    Hillel’s derashah: "Pesach overrides Shabbat". How does one mitzvah push aside another? Here Hillel’s halakhic method is exposed - "kal va-chomer, gezerah shavah, hekesh". A founding moment in halakhic history: the first time a dispute was settled by logic rather than received tradition.

    Hillel the Elder: Architect of New Halakha

    Today we will together build the foundations of Hillel the Elder's learning method, a method that transformed Jewish Halakha. We will see how Hillel, using logical tools, resolved a fundamental question: Does the Pesach offering override Shabbat?

    Insight

    Before Hillel, the rule was 'nothing overrides Shabbat except for saving a life.' Hillel introduced a revolutionary approach: there are mitzvot that override Shabbat, not only due to saving a life, but because of their severity or special importance.

    The question is not simple. On one hand, the Pesach offering is a Torah commandment. On the other hand, Shabbat observance is a fundamental principle of the Torah. How do we decide between them?

    The First Step: Kal Va-Chomer

    Hillel begins with a powerful logical tool: Kal Va-Chomer – 'what is light and what is heavy'. He compares the Pesach offering to the continual public offerings.

    תלמוד בבלי, פסחים סו ע"א
    ומה תמיד שאינו בא אלא מכח צבור, דוחה את השבת, פסח שבא מכח יחיד, אינו דין שידחה את השבת?

    And if the Tamid offering, which comes only from the community, overrides Shabbat, is it not logical that the Pesach offering, which comes from an individual, should override Shabbat?

    1. 1Distinguish between 'light' and 'heavy': The Tamid offering is 'light' because it's a communal mitzvah, whose obligation is less than an individual's.
    2. 2Derive the 'kal va-chomer': If the light (Tamid) overrides Shabbat, all the more so the heavy (Pesach, which is an obligation on every individual) should override Shabbat.

    The elders did not accept this Kal Va-Chomer. Why? Because there's a fundamental difference: the Tamid is a communal offering with a fixed time, while Pesach is an individual offering. You cannot compare them directly.

    The Second Step: Gezerah Shavah

    When the Kal Va-Chomer was rejected, Hillel did not give up. He pulled out another tool: Gezerah Shavah – a comparison based on identical words in the Torah.

    תלמוד בבלי, פסחים סו ע"א
    נאמר כאן 'במועדו' ונאמר להלן 'במועדו'. מה להלן דוחה את השבת, אף כאן דוחה את השבת.

    It says here 'in its appointed time' (Numbers 9:2 - Pesach) and it says there 'in its appointed time' (Numbers 28:2 - communal offerings). Just as there it overrides Shabbat, so too here it overrides Shabbat.

    1. 1Finding a common word: The word 'b'moado' (in its appointed time) appears both for the Pesach offering and for communal offerings.
    2. 2Comparing the law: Since communal offerings with the word 'b'moado' override Shabbat, then the Pesach offering with the same word also overrides Shabbat.
    Insight

    Gezerah Shavah is a stronger tool than Kal Va-Chomer because it is based on the language of the Torah itself. It creates a bridge between two seemingly different topics.

    The Third Step: Hekesh and the Elders' Acceptance

    Hillel was not satisfied with this, but added Hekesh – a comparison based on the proximity of passages. He showed the action of the Children of Israel in the desert, who slaughtered the Pesach offering on Shabbat.

    תלמוד בבלי, פסחים סו ע"א (מובא כראיה שהלל ידע מסורת)
    וידוע הדבר שהיו ישראל שוחטים את הפסח על השבת.

    And it is known that the Children of Israel would slaughter the Pesach offering on Shabbat.

    The combination of the three tools – Kal Va-Chomer, Gezerah Shavah, and Hekesh (and in fact, also ancient tradition) – convinced the elders. They accepted Hillel's ruling. This is a foundational moment where it was proven that Halakha can be learned and changed through logical tools, and not only through received tradition from generation to generation.
