֹהָלִים. עיין מהרש"א מה שאמר הפך פירוש רש"י והלשון מוכח יותר כפירוש מהרש"א ואמאי פירש רש"י שהיו גבוהי קומה יותר? נראה לי כי הוא אומר שנתבהל ממראיהם וקצר הקומה ביותר אין נבהלים ויראים ממנו אלא אדרבה הוא יהיה ללעג וקלס ונבזה בעיני רואיו ולכך הוצרך רש"י לפרש שהיו גבוהי הקומה ביותר.
אָמַר לֵיהּ בְּנֵי אָדָם הַלָּלוּ קְרוֹבִים לַמַּלְכוּת הֵם. קשה כיון דאמר לו 'אוֹמְרִים הֲרֹגוּ הוֹרְגִין' מה צורך לידע אם קרובין למלכות? ונראה לי אף על גב דאמר הכי לא הוה ניחא ליה לרב אחאי בחששה זו דרבי דוסתאי דאמר לא חשידי בהכי ואחר ששאל לו שאלות אלו אז אמר יפה עשית דחששת בכך ושפיר עבדתה. ועוד נראה לי בס"ד כי מה שאמר לו רבי אחאי בתחלה אַמַאי תַּעָבִיד הָכִי ודאי אין לפרש הכונה על מה שאמר טַב רָמוּ לֵיהּ כי דבר זה מובן מאיליו דמה שאמר כן הוא מחמת יראה ועל זה אין צריך לשאול, ורק הכונה הוא כמו שכתב רש"י למה נתרצית מיד להחזיר דהיה ראוי שתאמר להם תחלה כפי הדין איני רשאי להחזיר ואם לא היו מרוצים בדבריך אז יש לך להחזיר מחמת מורא? ולכן דקדק רש"י לכתוב 'מיד' והוא השיב אלו הם אמה וכו' אומרים כפותו כופתין וכו' פירוש מחמת שהיו תקיפים ואלמים ואנשי מידות וגבוהים בקומה יש להם גאוה גדולה ואם יאמרו לאדם לעשות כך ולא יעשה תכף, הורגים אותו! ואם כן אפילו על דבור הראשון בלבד היו כועסין והורגין לכך פחדתי להשיב להם דבר הפך רצונם. ורב אחאי אמר מן שינויים אלו שיש בהם אינו מוכח שהם בעלי גאוה לכעוס על המשיב דבר הפך דבריהם בדבור הראשון ורק ניכר שהם אלמים ותקיפים אך הגד לי אם קרובים למלכות ואם יש להם סוסים וכו'? ואמר לו הן! אז אמר לו זה סימן שהם בעלי גאוה גדולה ולכן יפה עשית שחששת אפילו על דבור אחד הראשון שלא להשיב הפך דבריהם. ודע כי מן השאלות אלו ששאלו רבי אחאי מוכח דרבי אחאי לא ראה אותם ולא הפקיד הכלי אצלם הוא בעצמו אלא יתכן אביו הפקידו אצלם והוא ירש אותו מאביו. ומה שאמר שְׁמוֹתֵיהֶן מְבֹהָלִין יתכן אותם השמות היו משונים באותו זמן שלא היה נמצא כמותם וכדמותן אצל שאר בני אדם ויתכן אלו היו אחים ושותפין אחד שמו אדרא ואחד ארטא ואחד פילי ויתכן שמות אלו היו של עצים חזקים וגדולים באותו זמן.

אֲמַר לְהוּ לְרַבִּי דּוֹסְתַּאי בַּר רַבִּי יַנַּאי וּלְרַבִּי יוֹסֵי בַּר כֵּיפַר: בַּהֲדֵי דְּאָתֵיתוּ, אַתְיוּהּ נִיהֲלִי. אֲזוּל, יַהֲבֵיהּ נִיהֲלֵיהּ. אָמְרִי לְהוּ: נִקְנֵי מִינַּיְיכוּ; אָמְרִי לְהוּ: לָא. אָמְרִי לְהוּ: אַהְדְּרֵיהּ נִיהֲלַן.
Rabbi Aḥai said to Rabbi Dostai bar Rabbi Yannai and to Rabbi Yosei bar Keifar: When you come from Neharde’a bring the vessel to me. They went to Neharde’a and the people who were in possession of the vessel gave it to them. After handing over the vessel, those people said to them: Let us perform an act of acquisition with you, so that you will be responsible for the vessel until you reach Rabbi Aḥai. The agents said to them: No; we do not want to do this. They said to them: If so, return the vessel to us, as we do not wish to transfer it in such a manner that we retain responsibility.
רַבִּי דּוֹסְתַּאי בְּרַבִּי יַנַּאי אֲמַר לְהוּ: אִין; רַבִּי יוֹסֵי בַּר כֵּיפַר אֲמַר לְהוּ: לָא. הֲווֹ קָא מְצַעֲרוּ לֵיהּ, אֲמַר לֵיהּ: חֲזִי מָר הֵיכִי קָא עָבֵיד! אֲמַר לְהוּ: טָב רְמוֹ לֵיהּ.
Rabbi Dostai, son of Rabbi Yannai, said to them: Yes, I am willing to return it. However, Rabbi Yosei bar Keifar said to them: No, as you do not have the right to retract in this situation. They tormented Rabbi Yosei bar Keifar to force him to agree to return the vessel. Rabbi Yosei bar Keifar said to Rabbi Dostai: See, my Master, what they are doing to me. Rabbi Dostai said to them: You are acting well; hit him.
כִּי אֲתוֹ לְגַבֵּיהּ, אֲמַר לֵיהּ: חֲזִי מָר, לָא מִיסָּתְיֵיהּ דְּלָא סַיְּיעַן, אֶלָּא אֲמַר לְהוּ נָמֵי ״טָב רְמוֹ לֵיהּ״! אֲמַר לֵיהּ: אַמַּאי תֶּיעְבֵּד הָכִי?
When these two agents came before Rabbi Aḥai, Rabbi Yosei bar Keifar said to him: See, my Master, not only did Rabbi Dostai not support me; rather, he even said to them: You are acting well; hit him. Rabbi Aḥai said to Rabbi Dostai: Why did you do this?
אֲמַר לֵיהּ: אוֹתָן בְּנֵי אָדָם – הֵן אַמָּה, וְכוֹבָעָן אַמָּהּ, וּמְדַבְּרִין מֵחֶצְיֵיהֶן, וּשְׁמוֹתֵיהֶן מְבוֹהָלִין: ׳אַרְדָּא׳ וְ׳אַרְטָא׳ וּ׳פִילֵי בְּרֵישׁ׳; אוֹמְרִין ״כְּפוֹתוּ״ – כּוֹפְתִין; אוֹמְרִין ״הֲרוֹגוּ״ – הוֹרְגִין; אִילּוּ הָרְגוּ אֶת דּוֹסְתַּאי, מִי נָתַן לְיַנַּאי אַבָּא בַּר כְּמוֹתִי.
Rabbi Dostai said to him: Those people who were in possession of the vessel, they are the size of a cubit, and their hats were a cubit, and they spoke from their midpoints, and their names were frightening: Arda and Arta and Pili Bereish. If one were to say to them: Restrain this person, they would restrain him. If one were to say to them: Kill him, they would kill. Had they killed Dostai, i.e., me, who would give Yannai, my father, another son like me?
אֲמַר לֵיהּ: בְּנֵי אָדָם הַלָּלוּ קְרוֹבִים לַמַּלְכוּת הֵן? אָמַר לֵיהּ: הֵן. יֵשׁ לָהֶן סוּסִים וּפְרָדִים שֶׁרָצִים אַחֲרֵיהֶן? אֲמַר לֵיהּ: הֵן. אֲמַר לֵיהּ: אִי הָכִי, שַׁפִּיר עֲבַדְתְּ.
Rabbi Aḥai said to him: Are these people close to the government? Rabbi Dostai said to him: Yes. Rabbi Aḥai asked him: Do they have horses and mules that run after them, i.e., do they have servants to perform their bidding? Rabbi Dostai said to them: Yes. Rabbi Aḥai said to him: If so, you acted well, as the situation was entirely out of your control.
״הוֹלֵךְ מָנֶה לִפְלוֹנִי״, וְהָלַךְ וּבִקְּשׁוֹ וְלֹא מְצָאוֹ – תָּנֵי חֲדָא: יַחְזְרוּ לַמְשַׁלֵּחַ; וְתַנְיָא אִידַּךְ: לְיוֹרְשֵׁי מִי שֶׁנִּשְׁתַּלְחוּ לוֹ.
§ The Gemara discusses the meaning of the expression: Deliver, in relation to a gift. With regard to one who said to his agent: Deliver one hundred dinars to so-and-so, and the agent went and searched for that person but did not find him, as he had died, it is taught in one baraita : The money should be returned to the sender. And it is taught in another baraita : The money should be given to the heirs of the one to whom it was sent.
לֵימָא בְּהָא קָמִיפַּלְגִי – דְּמָר סָבַר: ״הוֹלֵךְ״ כִּ״זְכִי״, וּמָר סָבַר: ״הוֹלֵךְ״ לָאו כִּ״זְכִי״?
The Gemara suggests: Let us say that they disagree about this, as one Sage, in the second baraita , holds that in the case of a gift, saying: Deliver, is like saying: Acquire, and consequently the agent took possession of the money on behalf of the one to whom it was sent. Therefore, the heirs inherit this item. And one Sage, in the first baraita , holds that in the case of a gift, saying: Deliver, is not like saying: Acquire, and therefore the agent must return the money to the sender.
אָמַר רַבִּי אַבָּא בַּר מֶמֶל: דְּכוּלֵּי עָלְמָא ״הוֹלֵךְ״ לָאו כִּ״זְכִי״; וְלָא קַשְׁיָא – הָא בְּבָרִיא, הָא בִּשְׁכִיב מְרַע.
Rabbi Abba bar Memel said: No; everyone agrees that in the case of a gift, saying: Deliver, is not like saying: Acquire, and the apparent contradiction between the two baraitot is not difficult: This baraita , which says that the agent must return the money to the sender, is dealing with a case where the giver was a healthy person when he issued the instructions. Such a gift is acquired by the recipient only once it reaches his possession, and this recipient died before the gift reached him. Conversely, that baraita , which says that he should give it to the heirs of the one to whom it was sent, deals with the instructions of a person on his deathbed. Since the gift of a dying person is immediately acquired by the recipient, this recipient acquired it straightaway, and therefore it must be given to his heirs.
רַב זְבִיד אָמַר: הָא וְהָא בִּשְׁכִיב מְרַע; הָא – דְּאִיתֵיהּ לִמְקַבֵּל בִּשְׁעַת מַתַּן מָעוֹת, הָא – דְּלֵיתֵיהּ לִמְקַבֵּל בִּשְׁעַת מַתַּן מָעוֹת.
Rav Zevid said: It is possible to say that saying: Deliver, is not like saying: Acquire, and that both this baraita and that baraita are dealing with a case where the giver was a person on his deathbed. Instead, the difference between the two sources is that this baraita , which states that he should give it to the recipient’s heirs, is referring to a case where the recipient was alive at the time of the giving of the money. Consequently, when the sender gives the money to the agent the recipient immediately acquires it, and his heirs claim it in his stead. That baraita , which says that the agent must return the money to the sender, is referring to a case where the recipient was not alive at the time of the giving of the money, and consequently the agent could not acquire the money on his behalf.
רַב פָּפָּא אָמַר: הָא וְהָא בְּבָרִיא; הָא – דְּמִית מְקַבֵּל בְּחַיֵּי נוֹתֵן, הָא – דְּמִית נוֹתֵן בְּחַיֵּי מְקַבֵּל.
Rav Pappa said yet another explanation of the baraita : This baraita and that baraita are both dealing with a healthy person who subsequently died. The difference is that this baraita , which said that the agent must return the money to the sender, is dealing with a case where the recipient died in the lifetime of the giver, and as he did not acquire the money himself his heirs do not take possession of it either. By contrast, that baraita , which states that the money should be given to the heirs of the recipient, is dealing with a case where the giver died in the lifetime of the recipient. Once he dies it is a mitzva to fulfill his wishes, and therefore the recipient, and his heirs after him, are entitled to the money.
לֵימָא ״הוֹלֵךְ״ כִּ״זְכִי״ תַּנָּאֵי הִיא? דְּתַנְיָא: ״הוֹלֵךְ מָנֶה לִפְלוֹנִי״, וְהָלַךְ וּבִקְּשׁוֹ וְלֹא מְצָאוֹ, יַחְזְרוּ לַמְשַׁלֵּחַ. מֵת מְשַׁלֵּחַ – רַבִּי נָתָן וְרַבִּי יַעֲקֹב אָמְרוּ: יַחְזְרוּ לְיוֹרְשֵׁי מְשַׁלֵּחַ, וְיֵשׁ אוֹמְרִים: לְיוֹרְשֵׁי מִי שֶׁנִּשְׁתַּלְחוּ לוֹ.
The Gemara further suggests: Shall we say that the issue of whether saying: Deliver, is like saying: Acquire, is a dispute between tanna’im ? This is as it is taught in a baraita , that if one person said to another: Deliver one hundred dinars to so-and-so, and he went and searched for him but did not find him, as he had died, the money should be returned to the sender. If the sender died, Rabbi Natan and Rabbi Ya’akov said: The money should be returned to the heirs of the sender. And some say: It should be given to the heirs of the one to whom it was sent.
רַבִּי יְהוּדָה הַנָּשִׂיא אָמַר מִשּׁוּם רַבִּי יַעֲקֹב, שֶׁאָמַר מִשּׁוּם רַבִּי מֵאִיר: מִצְוָה לְקַיֵּים דִּבְרֵי הַמֵּת. וַחֲכָמִים אוֹמְרִים: יַחְלוֹקוּ. וְכָאן אָמְרוּ: כֹּל מַה שֶּׁיִּרְצֶה שָׁלִיחַ – יַעֲשֶׂה. אָמַר רַבִּי שִׁמְעוֹן הַנָּשִׂיא: עַל יָדִי הָיָה מַעֲשֶׂה, וְאָמְרוּ: יַחְזְרוּ לְיוֹרְשֵׁי מְשַׁלֵּחַ.
The baraita continues: Rabbi Yehuda HaNasi said in the name of Rabbi Ya’akov, who said this in the name of Rabbi Meir: It is a mitzva to fulfill the statement of the dead. Therefore the money should be given to the heirs of the one to whom it was sent. And the Rabbis say: Due to the uncertainty, they should divide it. And here, in Babylonia, they said: Whatever the agent wishes to do he may do. Rabbi Shimon HaNasi said: When an incident of this kind occurred under my jurisdiction I inquired into how to proceed, and the Sages said to me: The money should be returned to the heirs of the sender.
מַאי, לָאו בְּהָא קָמִיפַּלְגִי – דְּתַנָּא קַמָּא סָבַר: ״הוֹלֵךְ״ לָאו כִּ״זְכִי״; וְרַבִּי נָתָן וְרַבִּי יַעֲקֹב נָמֵי – ״הוֹלֵךְ״ לָאו כִּ״זְכִי״, וְאַף עַל גַּב דְּמִית, לָא אָמְרִינַן ״מִצְוָה לְקַיֵּים דִּבְרֵי הַמֵּת״; וְיֵשׁ אוֹמְרִים – ״הוֹלֵךְ״ כִּ״זְכִי״;
The Gemara suggests: What, is it not correct to say that they disagree about this issue, that the first tanna holds that saying: Deliver, is not like saying: Acquire, and therefore the money should be returned to the sender? And Rabbi Natan and Rabbi Ya’akov also hold that saying: Deliver, is not like saying: Acquire, but they add that even though the sender died, one does not say: It is a mitzva to fulfill the statement of the dead. Consequently, the money is returned to the sender’s heirs. And the Sages in the clause beginning: Some say, claim that saying: Deliver, is like saying: Acquire. Therefore the recipient takes possession of the money immediately, and it is given to his heirs.
רַבִּי יְהוּדָה הַנָּשִׂיא אָמַר מִשּׁוּם רַבִּי יַעֲקֹב שֶׁאָמַר מִשּׁוּם רַבִּי מֵאִיר – ״הוֹלֵךְ״ לָאו כִּ״זְכִי״, מִיהוּ, הֵיכָא דְּמִית, אָמְרִינַן מִצְוָה לְקַיֵּים דִּבְרֵי הַמֵּת;
And Rabbi Yehuda HaNasi, who said in the name of Rabbi Ya’akov, who said this in the name of Rabbi Meir, also holds that saying: Deliver, is not like saying: Acquire. However, in a case where the sender died we say that it is a mitzva to fulfill the statement of the dead. Therefore, the one hundred dinars should be given to the recipient or his heirs.
וַחֲכָמִים אוֹמְרִים: יַחְלוֹקוּ – מְסַפְּקָא לְהוּ; וְכָאן אָמְרוּ – שׁוּדָא עָדִיף; וְרַבִּי שִׁמְעוֹן הַנָּשִׂיא – מַעֲשֶׂה אֲתָא לְאַשְׁמוֹעִינַן.
And the Rabbis say: They should divide it, because they are uncertain about the halakha in this situation. And the Sages in the clause beginning: Here they said, maintain that in this case the discretion [ shuda ] of the agent is preferable to an even division between the parties. And Rabbi Shimon HaNasi does not offer an opinion of his own; rather, he came to teach us an incident in which this case was decided in practice.
לָא, בְּבָרִיא דְּכוּלֵּי עָלְמָא לָא פְּלִיגִי; וְהָכָא בְּמַאי עָסְקִינַן – בִּשְׁכִיב מְרַע, וּבִפְלוּגְתָּא דְּרַבִּי אֶלְעָזָר וְרַבָּנַן קָמִיפַּלְגִי.
The Gemara rejects this suggestion: No; it is possible that in a case where the giver was a healthy person when he appointed the agent everyone agrees that saying: Deliver, is not like saying: Acquire, and with what are we dealing here? We are dealing with a person on his deathbed who sent these one hundred dinars, and they disagree in the dispute between Rabbi Elazar and the Rabbis.
דִּתְנַן: הַמְחַלֵּק נְכָסָיו עַל פִּיו, רַבִּי אֶלְעָזָר אוֹמֵר: אֶחָד בָּרִיא וְאֶחָד מְסוּכָּן; נְכָסִים שֶׁיֵּשׁ לָהֶן אַחְרָיוּת – נִקְנִין בְּכֶסֶף וּבִשְׁטָר וּבַחֲזָקָה, וְשֶׁאֵין לָהֶן אַחְרָיוּת – אֵין נִקְנִין אֶלָּא בִּמְשִׁיכָה. וַחֲכָמִים אוֹמְרִים: אֵלּוּ וָאֵלּוּ נִקְנִין בַּאֲמִירָה.
This is as we learned in a mishna ( Bava Batra 156a): With regard to one who divides his property orally, Rabbi Elazar says: Both in the case of a healthy person and that of a dangerously ill person, property that serves as a guarantee, i.e., land, is acquired by means of money, through a document, or by taking possession. And property that does not serve as a guarantee, i.e., movable property, can be acquired only through pulling. And the Rabbis say: If the giver is on his deathbed, then both this property and that property can be acquired through speech, and there is no need for an additional act of acquisition.
אָמְרוּ לוֹ: מַעֲשֶׂה בְּאִמָּן שֶׁל בְּנֵי רוֹכֵל שֶׁהָיְתָה חוֹלָה, וְאָמְרָה: ״תִּינָּתֵן
They said to Rabbi Elazar: Didn’t an incident of this kind occur with regard to the mother of the family of the sons of Rokhel, who was ill, and she said: Give
