    “Six for voluntary gifts.” Ḥizqiah said, corresponding to the six clans 165 During the week of service of a “watch” of Cohanim, each of the six workdays another clan would serve, whose members then had claim to all hides of elevation offerings of that day. In B, the statement is ascribed to Rav, Ḥizqiah’s cousin, and fellow student of the Elder R. Hiyya, Rav’s uncle and Ḥizqiah’s father. . Samuel said, corresponding to six sacrifices: the nests of the sufferer from gonorrhea, the nests of the sufferer from flux, the nests of the new mother, purification sacrifices, and reparation sacrifices, flour offerings, and the Tenth of an Ephah 166 This list has 7 items. The corresponding list in B has only six, but the selection in unconvincing. Probably the correct list is Tosephta 3:7 : The excesses of money for 1) purification sacrifices, 2) reparation sacrifices, 3) nests of sufferers from gonorrhea or flux, 4) nests of a woman after childbirth, 5) offerings of a nazir , 6) of a healed sufferer from skin disease. . Rebbi Joḥanan said, because the gifts were many, they added many horns for it. [As it is said] 167 This addition by the corrector, taken from B, has to be deleted, since it hides the fact that the following quote is the start of a question. The remaining additions by the corrector, while unnecessary, are not in conflict with the line of thought. , when they were finished they brought before the king and Jehoyada 168 2 Chr. 24:14. The problem is that the remaining part of the verse, quoted in full in ג nd B, notes that the excess money donated for the renovation of the Temple under King Joash was used to make silver and gold vessels for the Temple, while the corresponding verse in 2K. 12:14 declares the opposite. etc. Rebbi Samuel ben Naḥman in the name of Rebbi Jonathan [said], two voluntary gifts 169 The two verses refer to two separate collections. . Rebbi Ismael stated, one gift. [כִּי קָאָמְרִינָן. בְּחַטָּאת שֶׁמֵּתוּ בַעֲלֵיהֶן וַדַּאִי. וְאִי אָמְרִינָן. נִבְרוֹר ד׳ זוּזֵי וְנַשְׁדֵּי בִּנְהָרָא וְאִידָּךְ לִישְׁתְּרוּ. הָא אָמְרִינָן בָעָלְמָא. רִבִּי יְהוּדָה לֵית לֵיהּ בְּרֵירָה.]

    MISHNAH: Coins which are found between the sheqalim and the voluntary gifts, if closer to sheqalim they have to be given to sheqalim , closer to voluntary gifts to voluntary gifts; in the middle they have to be given to voluntary gifts 1 As explained at the end of the Mishnah, in general coins found are assigned to the box closest to the place where the coins were found. Only if the coins are strictly in the middle between two boxes they are assigned to the more holy use. Since voluntary gifts are strictly for elevation offerings but sheqalim are used for all needs of the Temple, voluntary gifts represent the more holy use. . Between wood and incense, if closer to wood they have to be given to wood, closer to incense to incense; in the middle they have to be given to incense 2 Incense is an offering in itself, whereas wood is only an auxiliary to offerings on the altar; incense is more holy. . Between nests and young birds for elevation sacrifices, if closer to nests they have to be given to nests, closer to young birds for elevation sacrifices to young birds for elevation sacrifices; in the middle they have to be given to young birds for elevation sacrifices 3 According to the rabbis, nests contain one bird as purification offering and one as elevation offering, whereas young birds for elevation sacrifices are all elevation sacrifices; the latter are more holy. . Between profane money and Second Tithe \4 , if closer to profane money they have to be given to profane money, closer to Second Tithe to Second Tithe; in the middle they have to be given to Second Tithe. This is the principle: one follows proximity; in the middle one is stringent.

    רִבִּי יוֹסֵה בֵּירִבִּי בּוּן אָמַר. רִבִּי בָּא בַּר מָמָל בָּעֵי. אָמַר הֲרֵי עָלַי עֵץ. מְבִיא גֵּיזָר אֶחָד. אָמַר רִבִּי לָעְזָר. מַתְנִיתָא אָמְרָה כֵן. שֶׁזֶּה קָרְבָּן בִּפְנֵי עַצְמוֹ וְזֶה קָרְבָּן בִּפְנֵי עַצְמוֹ. כָּהִיא דְתַנִּינָן תַּמָּן. שְׁנַיִם בְּיָדָם שְׁנֵי גְיזִירֵי עֵצִים. לְרַבּוֹת אֶת הָעֵצִים.

    HALAKHAH: “Coins which are found between the sheqalim and the voluntary gifts,” etc. It would only be necessary between sheqalim and nests 5 Since Mishnah 6:7 states that the horn for nests is next to the two for sheqalim , how can coins be found between sheqalim and gifts? !     רִבִּי יְהוֹשֻׁעַ בֶּן לֵוִי אָמַר. עוֹבְיָין (כַּמָּה חוֹקוֹת) [בָּאַמָּה שׁוֹחֲקוֹת]. וְאָרְכָּן (אַמָּה גַמּוּדָה) [כְּאַמָּה גְּרוֹמָה]. רִבִּי חוֹנִי בְשֵׁם רִבִּי אִמִּי. כְּמִין טוֹרְטָנִי. אָמַר רִבִּי שְׁמוּאֵל בַּר רַב יִצְחָק. לְפִי שֶׁלֹּא הָיָה מְקוֹם הַמַּעֲרָכָה אֶלָּא אַמָּה עַל אַמָּה לְפִיכָךְ לֹא הָיָה בוֹ אֶלָּא אַמָּה (גַמּוּדָה) [גְּרוֹמָה]. וְתַנֵּי כֵן. אַמָּה הַיְּסוֹד אַמָּה סוֹבֵב אַמָּה כַּרְכּוֹב וְאַמָּה קְרָנוֹת וְאַמָּה מַעֲרָכָה.

    And it is difficult. The sentence and the next are reproduced at the end of the Chapter (7). ? Rebbi Isaac said, it is a stipulation of the Court that the providers of nests also provide the disqualified ones 14 The provider has to provide a few extra birds which are treated as possible purification offerings (a situation impossible for four-legged animals) but are not eaten. . Would it not also be necessary between incense and wood, and frankincense, and gold for the cover 15 The Mishnah does not treat a number of other possible cases. ? As it is stated at the end, “one follows nearness; in the middle one is stringent.”

    MISHNAH: Coins found near vendors of animals always are Tithe money 16 Most kosher animals sold in Jerusalem are sold to pilgrims who use their tithe money for their living expenses in Jerusalem. If not all this money is spent during their visit, the remaining coins used to be given to their hosts, to be used to buy food consumed in purity according to the rules of second Tithe. Therefore the presumption is that money in the hand of resident Jerusalemites found near venders of animals for slaughter is Second Tithe money. The finder will have to use the coins according to Tithe standards. . On the Temple Mount, profane. In Jerusalem, during the remainder of the year they are profane, during the holidays everything is Second Tithe. One has to wait until the time allotted for each kind having passed and the meat automatically becoming disqualified; this is the remainder of the day for elevation sacrifices, the remainder of the day plus the following night for purification sacrifices, and the following day for well-being sacrifices. . If it was found in the countryside 26 Palestine outside of Jerusalem and its surroundings. , limbs are carrion 27 Since the butcher did not care to cut it into slices, one must assume that it was notkosher and thrown away for the dogs. , cuts are permitted 28 If there are no sources of non-kosher meat in the neighborhood. .     משנה: מָעוֹת שֶׁנִּמְצְאוּ בֵּין שְׁקָלִים לִנְדָבָה קָרוֹב לַשְּׁקָלִים יִפָּלוּ לַשְּׁקָלִים לַנְּדָבָה יִפְּלוּ לַנְּדָבָה מֶחֱצָה לְמֶחֱצָה יִפְּלוּ לַנְּדָבָה. בֵּין עֵצִים לִלְבוֹנָה קָרוֹב לָעֵצִים יִפְּלוּ לָעֵצִים לַלְּבוֹנָה יִפְּלוּ לַלְּבוֹנָה מֶחֱצָה לְמֶחֱצָה יִפְּלוּ לַלְּבוֹנָה. בֵּין קִנִּים לְגוֹזְלֵי עוֹלָה קָרוֹב לַקִּנִּים יִפְּלוּ לַקִּינִּים לְגוֹזְלֵי עוֹלָה יִפְּלוּ לְגוֹזְלֵי עוֹלָה. מֶחֱצָה לְמֶחֱצָה יִפְּלוּ לְגוֹזְלֵי עוֹלָה. בֵּין חוּלִּין לְמַעֲשֵׂר שֵׁנִי קָרוֹב לַחוּלִּין יִפְּלוּ לַחוּלִּין לְמַעֲשֵׂר שֵׁנִי יִפְּלוּ לְמַעֲשֵׂר שֵׁנִי מֶחֱצָה לְמֶחֱצָה יִפְּלוּ לְמָעֲשֵׂר שֵׁנִי. זֶה הַכְּלָל הוֹלְכִין אַחַר הַקָּרוֹב מֶחֱצָה לְמֶחֱצָה לְהַחְמִיר:

    הלכה: מָעוֹת שֶׁנִּמְצְאוּ בֵּין שְׁקָלִים לִנְדָבָה כול׳. לָא צוֹרְכָה דְלָא בֵין שְׁקָלִים לִקִינִּים. רִבִּי אָבוּן בְשֵׁם רִבִּי פִינְחָס. כְּמִין כּוֹכְלִיַים הָיוּ עֲשׂוּיִין. לָא צוֹרְכָה דְלָא מֶחֱצָה לְמֶחֱצָה יִפְּלוּ לִשְׁקָלִים. אִית דְּבָעֵי מֵימַר. שֶׁמָּא יִפְּלוּ לְשִׂיֵּרֵי הַלִּשְׁכָּה. אִית דְּבָעֵי מֵימַר. מֶחֱצָה לְמֶחֱצָה כְּמִי שֶׁמֵּת. אָמַר רִבִּי יָסָא. עַד דַּאֲנָא תַמָּן שְׁמָעִית קָל רַב יְהוּדָה שְׁאַל לִשְׁמוּאֵל. הִפְרִישׁ שִׁקְלוֹ וָמֵת. אֲמַר לֵיהּ. יִפְּלוּ לִנְדָבָה. עֲשִׂירִית הָאֵיפָה שֶׁלּוֹ. רִבִּי יוֹחָנָן אָמַר. יוֹלִיכֵם לְיַם הַמֶּלַח. רִבִּי לָעְזָר אָמַר. יִפְּלוּ לִנְדָבָה.

    וְקַשְׁיָא. וְיֵשׁ חַטָּאת קְרֵיבָה עוֹלָה. רִבִּי חִזְקִיָּה אֲחִי בְשֵׁם רִבִּי שִׁמְעוֹן בֶּן לָקִישׁ. תְּנַיי בֵית דִּין הוּא עַל הַמּוֹתָרוֹת שֶׁיִּקְרְבוּ עוֹלוֹת. הָאִשָּׁה הַזֹּאת בַּמֶּה הִיא מִתְכַּפֶּרֶת. אָמַר רִבִּי יִצְחָק. תְּנַיי בֵית דִּין הוּא. הַמְסַפֵּק אֶת הַקִּינִּים הוּא מְסַפְּק אֶת הַפְּסוּלוֹת. לָא צוֹרְכָא דְלָא בֵין קְטוֹרֶת לָעֵצִים לִלְבוֹנָה לְזָהָב לַכַּפּוֹרֶת. וְתַנִּיתָהּ בְּסוֹפָהּ. הוֹלְכִין אַחַר הַקָּרוֹב מֶחֱצָה לְמֶחֱצָה לְהַחְמִיר.

    משנה: מָעוֹת שֶׁנִּמְצְאוּ לִפְנֵי סוֹחֲרֵי בְּהֵמָה לְעוֹלָם מַעֲשֵׂר. וּבְהַר הַבַּיִת חוּלִּין. וּבִירוּשָׁלִַם בִשְׁאָר יְמוֹת הַשָּׁנָה חוּלִּין וּבִשְׁעַת הָרֶגֶל הַכֹּל מַעֲשֵׂר. בָּשָׂר שֶׁנִּמְצָא בָּעֲזָרָה אֵיבָרִים עוֹלוֹת. וַחֲתִיכוֹת חַטָּאוֹת. וּבִירוּשָׁלַיִם זִבְחֵי שְׁלָמִים. זֶה וָזֶה תְּעוּבַּר צוּרָתוֹ וְיֵצֵא לְבֵית הַשְּרֵפָה. נִמְצָא בַּגְּבוּלִין אֵיבָרִים נְבֵילוֹת וַחֲתִיכוֹת מוּתָּרוֹת. וּבִשְׁעַת הָרֶגֶל שֶׁהַבָּשָׂר מְרוּבֶּה אַף אֵיבָרִין מוּתָּרוֹת:

    הלכה: לָא צוֹרְכָה דְלָא בְּהַר הַבַּיַת קוֹדֶשׁ. רִבִּי בָּא רִבִּי חִיָיה בְשֵׁם רִבִּי יוֹחָנָן. חַזָּקָה שֶׁאֵין הַכֹּהֵן מוֹצִיא מִן הִַלִּישְׁכָּה מָעוֹת עַד שֶׁהוּא מְחַלְלָן עַל הַבְּהֵמָה.

    רִבִּי לָעְזָר בְשֵׁם רִבִּי הוֹשַׁעְיָה. הִסִּיעַ דַּעַת טָעוֹן צוּרָה. אָמַר רַב הוֹשַׁעְיָה. מַתְנִיתָה אָמְרָה כֵן. תְּעוּבַּר צוּרָתוֹ וְיֵצֵא לְבֵית הַשְּרֵפָה. אָמַר רִבִּי יוֹסֵי וְיֵאוּת. לְאוֹכְלוֹ אֵין אַתְּ יָכוֹל שֶׁמָּא נִתְקַלקְלָה צוּרָתוֹ. לְפוּם כֵן צָרַךְ מֵימַר. תְּעוּבַּר צוּרָתוֹ וְיֵצֵא לְבֵית הַשְּרֵפָה.

    רִבִּי קְרִיסְפָּא בְשֵׁם רִבִּי יוֹסֵי בֵּרִבִּי חֲנֵיִנָה. אֵיבָרִים נְבֵילוֹת לוֹקִין עֲלֵיהֵן מִשֵּׁם נְבֵילָה. מַתְנִיתָא אָמְרָה כֵן. אֵיבָרִים נְבֵלוֹת וַחֲתִיכוֹת מוּתָּרוֹת. חֲתִיכוֹת מוּתָּרוֹת לֹא מַמָּשׁ. וְדִכְוָותָהּ אֵיבָרִים נְבֵילוֹת לוֹקִין עֲלֵיהֵן מִשֵּׁם נְבֵילָה.

    רִבִּי קְרִיסְפָּא בְשֵׁם רִבִּי יוֹסֵי בֶּן חֲנִינָה. אִם הָיוּ מְחָרוֹזוֹת מוּתָּרוֹת. תַּשַׁע חֲנוּיוֹת מוֹכְרוֹת בְּשַׂר נְבֵילָה וְאַחַת מוֹכֶרֶת בְּשַׂר שְׁחוּטָה נִתְחַלְּפוּ לוֹ. חוֹשֵׁשׁ. וְלַנִּמְצֵאת הוֹלְכִין אַחַר הָרוֹב. תַּשַׁע חֲנוּיוֹת מוֹכְרוֹת בְּשַׂר שְׁחוּטָה וְאַחַת מוֹכֶרֶת בְּשַׂר נְבֵילָה נִתְחַלְּפוּ לוֹ. חוֹשֵׁשׁ. וְלַנִּמְצֵאת הוֹלְכִין אַחַר הָרוֹב.

    אָמַר רִבִּי יוֹחָנָן. הַנִּמְצָא בְיַד גּוֹי כְּנִמְצָא בַפַּלַּטְיָא. רִבִּי לָעְזָר בֵּירִבִּי חַגַּיי הֲוָה מְסַמֵּךְ לְרִבִּי מָנָא. חֲמָא לְחַד אֲרָמַאי מְקַטֵּעַ מִן סוּסֵיהּ וּמַפִּיק לִבְרָא. אֲמַר לֵיהּ. הָדָא הִיא דְאָמַר רִבִּי יוֹחָנָן. הַנִּמְצָא בְיַד גּוֹי כְּנִמְצָא בַפַּלַּטְיָא. אָמַר לֵיהּ. כֵּן אָמַר רִבִּי יוֹסֵי רִבִּי. וְהֵן שֶׂרָאוּ אוֹתוֹ יוֹצֵא מִמַּקֻּילִין שֶׁל יִשְׂרָאֵל. חַד בַּר נַשׁ בְּצִיפּוֹרִין אֲזַל בָּעֵי מִיזְבוֹן קוּפָּד מִן טַבְּחָא וְלָא יְהַב לֵיהּ. אֲמַר לֵיהּ לְחַד רוֹמַיי וְאַיְיתִי לֵיהּ. אֲמַר לֵיהּ. לָא נָסְבִּית עַל כָּרְחֵיהּ. אֲמַר. וְלָאו בְּשַׂר דִּנְבֵילָה יְהָבִית לֵיהּ. רִבִּי יִרְמְיָה בְשֵׁם רִבִּי חֲנִינָה. מַעֲשֶׂה בָא לִפְנֵי רִבִּי וְאָמַר. לָא כוּלָּא מִינֵּיהּ מֵיסּוֹר מַקֻּילִין דְּצִיפּוֹרִין.

    רַב נְחַת לְתַמָּן. חַמְתּוֹן מֵקִילוֹן וַחֲמַר עֲלֵיהוֹן. חַד בַּר נַשׁ אֲזַל בָּעֵי מְשִׁיגָּה אֵסְקוֹפְתֵּיהּ בְּגַו נַהֲרָא וְאִינְשִׁתָהּ וַאֲזַל לֵיהּ. חֲזַר בָּעֵי מִיסְבִינֵהּ. אֲמַר לֵיהּ רַב. אָסִוּר לָךְ. דָּנָא אֲמַר. הַהִיא שְׁטַף נַהֲרָא וְאַיְיתִי חוּרִי דִנְבֵילָה תוֹחְתּוֹי. חַד בַּר נַשׁ הֲוָה מְהַלֵּךְ בְּשׁוּקָא טָעִין קוּפָּד. אֲתַא דַיְיתָא וַחֲטַפְתֵּיהּ מִינֵיהּ וּטְלַקְתֵּיהּ. חֲזַר בָּעֵי מִיסְבִינֵהּ. אֲמַר לֵיהּ רַב. אֲסִיר לָךְ. דָּנָא אֲמַר. בָּשָׂר דִּנְבֵילָה הֲוָות טְעִינָה וּטְלַקְתֵּיהּ וְנָסְבָת הַהוּא אוֹחְרָנָא.

    גִּינַאי שְׁטַף זִיקִין. אֲתַא עוֹבְדָא קוֹמֵי רִבִּי יִצְחָק בַּר אֶלְעָזָר וְאָמַר. יַחְכְּמוֹן שְׁפַיָיא קִיטְרֵיהוֹן.

    נוּקְנִיקָה אִישְׁתַּכַּח בִּכְנִישְׁתָּא דְבוּלֵי. אֲתַא עוֹבְדָא קוֹמֵי רִבִּי יִרְמְיָה. אָמַר. יַחְכְּמוֹן סִיקִיָירִיָּא עֲבִידְתֵּהוֹן.

    גְּדִי צְלִי אִישְׁתַּכַּח בְּאִיסְרָטָא דְגוּפְתָּא. וְהִתִּירוּהוּ מִשֵּׁם שְׁנֵי דְבָרִים. מִשֵּׁם מְצִיאָה וּמִשֵּׁם רוֹב מְהַלְּכֵי דְרָכִים. מִשֵּׁם מְצִיאָה. דְּתַנֵּי. הַמַּצִּיל מִיַּד הָאֲרִי מִיַּד הַגַּיִיס מִשּׁוּנַת הַיָּם וּמִשּׁוּנַת הַנָּהָר וּמֵאיסְרַטְיָא גְדוֹלָה וּמִפַּלַּטְיָא גְדוֹלָה הֲרֵי אֵילּוּ שֶׁלּוֹ. מִפְּנֵי שֶׁהַבְּעָלִים מִתְיַיאֲשִׁין מֵהֶן. מִשֵּׁם רוֹב מְהַלְּכֵי דְרָכִים. מִשֵׁם שְׁחִיטַת הַגּוֹי. וְאִישְּׁתַּכַּח מִן דְּבֵית רִבִּי.

    עִיגוּל דְּגוּבְנָא אִישְׁתַּכַּח בְּפוּנְדָּקָא דְּלֵוִי. וְהִתִּירוּהוּ מִשֵּׁם שְׁנֵי דְבָרִים. מִשֵּׁם מְצִיאָה וּמִשֵּׁם רוֹב מְהַלְּכֵי דְרָכִים. מִשֵּׁם מְצִיאָה. דְּתַנֵּי. הַמַּצִּיל מִיַּד הַגַּיִיס מִיַּד הָאֲרִי מִשּׁוּנַת הַיָּם מִשּׁוּנַת הַנָּהָר מֵאִיסְטְרַטְיָה גְדוֹלָה וּמִפַּלַּטְיָא גְדוֹלָה הֲרֵי אֵילּוּ שֶׁלּוֹ. מִפְּנֵי שֶׁהַבְּעָלִים מִתְיַיאֲשִׁין מֵהֶן. מִשּׁוּם רוֹב מְהַלְּכֵי דְרָכִים. מִשּׁוּם גְּבִינַת גּוֹי. וְאִישְּׁתַּכַּח מִן דְּרִבִּי אֶלְעָזָר בֵּירִבִּי יוֹסֵי.

    אָמַר רִבִּי מָנָא קוֹמֵי רִבִּי יוֹסֵי. וַאֲנָן חָמְיָין רַבָּנִן מַכְרִזִין. אֲמַר לֵיהּ. [אִין אַתְּ] הֲוִויתָה מַשְׁכַּח לָא נָסְבָת. רִבִּי יוֹנָה אָבוּךְ לֹֹא אָמַר כֵּן אֶלָּא אָמַר. הַלְּוַאי כַּד נַשְׁכַּח נַשְׁכַּח מִן פִיּוֹסְרוֹס וּלְגֵיו. אֲפִילוּ כֵן אַשְׁכַּח וְלָא נְסַב.
