    Source and decoding

    Bava Metzia 14a
לא קשיא: כאן בשטר הלואה, דלא יהיב אינש זוזי בכדי. כאן במקח וממכר, דעביד אינש דזבין ארעא ליומיה.

There is no difficulty: Here it concerns a loan document, since a person does not give money for nothing; there it concerns a sale, since a person may buy land even for a single day.

Shmuel distinguishes loan from sale when warranty is omitted. For a loan it can be a scribal omission; a buyer may accept sale risk. This clarifies his position here, not every authority’s ruling. Define warranty and test transactional assumptions.

    3. 03·TerutzBava Metzia 14a

The Gemara resolves: in a loan, warranty is presumed omitted by scribal error since no one gives money for nothing, but in a sale a buyer may accept land even for a single day.

    4. 04·RayaBava Metzia 14a

The Gemara brings an incident involving Avuh bar Ihi, where Shmuel ruled that for a sale lacking warranty, scribal error is not presumed.

    5. 05·Conclusion of the sugyaBava Metzia 14a

The Gemara concludes that according to Shmuel there is an inherent distinction: in a loan document warranty is automatically assumed, whereas in a sale the buyer willingly bears the risk.
